O' WHEREAS, the Board of County Commissioners ofWeld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a public hearing was held on October 26 , 1977, ,. in the Chambers of the Board of County Commissioners of Weld c, County, Colorado, at 2 : 00 o'clock p.m. , for the purpose of hearing the petition of John Shupe, Hill-n-Park, P . O. Box 929 , ^-: Greeley, Colorado, 80631, requesting a change of zone from MH- Mobile Home District to B-Business District, for a portion of Hill-n-Park, a Subdivision located in the South z of Section 26 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, more particularly described as follows , to-wit: Lot A as Platted in Hill-n-Park Subdivision and filed in Weld County, Colorado WHEREAS , the petitioner was present, and WHEREAS, there was no opposition to the request of the petitioner for a change of zone upon the aforementioned tract of land, and WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning Resolution authorized the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts , and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the petitioner and the recommendations of the Weld County Planning Commission, and having been fully informed and satisfied that the request for rezoning complies with the Weld County Comprehensive Plan and the conditions set out in Section 8 . 2 and 8. 3 of the Weld County Zoning resolution; NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the petition of John Shupe for a change of zone from MH-Mobile Home District to B-Business District on the above described tract of land, be, and hereby is, granted subject to the recommendation of the 770026 14 K g�S° 3 x'745305 Department of Engineering Services that no driveway access be allowed directly on to County Road No. 52 . Is it impractical, impossible, or undesirable to develop the land according to its current zoning classification. Answer: Yes. The current zoning is mobile home. The parcel to he rezoned is nearly one acre in size and has only one water and one sewer tap. All the lots in the current Park range from 6600 square feet to 10,000 square feet. These are less than one quarter of an acre. 2. Would the proposed rezoning benefit the entire County by allowing a typical develop- ment which is needed and cannot locate in other parts of the County. Answer: The immediate need for a convenience store, self-service gas pumps, and car wash is obvious. The closest store of any type is over 3 miles away. The Park residents are vocal about the necessity and this is evidenced by the petition that is part of this application. 3. Would the proposed rezoning benefit lands adjoining the area requesting the change. Answer: As stated in the previous question, the need for a convenience store is quite evident based on population and vocal and written support by the area residents. The proposed development will he situated on Lot A. 4. What features apply to the property requesting rezoning which make it logical to re- zone this tract and not to rezone in a similar manner surrounding properties which may have like land use characteristics. Answer: The lot to be rezoned was originally intended for commercial use based on the fact that over 600 mobile homes were to be in the area and commercial business would be a necessity for the people. Now that West Hill-N-Park is being developed, there will be over 600 mobile homes adjoining the proposed rezoned land. 5. Why are other areas in the County already zoned according to the requested classi- fication, unsuitable for the development which is proposed. Answer: The specific development for Lot A would be a natural for the immediate area residents. It would be esthetically appealing to the area and would serve the Park and immediate area residents adequately. 6. What proof of evidence is available that the original rezoning is faulty or that changing conditions in the area justify rezoning at this time. Answer: At the time the preliminary plat was submitted, Lot A was designated "Commercial Area". When the final plat was approved, the lot was alphabetically lettered "A" as opposed to numerical numbering of all mobile home lots. The architect failed to put the word "Commercial" under the letter "A" and consequently the lot ended up under "Mobile Home" zoning. This was strictly an oversight on behalf of all concerned, be- cause all parties to the original subdivision were convinced that Lot "A" was commerci- ally zoned in the original plat. 7. Please submit Economic or other evidence that the area covered by the petition, needs additional Commercial. or Business in the area. (To be answered on changes requested for Business or Commercial). Answer: There are not any commercial areas in the immediate area now. The attached petition supports the need for a convenience store. People in Dos Rios have also indicated a need for a business entity in their area. 8. Give some evidence of the proposed business or commercial enterprises that are to locate in the requested area and a tentative time schedule for construction. (To be answered on Changes requested for Business or Commercial). Answer: The immediate business will be a convenience store on Lot A using a 40' X 48' steel building with attractive stonefacing on the front to enhance beauty. There will also be provided four self-service gasoline pumps that will be monitored by the store leasee. A three bay car wash will he built on the North end of Lot A. The operation is identical to three other stores in the Greeley Area: (1) the 11th Ave. Pantry at 11th Ave and 34 ByPass; (2) the 18th St. Pantry at 505 18th St. ; and (3) the 9th Street Pantry at 1403 9th Street. The contractor is ready to start as soon as the rezoning is approved. Construction should take 90 - 120 days. The driveway will be paved and attractive landscaping will be provided. The addition of the store will be an esthetically appealing improve- ment to the area and will blend nicely with the existing Fire Station. Ten sets of plans are attached for your information. Mr. Shupe was represented by Joel Rothman, who presented the request to the Board. No one in the audience was in opposition to the request. Access onto County Road 52 had been reviewed by the County Engineer' s Office and it was recommended by said Office that no access be allowed onto County Road 52. Adequate access is available on Yellowstone Drive. After all testimony was heard, Commissioner Dunbar made a motion to grant the change of zone from MH to B with access to be limited to Yellowstone Drive and no access to be permitted onto County Road 52 . Commissioner Carlson seconded the motion and it carried unanimously.
