G. Piper and .C,P t 4. Fagerberg; that the said L.T.Piper ratified, granted and con- firmed the right of way across the north end of his said forty to said county by accepting payment from, said county for the value of said land, on or about the said year, ifg2; that sometime after the establishment of the said road by the said county,afore- said, and while the same was in progress of being built, along in the intersection between N.W/ of NE4 of section 23, and SW4 of S3 of section 14, aforesaid, the owners of the land adjoining, to-wit: Charles Fagerberg and L. G. Piper agreed that the road could have a temporary construction, if agreeable to the county so to do, in that the said road could be placed.- 4r-, feet to the north of the center of the true line of the road, and thereby acc omodating the said Piper, in that certain shade trees then growing in the road could be left standing for the convenience and pleasure of the said Piper ; that te county constructed t;:e road on such line aecomodating the said Piper to that extent; that the agreement so to do and permission granted by the said Fagerberg to the said Piper to build the road upon Fagerberg's land and north of the true line of the road owned by the county commissioners:ioners as aforesaid, was a temporary matter, and grantert by the said Fagerberg for no consideration whatsoever except as a temporary convenience and accomodation to . the said Piper therein., and if acted upon by the county, was agreed in no way to be binding upon said Fagerberg, whenever the said county was reay to build and maintain a more thorough and perfect thoroughfare upon the said right of way owned by it, t', ty, as above set forth. //3Ug IIT. That the grove' of trees, the saving of which was the object in making such contour of the road, to the north, and on the said Fagerberg 's lAnt4at said point as aforesaid, have been long since chopred down and removed; that the cause anl reason there- fore, as between the owners of said land, for the jog in the road at the place as aforesaid, has been removed. IT. That the said county is now at work or about to become at work on said road, and is interested in the expenditure of a large sum of money Lhereon in permanently improving and fixing said road on its right of way between section 14 and 23, township 6 north, range 66 wept, and that it is desirable that the con- struction of the said road be made upon the true line on the county's ain+ a- right of way, owned by it, th , between said sections aforesaid, for the aforesaid purposes; that the plaintiff :las been informed and believes, :d so states 511/2 the fact to be, that the surveyor 's corner at ^f section 14, said township and range, has become misplaced and alleges that /4 .fir true right of way can be ascertained by a proper resurvey of the same; alleges that such survey should be made, and the road confined to the lana owned by the county and the proper locations found by proper survey between said sections ; alleges on information and belief that Horace Eldridge, the present owner of ITW- of of said section 23, has pretended to sell a rikht of way for a ditch to one Harvey E. Witwer from the north end of said land and that the said Witwer has taken possession of the same and has built said line of ;.itch• Alleges on informatim and belief that said line of ditch so built is built on the high- ! :tray or on the line owned by the county, off of the north side /PcA4 of of EE of section 23, and that said ditch is now con- 3 4 k.. 1: j 1� 1. i ' str?oted and maintained by the said Witwer in the county road at said place; that Daniel Strohi, roadoverseer for the district wherein said road is situated is now constructing and doing new work upon said road at the point aforesaid, and will, if not otherwise directed, build said road to the north of the right of way as owned by the county at the point as aforesaid,, making a jog in the line of the road at the point aforesaid and thereby taking the land of the plaintiff herein for road purposes, all of which_ iswiecessary providing that the said Witwer 4 compelled to vacate the ditch now maintained by him in the road belonging to the county as aforesaid. V. On information and belief alleges that the said. Witwer never obtained the consent of this board of county commissioners or otherwise to maintain a ditch in the county road at the point aforesaid; alleges that the true interests of the community will be best subserved by having said road changed to the line cv (relied by the county on t straight line east and west at the point above described. WHEREFORE petitioner demands judgment or an order of the Honorable Board of County Commissioners that they are the owners of 60 feet right of way as evidenced by the records belonging to the county pertaining to said road between }VJ* tett i k of section 23 and SW+ of SE4 of section 14, township and / range aforesaid; that the same be vacated by the said Witwer for ditch purposes and that if not so vacated when notified so to do that the proper remedy be Sought by the county attorney for the vacation of the same under the order of the board of county commissioners; that said line of road be immediately surveyed and when surveyed that the said Stroh', as roadoverseer or superintendent be directed to build said road accordingly on the line as found by such. survey at said point as aforesaid; 4 S . /p03,10 . Qr Gentlemen: M Your petitioners , owners of land adjacent to the hereinafter described public highway and owners of land to reach which it is necessary to travel over said highway, do respectfully petition your Honorable Board to take such measures and do such things as may be necessary to care for waters which flow upon and Akr gather upon said highway. i. Your petitioners further represent that said highway is that portion of the public highway between Sections Eighteen (18) and Nineteen (19) in Township 04.4 Six (6) North of Range Sixty-five (65) West of the 6th bit P. L. , Weld County, Colorado which lies westerly for a distance of about a quarter of a mile from the inter- ft section of said highway with the Lincoln highway; that since the construction of said Lincoln highway, waters falling upon Sections Seventeen (17) and Eighteen (18) PS follow the general trend of the land southward, and are It. gathered and accumulated by the ditches along said t highway, with the result that same flow in and upon the public highway between Sections Eighteen and Nineteen, Rf.,•; whete they gather and accumulate upon said highway and the lands adjacent thereto to such an extent that the said highway is rendered almost impassable and the 44 houses adjacent thereto are surrounded by said waters and the said lands adjacent to said houses are covered with water and injure them for farming purposes for which they are adapted.
