a subdivision of the State of Colorado, for good and sufficient
consideration, hereby sells and quitclaims to THE PRESENT OWNER

TO SIGN EASEMENT WITH JOHN SAUER FOR
GRAVEL LOCATED IN THE E1-NEk OF SEC. 31,
TWP. 5 N. , RGE 67 W. OF THE 6TH P. M. :
BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colo-
rado, that they sign an easement with John Sauer for gravel located in an irregular
tract of land in the East half of the Northeast Quarter of Section 31, Township 5 North,
Range 67 West of the 6th P. M., Weld County, Colorado, more particularly described
as follows, to-wit:
An irregular tract of land located in the EkNEa of Section 31, Township
5 North, Range 67 West of the 6th P. M., described as follows: Beginning
at a point on the East line of said Section, a distance of 520 feet from
the NE corner; then West parallel to the North line of said Section, a
distance of 94 feet, to the true point of beginning; then in a NWly direction
a distance of 540 feet along the East side of a certain hogback; then in a
SW1y direction, a distance of 137 feet, along the North side of said hog-
back; then in a SEly direction, a distance of 365 feet, along the West side
of said hogback; then East parallel to the North line of said Section, a
distance of 165 feet, along the South side of said hogback to the true point
of beginning.
Also, agreement for ingress and egress. Consideration is $100.00.
Reference is hereby made to the records of the Weld County Recorder, re-
corded in Book 1622 at Page 68.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote:

EASEMENT
THIS AGREEMENT, Made this 19th day of July A. D. 19 62
by and between JOHN SAUER
of Weld County, Colorado, part of the first part, and Weld County, in the State of
Colorado, a municipality, party of the second part:
WITNESSETH: The part cf the first part, for and in consideration of
ONE HUNDRED Dollars,
to first part in hand paid by the party of the second part, the receipt whereof is
hereby confessed and acknowledged, do hereby bargain, sell and convey unto the party
of the second part, its successors and assigns, the right to remove all gravel, sand
and road-making and building material which it shall be able to remove from the fol-
lowing described lands, situate in the County of Weld and State of Colorado, to-wit:
An irregular tract of land located in the East 1/2 of the Northeast 1/4 of Section 31,
Township 5 North, Range 67 West of the 6th P. M. , described as follows: Beginning
at a point on the East line of said Section, a distance of 520 feet from the
Northeast corner; then West parallel to the North line of said Section, a distance
1-' of 94 feet, to the true point of beginning; then in a Northwesterly direction, a
\ distance of 540 feet along the East side of a certain hogback; then in a Southwesterly

`t Southeasterly direction, a distance of 365 feet, along the West side of said

hogback; then East parallel to the North line of said Section, a distance of 165
feet, along the South side of said hogback to the true point of beginning.
Weld County, as a further consideration for this Deed and by acceptance thereof,
agrees that said tract of land shall be excluded from further assessment for taxes;
the first part hereby granting to the party of the second part the right to enter
upon said lands at any time hereafter and to excavate and remove therefrom all gravel,
sand and earthen material which it shall find suitable to its needs, together with the
rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right
to remove therefrom the part of the surface thereof as hereinab ve set forth. This
contract shall be binding upon and inure to the benefit of the heirs, administrators,
and assigns of the part of the first part, and the successors and assigns of the
party of the second part.
