RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1100042 AGAINST DAMARIS CALDERON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Damaris Calderon, ZCV #1100042, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Damaris Calderon, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 10, 2011, to allow adequate time for the property owner to remove all vehicles and tires, excluding the one allowed commercial vehicle, from the property or a Use by Special Review application shall be completed and submitted to the Department of Planning Services for processing. He said he received another letter. I asked if he had questions. He said yes. I said okay. He said why are you picking on me when there is a trucking company with 200 employees up the street. I said because I haven't received any complaints on the property up the street. I explained that his property was in violation again for the same violations as in years past. He said his commercial trucks come and go. I said which is why his property is again in violation. He said this other business has commercial vehicles too. I said we can discuss the other property later, but right now we are dealing with his property. He said he brings them to the property between jobs and anytime work needs done on them or if they are not needed. I explained he needed a Use by Special Review(USR)even if they were there only temporarily. He asked why we were picking on him. I said I'm not, but this is repetitive violation issue. I explained that he is also apparently allowing the neighboring properties to have their employees park their cars on his property. He said I try to tell them not to park on my property. I said, you may need to post a sign. He bought up the commercial property down the street again. He said what about the Noncommercial Junkyard. I explained any Derelict Vehicles, automobile parts and miscellaneous debris, must be completely screened from all adjacent properties and public rights-of-ways. He said you know what, I think I'm just going to have to hire an attorney and fight you in court. He said I don't think I should have to go through any process when my trucks are only there at night and weekends. He said and my business is much smaller than the one down the road. I said well maybe they went through a similar application already. He said I know they did, but they are much large than me. I said yes, but if they already went through the application process they are already in compliance. He said he was too.
