HomeMy WebLinkAbout20110337 • NOTICE OF PUBLIC HEARINGS ON ST.VRAIN SANITATION DISTRICT'S PETITION FOR AMENDMENT OF SERVICE PLAN Notice is hereby given that the Board of Directors of the St. Vrain Sanitation District (herein, "District") has petitioned the Board of County Commissioners of Weld County for an amendment to the District's previously approved Service Plan to extend the potential Service Area of the District to include an area encompassing approximately 9,206 acres of land generally located in an area bounded by CR 32 to the North, CR 6 to the South, the Platte River to the East, and WCR 1 to the West; and to increase the District's wastewater treatment plant's capacity. DATE AND TIME OF PLANNING COMMISSION HEARING: January 18, 2011 at 1:30 p.m. Pursuant to §32-1-207(2), C.R.S., and the Weld County Code, a public hearing will be held before the Weld County Planning Commission in the Hearing Room, Weld County Planning Department, 918 10th Street, Greeley, Colorado. DATE AND TIME OF BOARD OF COUNTY COMMISSIONERS HEARING: February 2, 2011 at 9:00 a.m. A subsequent hearing will be held in the Chambers of the Board of County Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th Street, First Floor, Greeley, Colorado 80631, at the times specified below. PURPOSE: The purpose of the hearings is to provide the public with opportunities to comment upon the requested expansion of the potential Service Area of the District and the wastewater treatment plant. Colorado state statutes require the approval by the Board of County Commissioners for any • "material modifications" of the originally approved Service Plan. By stipulation of the Board of County Commissioners in 1988 (when the District's original Service Plan was amended) any expansion of the District's potential Service Area is deemed to be a "material modification" requiring approval of the Commissioners after a public hearing on the issue of expansion of such area. Expansion of the potential Service Area would mean that those properties lying within the expanded area would be eligible, at the discretion of the individual property owners, to apply for inclusion into the District and to obtain sanitation service from the District subject to the District's Rules and Regulations. Although the District's current mill levy is .737 mills, no property within the potential Service Area would be taxed until and unless the property owner petitions for legal inclusion into the District's boundaries and requests sanitary sewer service. LEGAL DESCRIPTION OF ST. VRAIN SANITATION DISTRICT 208 BOUNDARY: The current SVSD 208 boundary includes approximately 120 square miles. PROCEDURE FOR OBJECTION: Any person in support of, or objecting to, the expansion of the potential Service Area or the increase to the wastewater treatment plant's capacity may appear at such date, time, and place indicated above to address the County Commissioners. In addition, any party that owns property within the proposed Service Area may file a written objection to the inclusion of that party's property into the proposed Service Area no later than January 23, 2011, such date being 10 days prior to the hearing. The Board of County Commissioners may consider and determine such requests at the hearing.
