4. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the

unplanned ponding of storm run-off.
5. Please add the following note to the final plat: "Weld County is not responsible for the
maintenance of drainage related features."
Flood Hazard Development Standards:

Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.

From: Bethany Salzman, Zoning Compliance Officer
Subject: USR-1758 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV09-00038)was noted. This
violation was initiated due to the operation of an oil&gas roust-about company without first obtaining the
appropriate zoning permits. This case was presented to the Board of County Commissioners through the
Violation Hearing process on June 16, 2009. At that Violation Hearing, the Board of County
Commissioners referred this case to the County Attorney's Office, but delayed legal action for 30 days to
allow more than enough time for a complete Use by Special Review(USR)application to be submitted to
staff for processing. Since this violation has already been filed in District Court(10-CV-30), investigation
fees are required.
Complaint submitted by a Weld County Commissioner.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, the commercial business and storage shall be removed from the property within 30
• (thirty) days or the Violation case will proceed accordingly through the Court process.

Re: USR-1758—Javier Barron-Sixtos — A Site Specific Development Plan and Use by Special
Review Permit for an Oil and Gas Support and Service Facility (roust-a-bout) in the A
(Agricultural)Zone District
Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(1.0)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
• According to the submitted information, potable water will be supplied by an existing well
located on the property, permit no. 28967-A. Well permit no. 28967-A was issued on June 27, 1978
for domestic purposes, as a replacement to the original well permit no. 28967, on the condition that
the old well is plugged and abandoned. The replacement well was constructed on July 20, 1978
however we did not received evidence that the old well was plugged. Therefore the applicant
needs to submit a Well Abandonment Report to affirm that the old well was plugged and
abandoned.
As currently permitted well no. 28967-A cannot be used to serve the site and a commercial
well permit must be obtained. The Applicant filed a well permit application, receipt no. 3646567, to
change well permit no. 28967-A from domestic to commercial purposes. On August 19, 2010 the
application was returned to the Applicant for additional information. The ability for well permit no.
28967-A to be changed to a commercial well will be evaluated at the time that the well permit
application is re-submitted to this office.
Should you have any questions in this matter, please contact loana Comaniciu of this office.
Sinc-rely,
