RE: ACCEPTANCE OF PUBLIC STREET SERVING LOTS 4, 5 AND 6 OF THE
FAGERBERG SUBDIVISION FOR FULL STREET MAINTENANCE.
WHEREAS, on September 17 , 1975, the public street serving
Lots 4, 5 and 6 of the Fagerberg Subdivision was accepted for
partial maintenance by the Board of County Commissioners, Weld
County, Colorado, and
WHEREAS, an on site inspection conducted by the Department
of Engineering Services on September 13, 1976 , revealed no
deficiency in maintenance on the part of the developer, and
WHEREAS , the Department of Engineering Services recommends
the acceptance of the above described street twenty feet wide
and . 026 miles more or less in length, and
WHEREAS, the Department of Engineering Services further
recommends a release of the Subdivider ' s Note in the amount of
Eight Hundred Dollars ($800 . 00) ;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the public street
serving Lots 4, 5 and 6 of the Fagerberg Subdivision being twenty
feet in width and . 026 miles more or less in length, be, and
hereby is, accepted for full street maintenance by the County
of Weld, and be it further resolved that the Board of County
Commissioners, Weld County, Colorado, does hereby direct the
County Clerk to release the Subdivider ' s Note in the amount of
Eight Hundred Dollars ($800. 00) securing performance by the
developer of required street maintenance.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on this 27th day of
September , A. D. , 1976 .

On demand after date for value received, the undersigned promises to pay to the
order of the Board of County Commissioners, Weld County, Colorado, the sum of
Eight hundred Dollars
( $800 . 00 ) with interest at ten percent (10%) per year from date of
demand until paid.
This note is given for the purpose of securing the Board of County Commissioners,
Weld County, Colorado, against a contingent liability by reason of said Board of
Commissioners, Weld County, Colorado, granting subdivision rights to one or
more of the undersigned within the County of Weld, Colorado, as outlined in Sub-
division Agreement dated March 31 , 1975 , and guaranteeing installation
of certain improvements in said subdivision by March 31 1977 .
Amount of note shall be conditioned by damages which the Board of County
Commissioners shall suffer by failure of undersigned/perform perform under said agree-
ment. Upon final acceptance of said improvements b 'P y thci`Board of County

to remain in full force and effect.

waive demand, pre entment for pay robest and notice of protest and of non-

It is also stipulated that shoul his note be collected by an attorney after maturity
or in case of defaul ' ( het r y,suit or otherwise) ten percent (10%), additional
on amount due sh a ed the holder as attorney fees.
If the,irhprovement shown have not been constructed by the stated completion
timejOhe Board of unty,Commissioners, at its option, may re-negotiate the
note amount to re ect change in construction cost and the amount of improvement
construction co pleted.

Subject:
At the request of the developer, Mr. Fagerberg , an inspection
was made on September 10, 1975 of the public street serving
Lots 4 , 5, and 6 of the Fagerberg Subdivision .
The construction complies with Weld County' s specifications
and it is our recommendation that this small public road
(138. 15 ' ) be accepted for partial maintenance .
In approximately nine months we will again inspect this
public street and will make recommendations at that time
for final acceptance.
