Dear Pat,
This is to summarize our recent conversation concerning water service to you property at 6461 Highway
392 (aka Windsor Gardner). The Town of Windsor provides water service to the property through a 3/d'
water service and meter at the south end of the property. Raw water allocated to the property is 1 unit of
CBT, which on average yields 195,000 gallons per year. If total annual water usage exceeds 195,000
gallons then the Town of Windsor will require dedication of additional water rights or cash-in-lieu of
dedication. Current cash-in-lieu is $10,000 per 326,000 gallons.
If you wish to utilize a new water service in addition to the previously mentioned existing 3/a" service, as
per Section 13-2-70(3) of the Windsor Municipal Code, it would have to be authorized by the Windsor
Town Board because your property is outside the Windsor corporate limits. Section 13-2-70(3)also
states that water plant investment fees for properties outside the corporate limits shall be double the
standard fee. Standard water plant investment fees are listed at the top of page 5 in the schedule that can
• be accessed at https://windsorgov.com/DocumentView.aspx?DID=1057. As stated in the paragraph
above, total annual water usage above the existing allocation of 195,000 gallons will require water rights
dedication or cash-in-lieu in addition to the water plant investment fee.
If you wish to enlarge the existing 3/d' water service rather than purchase an entirely new one that too
must be approved by the Windsor Town Board and as per Section 13-2-70(2) an additional water plant
investment fee is assessed and raw water dedication or cash-in-lieu is also assessed.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval

of a variance has been granted by the State Board of Examiners of Water Weil Construction and Pump Installation
Contractors in accordance with Rule 18.
•3) Approved pursuant to CRS 37-92-602(3)(c)for the relocation of an existing well, permit no. 247465. The old well must be
plugged in accordance with Rule 16 of the Water Well Construction Rules within ninety(90)days of completion of the new
well. The enclosed Well Abandonment Report form must be completed and submitted to affirm that the old well was
plugged.
4) The use of ground water from this well is limited to ordinary household purposes inside not more than 1 single family
dwelling(s),the irrigation of not more than 0.75 acre of home gardens and lawns, and the watering of domestic animals.
5) The maximum pumping rate of this well shall not exceed 40 GPM.
6) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTICE:This permit has been approved for a change in the location from which you applied for on your well permit
application. You are hereby notified that you have the right to appeal the issuance of this permit, by filing a written request
with this office within sixty(60) days of the date of issuance, pursuant to the State Administrative Procedures Act. (See
