RE: ACTION OF THE BOARD CONCERNING ZCV #1000159 AGAINST LARRY AND
MARIA MATHENA FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Larry and Maria Mathena, ZCV #1000159, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of June, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Larry and Maria Mathena, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 14, 2011, to allow adequate time for the property
owners to remove the remaining debris from the property and either, register and plate the two
camper trailers, have them removed from the property, or install proper screening from all
adjacent properties and public rights-of-way.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000159 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Larry and Maria Mathena to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until September 14, 2011, to allow
adequate time for the property owners to remove the remaining debris from the property and
either, register and plate the two camper trailers, have them removed from the property, or
install proper screening from all adjacent properties and public rights-of-way.

VIOLATION REMEDY:
As I indicated in my initial letter and we discussed over the phone, while the presence of a NONCOMMERCIAL
JUNKYARD consisting of DERELICT VEHICLES, iron/metal, building materials and miscellaneous debris is an
allowed use within the Agricultural Zone District, it must be completely SCREENED from all adjacent properties
and public rights-of-ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of
current registrations shall be submitted to this office. Any trash shall be removed from the property or would be
considered an illegal landfill.
Please see the following notes taken during an inspection I conducted from the road right-of-way on April 1,
2011:
Upon a visual inspection of the property, the following items were noted: LARGE amounts of wood (all over
Northern side of property). I noted a tree chipper and 1 commercial vehicle(not a violation). 1 2-tone brown
truck-derelict. I noted several camper/trailers(possibly derelict) (1 was expanded), mattress laying on top of

one of the mulch piles and miscellaneous debris over by the campers. See pictures dated 04/01/2011.
Please be advised as we discussed, if the property is brought into compliance by June 13, 2011, the above
Hearing will be cancelled.
The sale of wood would require a Use by Special Review(USR) permit.
RECOMMENDATION:
The Department of Planning Services recommends this case to be forwarded to the County
Attorney's Office for immediate legal action.

OTHER CASE HISTORY:
12/28/2010 Phone call Larry Mathena (454-0939 or 301-7653 cell) called. He said his wife
received a letter talking about some trash. He said he thinks he
knows what the letter was talking about and he has already been
working on cleaning it. He said he was already scheduled to go into
the hospital for knee surgery on January 4th. He said he is trying to
figure out if he could take paint, couches, computer screen, etc to
the landfill. I told him about household hazardous waste and
transferred him to their voice mail. I told him I would be sending a
letter which typically grants 30 days, but I would make it for 60 days
instead. He thanked me.

Beth:
I did contact Larry Methina in the Galeton area. Contact was made
at 2:50 pm, Tuesday, December 28, 2010.
He had already talked with the HHW program about paint disposal.
I advised him about obtainment of an Open Burning Permit for
disposal of some wood wastes that have accumulated around his
home and property. He said that he will be in Greeley and apply for
a permit on Wednesday, December 29, 2010.
02/22/2011 Phone call Larry Mathena called again. He said he has accomplished a lot of
the clean-up but isn't quite finished. He said he would need a little
more time. I explained that I would agree to grant additional time,
but the way I was going to approve additional time was to schedule
their case for the April 12th Violation Hearing. If the property was

brought into compliance the Violation Hearing would cancel, if not
they would need to attend the hearing to request any additional time
straight from the Board. He said he understood. He then asked
what a derelict vehicle was. I explained. He asked about 2 of his
camper/trailers. I said same items apply. He said well then you
really need to check out the property on the corner of CR 51 and CR
76. I asked for an address. He said it is right on the corner. I told
him I would see if I could tell what he was referring too.
04/06/2011 Phone call Larry Mathena called again. He said he has been working on it, but
isn't quite done yet. I explained that I conducted an inspection from
the road on 04/01/11. I explained that there was a considerable
amount of wood. He explained that he sells it during the winter. I
explained that would require a Use by Special Review(USR) permit.
He said he can't afford to apply for anything like that. He said he will
just use it himself. I explained that he needs to reduce the amount
to a reasonable amount of wood. We briefly discussed the
commercial vehicle. I told him that 1 commercial vehicle is a Use by
Right. He indicated he had already cleaned up around the
camper/trailers. He indicated he had just removed the 2 tone truck.
He asked how the complaint was initiated. I explained it appears
that the initial complaint was regarding metal flying off of a building
and blowing around in the road. He said he cleaned that up. I said
yes, but when we receive a complaint, we look at the entire property.
He said he would see what he could do before the June Violation
hearings. I asked him to give me a call. He said he would.

business day before or as soon as possible to the above mentioned violation hearing date.
The Department of Planning Services staff will be recommending that the Board of County Commissioners

must be completely SCREENED from all adjacent properties and public rights-of-ways;
otherwise, any Derelict Vehicles shall be operational at all times and evidence of current
registrations shall be submitted to this office. Any trash shall be removed from the property
or would be considered an illegal landfill.
DERELICT VEHICLE:A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way
or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202
to 42-2-227, C.R.S. This definition shall not include implements of husbandry,farm tractors or
