RE: AGREEMENT BETWEEN WELD COUNTY AND THE CITY OF GREELEY,
COLORADO FOR THE USE OF COUNTY OWNED VOTING MACHINES
TO BE USED IN THE CITY OF GREELEY ELECTION ON MAY 20, 1975.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board that there is a need
of the City of Greeley, Colorado, for the use of a certain number of voting
machines, being the property of Weld County, Colorado, in specified voting
precincts located in various parts of the City of Greeley for an election to be
held on May 20, 1975, and
WHEREAS, the City of Greeley, Colorado, has presented an agreement
providing for the use of a certain number of county owned voting machines in
said City Election, all as recited in said agreement attached hereto and made
a part hereof by reference, and
WHEREAS, the Board believes it to be in the best interest of the County
to enter into such agreement on the basis recited therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners, Weld County, Colorado, that the said agreement providing for
use by the City of Greeley, Colorado of a specified number of county owned
voting machines in the City Election on May 20, 1975, copy attached hereto
and made a part hereof by reference be, and it hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is author-
ized to execute the agreement as submitted and to make the same effective
forthwith.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 28thday of May, A. D. , 1975,
nunc pro tunc as of April 16th , A.D. , 1975.

AGREEMENT
THIS AGREEMENT, made and entered into this 16th day of April,
A. D. , 1975, by and between WELD COUNTY, State of Colorado, by the Board
of County Commissioners, for its respective interest, Party of the First
Part, and the CITY OF GREELEY, Party of the Second Part:
WITNESSETH:
WHEREAS, the Party of the First Part is the owner of voting machines
which presently are in the warehouse of the First Party, and in care and
custody of the First Party, and,
WHEREAS, the Party of the Second Part is desirous of using certain
machines in specified voting precincts located in various parts of the City of
Greeley for an election to be held on May 20, 1975.
NOW, THEREFORE, for and in consideration of the mutual promises,
agreements and covenants hereinafter contained, the parties hereto hereby
agree and contract as follows, to-wit:
1. Party of the First Part hereby agrees to deliver from its ware-
house a specified number of voting machines to the specified voting
precincts located in various parts of the City of Greeley , Weld
County, Colorado, as shall be directed by the Greeley City Clerk,
within five (5) days before said election day and First Party further
agrees to return same to storage within ten (10) days after such
election.
2. Party of the Second Part agrees to pay to Party of the First Part
as compensation for all haulage and transportation of said voting
machines at the rate of Eleven Dollars ($11 . 00) PER MOVE PER
MACHINE.
3. Second Party agrees to assume all liability in connection with the
use of the voting machines and shall carry adequate insurance on
said voting machines while under its control.
IN WITNESS WHEREOF, the parties hereto have set their hands and
seals this 16th day of April, A. D. , 1975.
