HomeMy WebLinkAbout20112166 RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #0900341 AGAINST LESTER STROH FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lester Stroh, ZCV #0900341, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of August, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time the matter was continued to August 9, 2011, in order to allow the property owner adequate time for the transfer of the dairy facility to a new operator, with the condition that the mobile homes on the site shall not be occupied by renters during said one-year time period. WHEREAS, on the 9th day of August, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lester Stroh was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. PEGGY GREGORY STATED THAT THEY HAD NO BUILDING ;p. . _ .PERMITS AND AT THIS TIME COULD NOT GET BUILDING PERMITS UNLESS THE ZONING VIOLATIONS WERE CORRECTED. AFTER DISCUSSING THE CASE WITH WENDI INLOES I TOLD HIM THAT AT STAFF LEVEL WE COULD NOT PERMIT THE STRUCTURES AND THEY WOULD NEED TO BE REMOVED IF HE WAS NOT USING THEM AS ACCESSORIES TO THE FARM. I DID TELL HIM HE HAD THE OPTION TO HAVE THIS CASE HEARD THROUGH A VIOLATION HEARING IN FRONT OF THE BOARD OF COUNTY COMMISSIONERS. THEY ARE THE ONLY ONES WITH THE AUTHORITY TO MAKE ANY EXCEPTIONS TO THE CODE. HE SAID HE WOULD DO THAT. 02/12/2010 Office Visit LESTER STROH CAME INTO THE OFFICE. HE STATED THAT HE WAS NOT ENTIRELY TOO SURE WHAT THE FINAL'VERDICT AT THE HEARING WAS. HE SAT DOWN WITH PLANNER KIM OGLE,WHO ALSO ATTEND THE VIOLATION HEARING, AND MYSELF. WE TOLD HIM THAT HE HAD 6 MONTHS TO TRY TO GET • THE DAIRY STARTED BACK UP. AFTER 6 MONTHS THERE WOULD BE A NEW VIOLATION HEARING THAT HE WOULD ATTEND TO GIVE THE BOARD OF COUNTY COMMISSIONERS AN UPDATE AS TO THE STATUS OF THE PROPERTY. IF HE HAD SOMETHING IN THE WORKS AND THE DAIRY COULD USE THE MOBILE HOMES AS ASSESSORIES TO THE FARM THEN THE CASE COULD POSSIBLY BE DISMISSED. OTHERWISE HE WOULD NEED TO BEGIN WORKING • ON HAVING THE MOBIEL HOMES REMOVED. ADDITIONALLY WE REITTERATED THAT THE MOBILE HOME THAT HAD A STOP WORK FOR REMODELING WITHOUT APPROPRIATE PERMITS SHOULD NOT FURTHER BE REMODELED UNTIL THE ISSUES WITH THE ZONING PERMITS HAS BEEN RESOLVED. KIM SUGGESTED HE KEEP THE PLANNING DEPARTMENT UPDATED EVERY FEW MONTHS SO WE KNOW WHERE HE IS AT WITH EVERYTHING. 07/26/2010 Other I sent a courtesy letter reminding him of the August 10, • 2010 Violation Hearing. 07/28/2010 Phone Call I received a phone call from Matthew Crowther(attorney). We discussed the violation case and the steps necessary to correct the violations. Crowther' Subject: RE: Lester Stroh-ZCV09-00341 Dear Mr. Crowther, In order to answer your question, I have to give you some history of the Weld County Code. The first approved Resolution (known as the Weld County Code), was adopted by Board Resolution on October 20, 1967. From 1967 until the August 25, 1981 date, all code modifications were adopted by Resolutions. On August 25, 1981,the Board created a Weld County Zoning Ordinance(the code was no longer tracked by Resolutions). Then on August 30, 1999 the entire Weld County Zoning Ordinance was Repealed and Codified. The only reason we have been able to determine as to why the presence of that date(August 25, 1981)is in the Code is because that is when the Zoning Ordinance was created as a whole. However, the mobile home section of the code has been in place since inception (1967). This is further evident, by the fact that Mr. Stroh obtained Zoning Permits for Accessory to the Farm Mobile Homes (ZPMH-58, ZPMH-218 and ZPMH-445)permits for all 3 (three) mobile homes. ZPMH-58(was approved on 05/16/78) ZPMH-218(was approved on 06/27/79) ZPMH-445(was approved on 05/06/81) I hope this answers your questions, please feel free to contact me if I can be of further assistance. He met with Kim Ogle and I. He indicated that he still has not been able to get anyone to start a dairy out there. He said he has been trying, and at least a couple of times he thought he had someone, but it has always fallen through. He asked if I had seen the property. I told him that I had not yet, but I would be conducting my inspection on Monday, the 9th. He asked if he could meet me there. I said sure. We scheduled an inspection for Monday, August 9, 2010 @ 2:30 pm. 08/09/2010 Property Inspected During an on-site inspection with Lester Stroh, the following items were noted: He drove me around the property and showed me the barns(including the newer milking parlor). We went inside all 3 (three) mobile homes. The first one (furthest North) had a new heating source installed in the living room (looked like a pellet stove or wood burning stove). In the Northern bedroom there was a power strip(extension cord)coming out of the floor(hole was cut in the carpet(but it came up out of the floor). In the middle mobile home, a front porch shed is built around the old metal style stairs leading to the front door. Inside another new heat source. (either a pellet stove or a wood burning stove) Living room floor is carpeted. Both the Northern unit and the middle unit had sliding glass doors that appear to have been added over the years. The furthest Southern mobile home unit- appears to have been gutted all the way down to the base. There were exposed beams inside the entire structure. The siding was new, the installation was new, all the electric work was new it even appears as though they may have changed the rooms/hallways inside the unit. No walls,(sheet rock).was installed. The floor was plywood. See pictures of the outside of the units taken from the county road dated 08/09/10. 06/22/2011 Office Visit Lester Stroh came to the Greeley Planning Office. He wanted Wendi Inloes, but she was out. He arranged an appointment for the next day (06/23/2011 @ 3:30). He said the dairy is up and running. He said the house is rented out(to someone completely unrelated to the dairy). He said he needs to get the 3 mobile homes ready to be used. He said the guy running the dairy is a Kyle Hendrix. Lester(405-6198). I explained with 80 acres, 320 is his max number of cattle. He shook his head. 06/23/2011 Office Visit Lester came back to the Greeley Planning Office. He met with Wendi Inloes, Frank Piacentino, Peggy Gregory and I (Bethany Salzman). He said no one needs them at this moment, but they need to be ready in case the dairy operator needs to put someone out there. He said he could move in his hired hand into one of them. He said he could move into another one of them. We tried to explain that whoever lives in them has to work on the farm full time. Frank tried to walk him through permits, but without the zoning permits,the building permits don't really help.
