It is acceptable. 1C-The building permit issues will have to be addressed/satisfied before the recorded exemption plat is recorded which will have to be recorded prior to the USR plat. I will be moving condition 1.C as a condition of the recorded exemption or to remove and add this as a condition of the RE only.- I will be adding a condition of approval that the recorded exemption plat shall be submitted for recording the USR plat. 2G -Yes, staff will amend this condition. 1- I discussed the Lot A boundaries with Bruce Barker. The boundaries as submitted are acceptable. 2- Yes they can. The recorded exemption will take 45-60 days for staff to process. Once the plats are finalized the RE and USR plats can be submitted concurrently. • 3- I will add a prior to recording the plat condition that RECX11-0008 shall be submitted for recording. iimail your presentation to Esther Gesick-egesick@co.weld.co.us. Those Conditions are: 1A: As you know, I brought you a revised Landscape Mitigation Plan on Friday. With the exception of the fact that we will need to modify the USR permit boundary shown on that plan to match the boundary of Lot B on the RE application, is it safe to say that the Landscape Mitigation Plan content is approved by staff? 1C: Since we submitted the RE application on Friday, will staff remove this Condition regarding the building permit issues? 2G: Assuming 1C gets removed,will staff then amend 2G to indicate that the Boundary of USR-1779 should match the El oundary of Lot B of the RE? Also related to the RE application, Anne and I have a few questions: • 1. Prior to the hearing, we would like to know that staff is ok with the boundaries for the two lots as shown on the RE sketch plan map since the RE directly affects the USR. When we met, you mentioned needing to review it with Bruce to make sure he was ok with it. As I explained when we met on Friday, Mr. Iverson is adamant that we make the access drive for the property part of Lot A so that it is on the same lot as his structures. Therefore, there will be an access easement on the access drive to give Lot B legal access. In addition, Mr. Iverson wants the land along the ditch to be a part of Lot A -doing this is what Lafarge would want as well since the DRMS permit excludes that finger of the property from the DRMS permit boundary. 2. Could you please clarify how the County wants to handle the timing of the recording of the RE in relation to the USR. Can they both be processed and finalized concurrently so that the RE is just recorded right before the USR? 3. Will you be recommending a new"Prior to Recording the Plat" condition of approval related to the RE application? If so, please share that language with us ahead of time. Finally, we will have a Powerpoint Presentation for the hearing. Once we have it finalized, who should I email it to so that it can be loaded onto the County computer system? We appreciate you working with us to make those changes. Also,just to give you a heads up, there are two other changes we are going to ask the Commissioners to consider making: 1. Eliminate Condition 1F regarding the Improvements Agreement. Since there are no improvements that need to be made to the access and the parking lot is essentially just a open area where Lafarge's employees will park, the only remaining improvements are the planting of the 5 trees per the Landscape Mitigation Plan. It seems like overkill to do an Improvements Agreement for 5 trees. So, we are going to ask the Board to remove Condition 1F and replace it with a note on the plat that indicates the trees must be planted prior to operations. 2. Modify Development Standard 26 to allow the same Hours of Operation at the Iverson Mine as the Board approved for the 35th Avenue Mine site a year ago.
