HomeMy WebLinkAbout20112382.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO SEPTEMBER 7, 2011 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 7, 2011, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Finance and Administration, Monica Mika MINUTES: Commissioner Rademacher moved to approve the minutes of the Board of County Commissioners meeting of August 31, 2011, as printed. Commissioner Long seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. PROCLAMATIONS: NATIONAL SUICIDE PREVENTION WEEK - SEPTEMBER 4-10, 2011, AND WORLD SUICIDE PREVENTION DAY - SEPTEMBER 10, 2011: Chair Kirkmeyer read the certificate into the record, proclaiming September 4-10, 2011, as National Suicide Prevention Week, and September 10, 2011, as World Suicide Prevention Day. Larry Pottorff, Executive Director, North Range Behavioral Health, thanked the Board for recognizing this crucial issue. He stated it is the goal of North Range Behavioral Health to reduce suicide in Weld County, and the tragedy of suicide impacts many people. Krismichelle Nohavec, Suicide Education and Support Services (SESS), thanked the Board for acknowledging this serious health concern for the people of Weld County. She stated she spoke to the Board last year, when the suicide rate in Weld County had increased 39 percent from the year 2009 to the year 2010, and the numbers have similarly increased again this year. She stated SESS facilitates i I Minutes, September 7, 2011 2011-2382 Page 1 BC0016 suicide prevention efforts through the high schools and colleges, and it provides public health training, for example, Question Persuade Refer (QPR) training, which trains people to deal with others in a suicidal crisis. Ms. Nohavec stated SESS also offers Mental First Aid training for the community at North Range Behavioral Health. She stated suicide is the most preventable cause of death and knowing the warning signs and what to do when someone is in crisis can help prevent it. She stated SESS provides post-vention services, in addition to prevention services, where staff works with those who are bereaved by suicide, and it is free of charge to residents of Weld County. Commissioner Long expressed his appreciation for the work North Range Behavioral Health does. He stated he is involved with violence prevention, including homicide and suicide, and often when analyzing suicide, it is observed there was denial of apparent warning signs, particularly within the family circle. Commissioner Conway thanked North Range Behavioral Health for bringing this difficult topic out of the shadows and initiating dialogue and awareness. Commissioner Rademacher thanked Ms. Nohavec for her work. Commissioner Garcia stated suicide prevention is an important part of health and wellness, and people often do not think about mental wellness. Chair Kirkmeyer concurred with the other Commissioners' comments, and she stated she has been touched by suicide in her family. She stated this is important work and she appreciates it. Ms. Novahec submitted a resource card into the record with information about what to say and do, who to call, and what to look for when someone may be dealing with an individual who is in a suicidal crisis, along with a her business card, marked Exhibit A. ORIGINAL FORT LUPTON AS HONORARY COUNTY SEAT - SEPTEMBER 9-11, 2011: Chair Kirkmeyer read the certificate into the record, proclaiming Fort Lupton as the Honorary County Seat. Commissioner Conway commended Chair Kirkmeyer for her efforts towards the restoration of the fort, along with the Historical Society. He stated Channel 4 aired a Colorado Getaway episode featuring Fort Lupton as a destination. COMMISSIONER COORDINATOR REPORTS: Chair Kirkmeyer stated the grand opening of the newly restored fort in Fort Lupton will occur on September 9, 2011, and she invited everyone to attend. She stated there will be cake and there will be fireworks at the end of the evening. She stated the fort restoration has resulted in a lot of good press coverage for Weld County, and after the Colorado Getaway episode aired on Saturday, there were about 500 visitors to the fort on Sunday and another 300 on Monday. BIDS: PRESENT BID #81100117, CONCRETE CURB AND GUTTER PROJECT - DEPARTMENT OF PUBLIC WORKS: Monica Mika, Director of Finance and Administration, stated said bid will be presented for approval on September 21, 2011. PRESENT BID #B1100127, DRY CLEANING SERVICES - SHERIFF'S OFFICE: Ms. Mika stated said bid will be presented for approval on September 21, 2011. She stated originally this bid was going to include all the departments; however, the Paramedic Service does not use this service. She stated there are two (2) potential vendors, and she recommended a work session be scheduled to discuss this bid. APPROVE BID #61100118, CUSTODIAL SERVICES FOR SOUTHWEST WELD COUNTY, SOUTHEAST WELD COUNTY, AND CARBON VALLEY BUILDINGS - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Mika stated this bid was presented on August 22, 2011, and she recommended approval of the low bid. Commissioner Rademacher moved to approve the low bid from Porter Industries, Inc., based on staff's recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. Minutes, September 7, 2011 2011-2382 Page 2 BC0016 NEW BUSINESS: CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - DR. STEPHEN CASTLE, D.O./CASTLE MEDICAL BUILDING, LLC: Christopher Woodruff, Assessor, stated this property is a medical office building located within the City of Greeley, and the request is for Tax Year 2009, which considers data from the year 2007 and the first half of the year 2008, to establish the value. He stated the building was constructed in the year 2002. He stated since this is commercial property, the Assessor's Office is required to evaluate three (3) approaches to determining the value for the property. Mr. Woodruff stated the cost approach yielded a value of $805,778.00, and it took into account the building's age and the unfinished basement. He stated the market comparison approach considered comparable sales from the year 2007 and the first half of the year 2008. He stated several similar office buildings were sold without interior finishes; therefore, those sales figures were adjusted to make the sales figures comparable to a finished building. Mr. Woodruff stated the adjusted sales for the period ranged from $164.00 to $254.00 per square foot, with an average of $187.00 per square foot and a median of $182.00 per square foot. He stated the highest range was in the Town of Windsor, which was not correlated to, and the value which was correlated to is $165.00 per square foot, resulting in a market value of$698,610.00. He stated the income approach was also evaluated for this building, and the typical lease rates for medical offices ranged from $14.75 per square foot to $22.96 per square foot, with an average of$17.68 per square foot and a median of $17.39 per square foot. Mr. Woodruff stated the value was correlated to $16.00 per square foot, using a typical vacancy rate of 16 percent, expenses of five (5) percent, and a cap rate of eight (8) percent. He stated the income approach yielded a value of $683,800.00, which is $161.40 per square foot. He stated the value the Assessor's Office determined for the property for Tax Year 2009 is $698,610.00, and the information submitted by the petitioner's representative was not persuasive, since three (3) of the six (6) property leases for which income data was provided were leases executed after June 30, 2008, and are unable to be considered by staff, and one (1) of the leases was for a non-medical property. He stated the two (2) leases staff could consider averaged between $17.62 and $18.80 per square foot; therefore, he feels the value of $16.00 per square foot, for a total value of $698,610.00, is appropriate for the property for Tax Year 2009, and he recommends denial of the petition. No representatives of Dr. Stephen Castle, D.O., or Castle Medical Building, LLC, were present. Commissioner Garcia stated the Assessor's Office did a fine job and made decisions which benefit the taxpayer in this case, and he moved to deny said petition, based on staff's recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR THE UPGRADE AND MAINTENANCE OF CRS 85, 86, AND 88, AND AUTHORIZE CHAIR TO SIGN - CONTINENTAL RESOURCES, INC.: Donald Carroll, Department of Public Works, stated this agreement is for a location four (4) miles east of, and one (1) south of, State Highway 14. He stated the agreement will provide Continental Resources, Inc., access to the rights-of-way for County Roads 85, 86, and 88, and the County has 60 feet of right-of-way on each of the Section Lines; however, just 30 feet of right-of-way will be utilized. Commissioner Long moved to approve said agreement and authorize Chair to sign. Seconded by Commissioner Rademacher, the motion carried unanimously. CONSIDER TEMPORARY CLOSURE OF CR 70 BETWEEN CRS 41 AND 43: Janet Carter, Department of Public Works, stated this closure commenced September 1, 2011, in order to remove irrigation water from the roadway and complete road repairs, and it is anticipated to end September 9, 2011. She stated the average daily traffic count for County Road 70 is 67 vehicles, according to a traffic count taken in the year 2006, and staff intends to use water for dust abatement on the gravel portions of the detour route. She stated road signs and barricades will be utilized throughout the closure. Commissioner Conway moved to approve said temporary closure. Seconded by Commissioner Garcia, the motion carried unanimously. Minutes, September 7, 2011 2011-2382 Page 3 BC0016 CONSIDER APPOINTMENTS TO AREA AGENCY ON AGING ADVISORY BOARD: Commissioner Garcia moved to appoint Sandy Magnuson and Ken Norem to the Area Agency on Aging Advisory Board, with terms to expire January 31, 2013, and January 31, 2014, respectively. Seconded by Commissioner Conway, the motion carried unanimously. CONSIDER RECOMMENDATION OF APPOINTMENTS TO JUVENILE SERVICES PLANNING COMMITTEE: Commissioner Garcia moved to approve the recommendation of the appointments to the Juvenile Services Planning Committee, as specified in the Resolution. Seconded by Commissioner Conway, the motion carried unanimously. CONSIDER APPLICATION FOR A TEMPORARY ASSEMBLY OF MORE THAN 350 PERSONS ON SEPTEMBER 24, 2011 — MEAD ROTARY CLUB FOUNDATION: Brad Yatabe, Assistant County Attorney, stated this application is for the Sugarbeet Festival, and it indicates the event is expected to have 250 people in attendance, and the following application indicates 300 people are expected to attend the event, and both numbers are below the threshold for requiring a temporary assembly permit. He stated the event has taken place in previous years, and perhaps it is a good faith effort, or perhaps more people were expected to attend in previous years. He stated the County Attorney's Office has no objections to the event. Deputy Lisa Carpenter, Sheriff's Office, stated that Roy Rudisill, Director, Office of Emergency Management indicated in an email that he has some concerns about an ambulance being on-site, Mountain View Fire being available, and that an Incident Response Plan be submitted. Commissioner Rademacher stated Mountain View Fire District covers this event each year and it sets up a booth on-site; therefore, he is confident it will be providing coverage this year as well. He stated at least 350 people are expected for the event, and perhaps the incorrect number indicated on the application was a typographical error. Mr. Yatabe clarified neither application has 350 people listed. Chair Kirkmeyer stated perhaps the applicant is just covering all their bases, in case more than 350 people attend the event. Commissioner Conway stated he has attended this event, and more than 350 people were in attendance. He stated in the interest of protecting the applicant, the Board should approve the application, in case there are more than 350 people in attendance. He stated this is a wonderful event and he hopes there are a lot of participants. Terry Enright, applicant, stated he completed the applications, and he apologized for the errors. He clarified there will be more than 350 people, and the application is consistent with what has been submitted in previous years. Commissioner Conway thanked the Mead Rotary Club Foundation for conducting this great event. Mr. Enright stated the event allows the Mead Rotary Club Foundation to support some wonderful water projects in Nicaragua. Commissioner Rademacher moved to approve said application. Seconded by Commissioner Conway, the motion carried unanimously. CONSIDER APPLICATION FOR A SPECIAL EVENTS PERMIT FOR SEPTEMBER 24, 2011, AND AUTHORIZE CHAIR TO SIGN — MEAD ROTARY CLUB FOUNDATION: Based on the previous discussion, Commissioner Rademacher moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. PLANNING: CONSIDER IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT #1687 - JOURNEY VENTURES, LLC: Dave Bauer, Department of Planning Services, stated Use by Special Review Permit #1687 was approved on May 11, 2009, and after a slow construction season, a phased improvements agreement has finally been pulled together. He stated the improvements agreement is to widen the radii on County Roads 58 and 51, and as traffic Minutes, September 7, 2011 2011-2382 Page 4 BC0016 picks up, County Road 58 will be widened. He stated additional collateral will be collected as other projects are identified and designed. Commissioner Conway moved to approve said agreement, authorize the Chair to sign, and accept collateral for Use by Special Review Permit #1687. Seconded by Commissioner Rademacher, the motion carried unanimously. CONSIDER PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT#1670 - NORTHERN COLORADO DISPOSAL: Rich Hastings, Department of Public Works, requested the partial release of collateral for USR #1670, which is located on the southwest corner of O Street and 59th Avenue and the intersection of County Roads 64 and 31. He stated the roadway and detention pond work has been completed; however, the initial seeding was not successful; therefore, additional seeding will occur this spring, and warranty collateral, in amount of $7,500, will be accepted, with the remaining $187,100.00 being released. Commissioner Garcia moved to approve said partial cancellation and release of collateral for Use by Special Review Permit #1670. Seconded by Commissioner Long, the motion carried unanimously. SECOND READING OF CODE ORDINANCE #2011-6, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS, OF THE WELD COUNTY CODE: Commissioner Rademacher moved to read Ordinance #2011-6 by title only. Seconded by Commissioner Conway, the motion carried unanimously. Mr. Barker read the Ordinance into the record by title. In response to Commissioner Rademacher, Tom Parko, Department of Planning Services, stated there are no changes being proposed for the second reading of the Ordinance. Chair Kirkmeyer provided the opportunity for public testimony; however, none was given. Commissioner Rademacher moved to approve Ordinance#2011-6. Seconded by Commissioner Garcia, the motion carried unanimously. SECOND READING OF CODE ORDINANCE #2011-9, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE: Commissioner Conway moved to read Ordinance #2011-9 by title only. Seconded by Commissioner Long, the motion carried unanimously. Mr. Barker read the Ordinance into the record by title. Chris Gathman, Department of Planning Services, stated there are no changes being proposed for the second reading of the Ordinance. He reviewed the changes proposed to the Ordinance on first reading regarding the number of animal units to be allowed per acre in the A-1 (Concentrated Animal) Zone District, as indicated in Table 23.1D. Chair Kirkmeyer provided the opportunity for public testimony; however, none was provided. Commissioner Conway moved to approve Ordinance #2011-9. Seconded by Commissioner Long, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Ordinances #2011-6 and #2011-9 were approved on second reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
