RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000122 AGAINST MILAN AND MARIE HALEK FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Milan and Marie Halek, ZCV #1000122, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of January, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Milan and Marie Halek, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 11, 2011, to allow adequate time for the property owner(s) to finish the building requirements of their new home in Boulder County and vacate their residence in the shop structure. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000122 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Milan and Marie Halek to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until March 11, 2011, to allow adequate time for the property owner(s) to finish the building requirements of their new home in Boulder County and vacate their residence in the shop structure. I advised him that it appeared that the house was utilized as 2 separate rental/dwelling units(a duplex for lack of a better term). He said that was correct. I advised him that the utilization of this house as a duplex is a zoning violation. He said he would get in touch with the property owner. I advised him that I sent a letter that morning, but I also gave him my name and number. 09/27/2010 Phone call Marie Halek(303-775-3491) called. She indicated that her property management company called her and asked her to give me a call. I explained that the conversion of the house into a duplex (upstairs and downstairs)without the appropriate zoning/building permits was a violation. She said they purchased the property back in 2001 at a "public auction""as is". She said the previous owner had already separated the house into separate living facilities (the previous owners were divorced and he lived downstairs and she lived upstairs). I explained that while I understood she may have not made the modifications, since she is the current property owner, she would be the responsible party to either permit them or remove them. I started to explain the Pre-Application Request meeting paperwork-my office phone started acting up and it disconnected us. 09/27/2010 Phone call I called Marie Halek (303-775-3491) back as soon as my office phone cord was repaired. I then asked if they reside on the property. She said yes in the guest house. I advised them that was a violation as well. She said when they bought the property that was a shop with an office and restroom. I advised that the previous owner must have made several modifications to the property without permits. She said they are staying it in while they finish building their house on Pebble Ct, then it is utilized when friends/family visit. She also said it could be a rental unit. I explained that the Pre-Application paperwork they received should be completed, a brief narrative and a map of the property (buildings, septic system, access, etc) should be submitted back to Planning. I told her to call if she had questions when she received it. She said the new house is not finished. I explained the other option we discussed and they said would work was that they could move from the garage (converted dwelling) into the house. She said the previous tenants kept ducklings or something in the house and due to her health issues, the entire house will need to be re-carpeted, repainted and completely cleaned.
