RICHARD McCOY TO EXTEND THE CLOSING DATE OF HIS CONTRACT WITH WELD COUNTY FOR THE PURCHASE OF CERTAIN REAL ESTATE OWNED BY WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 13, 1977, the Board of County Commissioners of Weld County, Colorado, entered into an agreement with C. Richard McCoy as Purchaser, for sale and purchase of certain real estate owned by Weld County, Colorado, and more particularly described as follows , to-wit: Lots 1, 2, 3, 4 and 5 inclusive , Cranford Sub- division, Block 162, City of Greeley, Weld County, Colorado, and WHEREAS, paragraph number 10 of said real estate contract pro- vides for a closing date of October 30 , 1977 for payment of the balance due and owing of the purchase price, and further states that in the event of default by the Purchaser, if the Seller elects to treat the Agreement as void, then $5, 000. 00 which shall be paid by Purchaser to the Seller as a down payment, shall be retained by the Seller as liquidated damages, and WHEREAS, C. Richard McCoy has informed the Board of County Commissioners that he is not in a position to take possession and pay the balance of the purchase price, as set forth in the contract dated June 13, 1977 . Mr. McCoy has informed the Board of the difficulties he has encountered in trying to obtain federal grant dollars to pay this debt, and he has requested the Board of County Commissioners to allow him an extension of four month' s time in which to pay the balance remaining of $186 , 000 . 00, and WHEREAS, after careful consideration and discussion of the financial burden this real estate transaction has placed on Weld County, the Board of County Commissioners deems it to be in the best interest of Weld County to deny C. Richard McCoy' s request and to take the matter under further discussion for future deter- mination. /Jsa©a/ �i e Crn 770498 t, .. Pr f Lo Ali n,. �, 8" NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, as stated in the aforemen- tioned real estate contract dated June 13, 1977, said Board does consider this contract breached and void and of no further effect, and, therefore, the Board of County Commissioners of Weld County, Colorado, does deny C. Richard McCoy' s request. BE IT FURTHER RESOLVED by the Board of County Commissioners, that the $5, 000. 00 down payment made by the Purchaser, as afore- mentioned, be, and hereby is, accepted. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 31st day of October, A.D. , 1977.
