The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may be all-inclusive, as other
issues may arise during the remaining application process.
COMMENTS:
Weld County Road Classification Plan (FHU):
WCR 29 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a
60-fo :t right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Access:
• The applicant shall utilize the existing residential access to the property.
1. The existing access and gravel driveway shall be graded and drained to provide an all-weather
access to the facility.
2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Storm Water Drainage:
The applicant has provided a water quality depression that is acceptable to the Public Works department.
3. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
4. Please add the following note to the final plat: "Weld County is not responsible for the
maintenance of drainage related features."
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SF HA) as determined by the Federal Emergency
Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for a dog kennel for raising
up to 25 dogs for a breeding operation. All structures are in place and no new
construction is proposed. The existing garage and a portion of the property will be
utilized for the operation. Water is supplied by Central Weld County Water District
(Account No. 116140); however, this Department requests documentation that the
District has no objection to this request for a kennel operation.
• The facility will not have any employees except for the owners. There will be clients
who come to the site and they must have access to potable water, restroom and hand
washing facilities. A residence is located on the property and it appears from the
application the existing septic system may be utilized for the kennel operation. There
was no mention if any water will be used in the daily sanitation of the kennel and/or
supplies (bowls, bedding ect). The existing septic system was permitted for a 2
bedroom residence (SP-9600206) and will require an engineer review to ensure there is
sufficient capacity to serve the proposed kennel operations.
The application indicates that waste produced from the kennel operation is collected as
needed and placed in a 3 cubic yard dumpster which is picked up weekly by B & C
Refuse in Platteville. This information will be sufficient for a waste handling plan.
A dust abatement plan was submitted with the application. The applicant is proposing to
apply water to control on-site dust. The road and parking area on the facility consists of
road base materials and/or recycled asphalt.
Noise will be restricted to the level allowed in the non-specified zone district.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:

• We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. In the event the applicant intends to utilize the septic system at the existing home
for clients and kennel sanitation needs, the septic system shall be reviewed by a
Colorado Registered Professional Engineer if the usage exceeds 4 people and/or
wastewater from the kennel flows into the septic system. The review shall
consist of observation of the system and a technical review describing the
system's ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
2. Submit documentation from Central Weld County Water District indicating that
the existing tap is sufficient for the kennel operation.
3. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
• evidence that the applicant is not subject to the PACFA requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

• 5. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. .
9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and clients of the facility, at all times.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
• purposes. The facility shall utilize the existing public water supply. (Central Weld
County Water District)
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Subject: USR-1756 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV10-00037)was noted. This
violation was initiated due to the presence of more than 4 (four) dogs without first obtaining the
appropriate zoning permits. This case was scheduled to be presented to the Board of County
Commissioners through the Violation Hearing process on August 10, 2010, but due to the receipt of this
application the violation case was remanded back to the Department of Planning Services for processing.
No investigation fee is required.
Complaint was submitted by a Colorado PACFA Inspector.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied by the Board of County Commissioners please request this violation case to be
referred to the County Attorney's Office with a delay of legal action for 30 (thirty)days to allow adequate
time for the reduction of dogs to 4 (four) or fewer to occur.

Kennel (up to 25 dogs and 1 cat) in the A (Agricultural) Zone District.

Narrative: Weld County records indicate the building permit for the garage (BC-0101119) has
expired, was never finalized and has several outstanding building corrections.
1. A building permit is required for the change of use. An application and building permit is
required for each structure. A plan review is required for each building or structure for which a
• building permit is required. Two complete sets of plans are required when applying for each
permit. Include a Code Analysis Data sheet for the Weld County Building Department for each
structure that requires a permit. Submittal plans shall include a floor plan showing the specific
uses of each area for the building. Plans shall bear the wet stamp of a Colorado Licensed
Architect or Engineer.
2. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2008 National Electrical Code; 2006 International Mechanical Code; 2006
International Plumbing Code: 2006 International Energy Code;2006 International Fuel Gas
Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code.
3. All building plans shall be submitted to the Platteville-Gilgrest Fire Protection District for
review and approval prior to issue of Building Permits,
