HomeMy WebLinkAbout20112684.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1100023 AGAINST WARREN AND NORMA EHRLICH FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Warren and Norma Ehrlich, ZCV #1100023, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of October, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Warren Ehrlich, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until November 11, 2011, to allow adequate time for the property owner to bring the property into compliance by closing the auto repair business. Michelle Martin & I met with them. We walked them through the Pre-Application and explained what would occur at the meeting. They indicated they would fill out the Pre-Application form and mail it into us. 03/17/2011 Office visit Pre-Application meeting. 05/24/2011 Office visit The Ehrlichs came into the Greeley Office. They met with Michelle Martin and I. Do to their farming operation, we agreed to push out the violation hearing to the October 11th Violation Hearing, but we strongly advised them that we would not extend the case again. They hoped for longer, but said they would make it work. 09/06/2011 Letter received Warren Ehrlich submitted a letter(see documents). 09/08/2011 Phone call I attempted to contact Warren (626-9580). I left a message with a female. I explained that as we had previously discussed, we would not be extending the case again. Instead, Mr. Ehrlich would need to attend the Violation Hearing to request additional time. Michelle and I were then able to get in touch with Rich (371-0636). We explained to him that we had just left a message for Warren and that we were not able to grant an extension. Someone would need to attend the hearing to request any extensions. 09/29/2011 Office visit Warren & Rick came to the Greeley Planning Office. Warren indicated that he checked with the Assessor's Office to find out if his taxes would increase. They said yes. Because we get asked all the time from other people, I asked how much they would increase He said they didn't tell him and it wouldn't matter. Even if it was$1 it wasn't worth it. He said he pays enough in taxes. He said he just wasn't doing it. He asked how much time I was going to give him to close shop. I asked how much they needed. Warren was saying like a week. Rick said closer to 3 weeks. I said here is what I am going to recommend: That they refer the case to the County Attorney's Office, but delay legal action for 30 days. They said that will give them more than enough time to finish and have the business removed. I told them that as soon as I validate the business has been removed, the Violation case will close. I know we have had pre application hearings and have met with planning department and or talked several times but timing the last 2 months for Alfalfa and Hay for us to actively investigate, interview and research all options proposed and recommended by the county have not been fully evaluated. We are now going into beans and then corn harvest. We have been active contributors for generations in the farming and agriculture arena for Weld County and would request you completely understand what everything entails on what all departments are requesting. (The legal description is Lot A of AmRE-637 also known as part of the SE4NE4 of Section 4, T6N, R67W of the 6t° P.M.; Situs Address is 35491 CR 19) Background Information: The applicants indicated that most of the work is done on family farming equipment, but he does conduct a small portion of business on customer diesel repair and other mechanical repairs. Dusty does not live on-site. Warren is currently not associated with the operation. Dusty indicated he can run anywhere from 1-3 vehicles a week other than family repairs. He also indicated that occasionally there is some associated storage (primarily waiting on parts, etc.) Health Department Warren indicated that there are 4 bedrooms in the house (2 upstairs and 2 basement), no restrooms in the shop. A Waste Handling Plan is required. Mary indicated they will require the system to be evaluated by an engineer both for the addition of the possible commercial traffic and the addition of 2 bedrooms. There was discussion about the system never being pumped before. Public Works There are 2 existing accesses on the property. The furthest Northern access is forAg access only. Traffic Study is not required. Drainage Report is not required; however the applicant shall provide a short description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1) where the water originates if it flows onto the property from an offsite source, 2)where it flows to as it leaves the property, 3)the direction of flow across the property, and 4) if there have been previous drainage problems with the property. The application shall also provide flow arrows on the map showing where the stormwater starts, how it goes across the property, and where it leaves the property. The applicant will still be responsible for providing a water quality feature that conforms to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria manual. Heidi gave them some questions to answer and submit with their application. She also provided her business card for questions. Building Department Ken explained that our records indicate that building permits were not obtained for the outbuilding. He explained if they proceeded with the commercial use of the building, they would need to hire a Design Professional (Architect or Engineer) to determine structure stability and design standards and type of occupancy. He also described the building permit fee and associated impact fees. Since there was also discussion of removal of the commercial operation, Ken explained if the business component is removed and if the building reverts back to "Ag" use, instead of a building permit a, Certificate of Compliance (COC) permit would be required for an Ag Exempt building. Planning Department Bethany indicated that a 60 day letter would be sent after completion of the current letter timeline, which will push this case out until June, but by June either a complete USR application shall be submitted or the business relocated. She also discussed the Investigation Fee. If requesting a waiver of the Investigation Fee a letter shall be drafted and submitted to Trevor Jiricek (Director of Planning Services) for consideration. Michelle discussed the application fees and differences between Home Business and full blown commercial USR. Michelle explained the USR application. She encouraged them in order to avoid having to go through this process again to think out maybe 5 years. She explained that the Certificate of Conveyances (done through a title company) should be the very last item completed prior to submittal. She offered to print out the surrounding property owner lists since access to the web is not available. She discussed the mapping requirements. Staff urged the applicant to contact staff for any questions: Planner On Call available Monday through Friday 7:30 a.m. to 4:30 p.m. or call ahead for an appointment. Staff explained the USR process. The applicant shall submit 4 packets for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as many of the referrals as possible. At that meeting the Planning Commission hearing will be scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks after the Planning Commission hearing. The above notes are provided as a courtesy to the applicant. Pre-application reviews are required prior to beginning the application process; however, this review is not an application. ' • Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in the Greeley office.
