A Site Specific Development Plan and Use by Special Review permit for a Mineral Resource Development including Open Pit Mining and Materials Processing (sand, gravel and stone), including concrete and asphalt recycling, and a concrete and asphalt batch plant facility in the A (Agricultural) Zone District. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 15, WCR 26.75 and WCR 17 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. • WCR 26 and a portion of WCR 17 are under the jurisdiction of the Town of Firestone. Firestone has requested an additional 20 feet of right-of-way for WCR 26 in their referral dated February 8, 2011. The project will utilize the existing access to WCR 15 which has been paved from the entrance to WCR 26. A portion of the site is located within the FEMA mapped Zone A 100-Year Floodplain and/or possibly the floodway. Weld County Code prohibits the construction of buildings within the floodway. The applicant has stated that no new structures will be built. Any stockpiling of materials in the floodplain will require a Flood Hazard Development Permit. The current effective Flood Insurance Rate Map appears to show that the railroad embankment is the eastern boundary of the floodplain. It appears that the applicant plans to remove the railroad embankment during mining operations. It stands to reason, that removing the railroad embankment will extend the floodplain boundaries to the east. Therefore, the applicant needs to show what the impact of removing the railroad embankment will be on the floodplain. Pursuant to the attached letter from FEMA dated January 13, 2011, a Letter of Map Revision will need to be issued by FEMA prior to release from DRMS. REQUIREMENTS: 1. Utilize the existing accesses to the site from WCR 15. No new accesses will be granted. 2. Pursuant to Chapter 15, Articles I and II cf the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is • completely developed. 3. The supporting materials need to show what the impact of removing the railroad embankment will have on the floodplain. The AmFHDP will also need to show what the impact of storing stockpiles and/or berms in the floodplain will be. No stockpiling of material can occur in the floodway. 5. Please show the boundaries of the FEMA approved floodplain on all drawings. 6. The applicant shall comply with County and FEMA floodplain regulations and obtain a Letter of Map Revision (LOMR) from FEMA prior to the release from DRMS. 7. Please address any offsite drainage coming onto the site and explain how it will be handled. The Town of Firestone has provided additional information about drainage in the area. 8. Weld County is not responsible for the maintenance of on-site drainage related features. 9. Add the following notes to the Plat: A. WARNING: LOT MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Parcels # 120932000027, #120932000032, #120932000031, & #120932000035 may not be able to obtain building permits to construct structures. COLORADO DATE: 3/10/2011 Environmental Health Services has reviewed this proposal for a mineral resource development facility including open pit mining and processing, concrete and asphalt batch plant and recycling, scale house and supporting facilities for mining operations. The application states that potable water will be supplied by Central Weld Water District and portable toilets are provided. A water tap assignment from Central Weld Water District was provided with the application; however it is not signed by the District. The use of portable toilets was approved per USR-1102 that was recorded December 1, 1999. • Noise will be restricted to the level allowed in the industrial zone district, which is 80 dba. In addition, berms, conveyors and shroud covers could be installed to limit noise impacts. A minimal noise plan is required for this amendment. A dust abatement plan is required. The plan should include control measures such as, application of water, revegetation, conveyors, reducing vehicle speeds, compaction of road surfaces, berms and covering or watering loaded haul trucks. The application states that water is available through existing water rights for dust control, evaporation and product washing. The source of water shall be included in the dust abatement plan. A waste handling plan is required and should include the name, address and phone number of the waste removal and disposal companies. The plan should indicate how any waste associated with the facility is contained and disposed of. The amount and type of fluids that will be on site is also required. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: • • We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The applicant shall submit a dust abatement plan for review and approval, to Environmental Health Services, Weld County Department of Public Health & Environment. 3. The applicant shall submit a noise abatement plan for review and approval, to Environmental Health Services, Weld County Department of Public Health & Environment. 4. The applicant shall submit a water tap assignment that is signed by Central Weld County Water District, to Environmental Health Services, Weld County Department of Public Health & Environment. 5. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing areas shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. • Vehicle washing areas should be designated on the plat. 6. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, to Environmental Health Services, Weld County Department of Public Health & Environment, if applicable. 7. The applicant shall submit an odor abatement and response plan. This plan shall be implemented at the request of the health department in the event that odor levels detected off site of the facility meet or exceed the odor limit as specified by the Colorado Revised Statues. The plan shall also be implemented in the event that the Health Department receives a significant number of odor complaints and in the judgment of the Director of Public Health, there exists an odor condition requiring abatement. The plan shall be submitted to Environmental Health Services, Weld County Department of Public Health & Environment. 8. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: • 2 • 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential • nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 6. Any vehicle washing areas shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. • 3 • 9. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility at all times. Maintained portable toilets are adequate. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.A permanent, adequate water supply shall be provided for drinking and sanitary purposes, at all times. (Central Weld Water District) 12.The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 13.The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 14.All potentially hazardous chemicals must be stored and handled in a safe manner • in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 15.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 16.The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation Mining and Safety. (OMLR) 17.The operation shall comply with the Mine Safety and Health Act. (MSHA) 18. The operation shall comply with the Occupational Safety and Health Act. Sand and gravel mining is a conditional use in the Town's A District. The Town has adopted standards for Mining and Extractive uses, as set forth in Article 3, Section 16-3-105 (13) of the Mead Development Code. The Town's standards do not permit excavation within 30 feet of a boundary of an adjacent property. The application • proposes excavation can occur within 10 feet. The Town requests the following be considered by the County in review of this application: 1. Require a 30 setback for excavation. 2. Require roads be monitored, and kept free of debris and mud tracking. Mud shall be removed in a timely manner. 3. Require additional detail on the reclamation plan, including vegetation restoration details, and landscaping details adjacent to all property boundaries. 4. The County shall monitor all reclamation, for conformance with the reclamation plan, and keep the reclamation bond in full force and effect. 5. We were seeking a means to maintain some contiguity for the Firestone Trail around your planned operation. As you may be aware, the Town of Firestone purchased over 12 miles of the now abandoned Dent Branch of the UPRR, a portion of which crosses your proposed mine. Part of the purchase included sore "disclaimer parcels" which UPRR indicated had clouded title. Two of these disclaimer parcels exist on your site beginning at WCR 26 and extending north. A unencumbered parcel of the Firestone Trail projects into your site from the north a few hundred feet, which your proposed mining plan preserves. The Town would like to propose a land swap. To ensure that we can someday construct the • extension of the Firestone Trail and also to allow us to eventually widen the adjacent roadways, we are requesting LG Everist deed to the Town a 20' wide corridor adjacent to WCR 26, WCR 17. and WCR 26.75, generally as shown on the attached exhibit. In exchange, the Town will provide a quit claim deed to LG Everist for that portion of the Firestone Trail projecting into your site from the north. In addition, the Town will provide you a quit claim deed for the two disclaimer parcels The land area of the proposed 20' corridor is approximately 170,000 s.f. while the Towns unencumbered parcel projecting into your site from the north is only about 100,000 .5.f. However, it appears that this swap will actually result in more mined land for LG Everist since much of the 20' corridor is at the currently planned top of slope or outside of your mining area. We would ask that the grade of the 20' wide corridor not be lowered any more than it already is and be taken out of the mine plan. We offer the following comments: General: • 1. The proposed/amended mining pit is located west of the Heintzelman Pit 116 specifically between WCR 15 and Holiday Street (WCR 17), north of Zinnia Avenue (WCR 26) and is 377.33 acres. The property is located within the Town's current growth boundary with an anticipated Low Density Residential land use category. 2. We recommend that the County require 20-feet of additional Right-of-Way (R.O.W.) be conveyed to the Town of Firestone along Zinnia Avenue (WCR 26), WCR 15 and Holiday Street (WCR 17) along the property lines. The Reclamation Plan should be revised to preserve the existing grade within this additional R.O.W. (see attached redlines). 3. We requested that the existing Sidehill irrigation ditch be relocated out of the additional R.O.W. of WCR 26. 4. A portion of the former Union Pacific RR Dent Branch crosses the property. This former rail line is part of the Legacy Trail project that Weld County participated in. The mining plan appears to remove the entire rail corridor. We request Weld County require that a 50-foot Legacy Trail corridor easement be preserved and conveyed to Weld County. The alignment of the trail does not have to match the existing railroad alignment but could parallel WCR 26, WCR 15, and WCR 26.75 to connect to the trail property already owned by the Town of Firestone at the north and south boundaries of this application. 5. The proposed mining plan needs to preserve or accommodate the historic 100-yr drainage patterns, including runoff from offsite property to the south and east. The applicant should • review the Town of Firestone's "Sump Basin Master Drainage Plan" for runoff rates and drainage patterns and the recommendations in the plan should be followed. This property is COLORADO CIVIL GROUP, INC. o 1413 W. 29'" Street o Loveland, Colorado 80538 o 970-278-0029 ■ the low point in a very substantial sump, partially created by the old railroad grade and partially natural (see the attached Sump Basin Master Plan Exhibit showing the drainage basins and the convergence of the sub-basins at this site). There is a significant amount of • storm runoff that flows to this property (see the attached Sump Basin Master Plan Table for the corresponding runoff values). Currently, much of the basin is undeveloped but with the next growth cycle that is likely to change. Firestone requires detention of developed runoff for release at historic rates but with development this property will see a significant increase in minor storm and nuisance runoff. The application does not make any mention of how they intend to accommodate this or even that they are aware of the amount of runoff this site will receive. The Town of Firestone recently approved a Conditional Use Permit (CUP) for a Mining Pit on the adjacent property to the east for the Heintzelman Pit owned by Vara Companies. They designed a storm channel around the east, south and western perimeters of their site to convey the 5-year storm. (See the attached CUP, Sheet 2 for storm channel and grading notes). 6. The access for the mining pit is off of the County's WCR 15. The application states that the primary haul route will be south on WCR 15 to Zinnia (WCR 26) and then west to Colorado Boulevard (WCR 13). This should be a condition of the permit approval and any accommodation for "local" deliveries using an alternate route should be better defined. 7. Sheet 1 — The Town of Firestone's ROW for Zinnia Avenue (WCR 26) and Holiday Street (WCR 17) should be listed, see attached redlines. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided • herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The Applicant is requesting an amendment to the existing Conditional Use Permit for the Firestone Pit (previously known as the Del Camino Pit)to add 261.41 acres to the permitted area. This amendment will increase the mining reserve and the life of the mine. The Firestone Pit is an existing sand and gravel aggregate mine that is permitted by the Division Reclamation Mining and Safety ("DRMS") under permit no. M1996-052. Based on the submitted information it appears that the Gravel Mining operation will continue to cause depletions to the Saint Vrain Creek a tributary to the South Platte River due to evaporative losses from exposed ground water, operational losses and dewatering. A Substitute Water Supply Plan ("SWSP") was approved for the Firestone Pit on April 19, 2010 and this SWSP is valid until December 31, 2011. All lagged depletions from the existing and amendment area shall continue to be replaced under a substitute water supply plan ("SWSP") until there is no longer an effect on stream flow. In addition, if stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be released to the stream system within 72 hours.
