HomeMy WebLinkAbout20111806.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ABATEMENT OF NUISANCE CONDITION ON PROPERTY OWNED BY MID PLAINS INVESTMENTS, LLC - C.R.S. 25-1-518 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mid Plains Investments, LLC, owns property located at 1401 East 18th Street, Greeley, Colorado 80631 ("the Property"), on which household trash, including food waste, has accumulated, thereby constituting a nuisance in need of abatement in accordance as per provisions of Section 25-1-518, C.R.S., and WHEREAS, despite efforts by the Department of Public Health and Environment ("DPHE") staff to resolve said matter, the nuisance has not yet been abated, and WHEREAS, on the 25th day of July, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said nuisance condition, and WHEREAS, a representative for Mid Plains Investments, LLC, was not present or represented at said hearing, although notice of said hearing was provided by the DPHE, and WHEREAS, staff requested that the matter be continued to August 15, 2011, in order to allow the property owner adequate time to bring the property into compliance, and the Board deemed it advisable, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for an Order of Abatement against Mid Plains Investments, LLC, be, and hereby is, continued to August 15, 2011, Cq VAL- , m\d PIN.Ins 2011-1806 7- B°1-l1 HL0038 HEALTH VIOLATION - MID PLAINS INVESTMENTS, LLC PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 25th day of July, A.D., 2011.
