RE: STATEMENT OF COUNTY COMMISSIONERS REGARDING THE FLOW OF WATER
IN THE COUNTY BORROW PIT ALONG COUNTY ROAD 13 , COMMENCING AT
THE NE4 OF SECTION 25 IN TOWNSHIP 4 NORTH OF RANGE 68 WEST OF
THE 6TH P.M. , AND ENDING AT THE EAST QUARTER CORNER OF SECTION
24 IN TOWNSHIP 4 NORTH OF RANGE 68 WEST OF THE 6TH P.M. ALL IN
WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, have been requested to give permission to allow water to
flow in a northerly direction for one-half mile along the west side
of County Road 13, commencing at the Northeast corner of Section
25 in Township 4 North of Range 68 West of the 6th P.M. , and end-
ing at the East quarter corner of Section 24 in Township 4 North of
Range 68 West of the 6th P.M. , all in Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , after having con-
sidered said matter have determined that the natural flow of the
tail waters which collect at the Northeast corner of Section 25 in
Township 4 North of Range 68 West of the 6th P.M. , do flow in a
natural course in a northerly direction along the West side of
County Road 13 for a distance of one-half mile as hereinabove set
forth in this Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado do hereby declare that they have no objection to the con-
tinued use of the borrow pit for the continuing flow of tail waters
which gather at the Northeast corner of Section 25 in Township 4
North of Range 68 West of the 6th P.M. , so long as said one-half
mile segment of borrow pit along the west side of County Road 13 is
not used for the transportation of waters other than the tail waters
which collect at the Northeast corner of the aforesaid Section 25
in Township 4 North of Range 68 West of the 6th P.M. .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that said Board of County Com-
missioners does declare that they have no objection to the continued

use of the borrow pit running along the west side of County Road
13 for a one-half mile distance commencing at the Northeast corner
of Section 25 in Township 4 North of Range 68 West of the 6th P.M.
and ending at the East quarter corner of Section 24 in Township 4
North of Range 68 West of the 6th P.M. , all in Weld County, Colo-
rado, for the purpose of transporting tail water which gathers at
the Northeast corner of Section 25 in Township 4 North of Range 68
West of the 6th P.M.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 19th day of
April, A.D. , 1978 .
