Home My WebLink About780805.tiff RESOLUTION RE : RECORDED EXEMPTION NUMBER 307 - ERVIN AND KATHLEEN FRANK, AMENDMENT TO ALLOW FILING UPON DOCUMENTATION FROM THE HEALTH DEPARTMENT THAT SEWAGE PROBLEMS HAVE BEEN CORRECTED AND AGREEMENT WITH FUTURE LANDOWNER. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , Recorded Exemption No. 307 for Ervin and Kathleen Frank was approved on the 5th day of April, 1978 by the Board of County Commissioners of Weld County, Colorado and said Resolution contains certain conditions , and WHEREAS, the Board of County Commissioners wish to clarify said Resolution and to amend a portion of the conditions on the original Resolution approving Recorded Exemption No. 307, and WHEREAS, the Board of County Commissioners deem it advisable to amend Recorded Exemption No. 307 to provide that Recorded Ex- emption No. 307 shall be filed after the applicants have provided proper certification from the Health Department that sewage prob- lems on the site have been corrected and the future landowner has submitted documentation he will cooperate with the County regarding problems with the drain tile located on the easterly portion of the property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Recorded Exemption No. 307 may be recorded upon the receipt by the Board of County Commissioners of Weld County, Colorado of certification from the Health Department that sewage problems on the site of Recorded Exemption No. 307 have been corrected and upon receipt of documentation from the future landowner that he will cooperate with the County regarding problems with the drain tile located on the easterly portion of the property.
