WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 29, 2008, the Board approved Use by Special Review Permit#1665, for High Plains Disposal, Inc.,4501 UW Highway 59N, Lufkin,Texas 75902, for an Oil and Gas Support Facility (Class II —oilfield waste disposal facility) in the A (Agricultural) Zone District on the following described real estate, to wit: Part of the N1/2 of Section 25, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on June 1, 2009 the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and High Plains Disposal, Inc.,with terms and conditions being as stated in said agreement, and accepted Performance and Payment Bond PRF08958838 from Fidelity and Deposit Company of Maryland, 900 Summit Avenue, Fort Worth, Texas 76102, in the amount of$237,337.24, and WHEREAS, on September 8, 2010, the Board approved the partial release of collateral for the Improvements Agreement According to Policy Regarding Collateral and accepted replacement Maintenance Bond No. MNT08958838, drawn on Fidelity and Deposit Company of Maryland, 1400 American Lane, Tower I, 19th Floor, Schaumburg, Illinois 60196-5492, to be retained for the one- year warranty period, reducing the amount of credit available for draw by Weld County to $35,600.59, and WHEREAS,staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend the full release of said collateral, in the amount of$35,600.59. The site is located on CR 54, east of CR 49, near the Weld County Kersey Grader Shed.
