RE: ACTION OF THE BOARD CONCERNING BCV#1100003 AGAINST GLEN TRUE AND
SHARON WELLS-TRUE FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Glen True and Sharon Wells-True, BCV#1100003, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Sharon Wells-True, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until July 10, 2011, to allow adequate time for the property owner to
submit all remaining required documentation to the Department of Planning Services for both
the Use by Special Review and all required permits.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that BCV #1100003 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Glen True and Sharon Wells-True, to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until July 10, 2011, to
allow adequate time for the property owner to submit all remaining required documentation to
the Department of Planning Services for both the Use by Special Review and all required
permits.

OTHER CASE HISTORY:
01/17/2011 Office Visit Glen and Sharon True came to the office and met with Frank, Ken,
Kim, and myself. Mr. True is a bicycle tire and tube salesman and
sells True Goo tire sealant. He also has an offsite location.
The building post frame and not structural steel as stated on the agricultural
exempt permit application. It has two bathrooms, a kitchen, office
sauna, exercise room, has been insulated, and has plumbing and
electric. Overhead heaters have been installed.
Ken told them they need an architect and structural engineer and all
covered utilities will need to be uncovered to be inspected.
Kim stated they need to permit the business as a home business
and the kitchen will need to be removed or a permit submitted for a
second dwelling on one parcel.
Mr. True stated he is an engineer and requested he be able to
engineer the building - Frank and Ken stated that would be a conflict
of interest. He was also told he can return the building back
to its original intent and remove all the interior improvements. He
may permit the electric and plumbing for strictly agricultural use.
02/25/2011 Office Visit Art Ranes, architect, was in the office today to obtain information
regarding requirements for the change of use of the agricultural
exempt building.
04/05/2011 Phone Call Bethany and I had both received phone messages from Glen True so
we returned his calls with a conference call with Kim Ogle, Bethany,
and myself. Mr. True said he was to meet with the architect and
engineer tomorrow morning so we will call him Thursday afternoon
(04/07/11 at 2:00)to discuss what he has decided.
05/04/2011 Office Visit Ms.Wells-True was in the office and met with office staff. She submitted
the payment for the USR and we discussed the building plans. Further
clarification is needed as to what is living space, what is used for the
business and what is storage for the business and/or personal storage.
Ken asked if he could do a site visit to help determine the uses and
requirements to complete the plan review. Ms.Wells-True stated she
would have to clear that with her husband and would get back with him.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on May 10, 2011, at 10:00 a.m., to consider the
violations. The property is in violation of the following Sections of the Weld County Code:
Section 29-3-10 "Building permit required."
Section 29-3-50 "Existing use or occupancy."
Section 29-3-160 "Zoning compliance."
To bring your property into compliance:
A permit application and all applicable documentation shall be submitted for the
change of use of the "agricultural exempt" building, fees paid, the permit issued
and all inspections completed.
This meeting will take place in the County Commissioners Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative
be in attendance at this meeting to answer any questions the Board of County Commissioners might
have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate
that you were made aware of the nature of the violation, the action necessary to correct the violation,
and that you were given sufficient time to remedy the violation. If you have any questions concerning

Dear Mr. True and Ms. Wells-True:
It has been determined that the property located at 5227 County Road 18 is currently in violation of the
Weld County Code. On June 4, 2009, you were issued Agricultural Exempt permit number COC09-
00031 for a structural steel building on slab with no electric and you have stated you installed utilities in
the building. Additionally, you stated you have completed some interior construction which includes an
office which is altered from the "farm equipment storage" as stated on the permit application for the
building.
A permit application shall be submitted for the change of use of the building including utilities plus all the
required information required to process the application which will include engineered building plans.
It is the intention of this office to assist and cooperate with you without imposing undue hardship;
however, we have no discretion in this matter if you fail to correct this violation within 14 (fourteen) days
from January 12, 2011. Failure to do so could result in this office scheduling the violation before the
Board of County Commissioners to consider whether to refer the case to the County Attorney's Office for
legal action.

The following conditions must be met prior to determining if a building is considered agricultural exempt. I, the
undersigned, understand and agree to the following conditions of this zoning permit:

7. Should the use of the building not be listed as a use-by right or accessory use in the Agricultural Zone District, a Use by Special
Review permit may be required.
The use of the Agricultural Exempt Building shall be verified periodically by the Departments of Building Inspection and Planning
Services.A change in use without the consent of the Departments of Building Inspection and Planning Services will be considered a
violation of the Weld County Code and shall be prosecuted accordingly.
L. No utilities are allowed to the structure except electricity and water for the specific purpose of maintaining farm implements and
cleaning and watering livestock and poultry. Any additional utilities such as bathroom facilities or heating will void the agricultural
exempt status. (Although an Agricultural Exempt Building does not require any structural permits or inspections,a building permit or
electrical permit and fees are required prior to the commencement of any water piping or electrical work.Electrical shall be wired to
dust proof environment in accordance with 2008 National Electrical Code Article 547).
. There shall be no parking of private vehicles within the structure. Such use reclassifies the structure as a garage,which requires a
