Dear Mr. Waddell:
Pursuant to the authority vested in the Weld County Department of Public Health and Environment
(WCDPHE), by Article III, Section 14-3-10 of the Weld County Code, which authority is
implemented through the Environmental Health Division(the"Division"). The Division hereby makes
the following findings and issues the following Corrective Action Plan:
General Findings
1. Stanley Waddell has leased a poultry processing plant to Doug Rice dba: Rocky Mountain
Poultry utilizing a six thousand gallon(6,000 g)cistern as its primary drinking water source,
located at 18920 CR 100,Nunn, Colorado, in Weld County, Colorado (the "System").
2. Stanley Waddell is the owner as defined by Weld County Code Article III, Section 14-3-50
3. In accordance with Weld County land use permit USR 1242 and the above listed Weld County
Cistern Usage Permit(CUP), an inspection and water sample collection is required to be
completed each quarter.
4. The System shall fill the cistern with water from a safe supply and be able to supply records of
purchases made for potable water.
5. The System must be equipped with an automatic chlorination device with an alarm that will
sound in the event of a malfunction.
6. During plant processing, chlorine residual must be taken BEFORE operation to ensure
sufficient chlorine is present in the cistern drinking water and the results documented for each
day of operation. The System must maintain free chlorine residual records to be available at all
times on site for examination by an agent of the Division upon inspection.

7. On January 11, 2011 a WCDPHE Division Representative Denise Carter conducted an
inspection of the System and to collect a water sample for bacteriological testing. A
bacteriological sample was not collected as the free chlorine residual concentration results
were>8.8 (greater than 8.8). The presence of excessive chlorine invalidates the analysis for
Total Coliform and Ecoli. Operator Doug Rice and the Division Representative agreed that
Mr. Rice would contact the Division when he thought the free chlorine concentration in the
cistern was equilibrated within the acceptable range. This appointment needed to be made
within the first quarter to remain in compliance with cistern regulations and USR 1242.
8. On March 15, 2011 a Division Representative, Denise Carter returned to the processing plant
to collect a water sample and perform a free chlorine residual. Again the free chlorine residual
concentration results were>8.8 (greater than 8.8) in the field. A sample of the water was taken
in a clean container back to the laboratory to determine the actual free chlorine in the water.
As a consequence of the high free chlorine result-for a second time, a bacteriological sample
was not taken as the presence of excessive chlorine invalidates the analysis for Total
Coliform/Ecoli.
Corrective Action Plan
1. Immediately comply with the Colorado Primary Drinking Water Regulations, 5 CCR 1003-
1, Articles)-13.
2. Within the thirty(30)days of receipt of this Corrective Action Plan, Rocky Mountain
Poultry shall submit a free chlorine residual within the Colorado Primary Drinking Water
Regulation standards range of 0.2 -1.2ppm and a bacteriological sample with analysis
results of absent for Total Coliform and Ecoli.
3. Within sixty(60) days of receipt of this Corrective Action Plan, Stanley Waddell shall
choose one of the following options and create and submit the plan for approval by the
Division(WCDPHE):
1. Replace the pellet chlorinator with a Liquid Chemical Feed Chlorination Injection
Pump. A Malfunctioning Alarm must be attached to the system.
2. Move the current chlorination system out of the processing area to ensure chlorine
pellets do not clump and plug the injector, install a Malfunctioning Alarm AND, ensure
current system is operating correctly by setting up a reoccurring maintenance plan with
a licensed drinking water operator of the State of Colorado.
3. Install a universal controller capable of continually analyzing free chlorine in real-time while
automatically injecting the required chlorine dose to control the concentration level of
disinfectant within the adequate range of 0.2-1.2ppm.
The approved plan shall specifically outline specific events and timelines including how Stanley
Waddell will ensure proper installation, maintenance and operation and provide plan
specifications and diagrams to the Division.
4. Within ninety(90) days of receipt of this plan, Stanley Waddell will oversee Rocky Mountain
Poultry apply the chosen option from above and submit to an inspection of the plant during
processing operation.
5. Upon completion of the inspection, a representative of the Division will perform a free chlorine
residual test using a Hach Pocket Colorimeter and a representative of Rocky Mountain Poultry will
perform a similar test on the Hach Color Comparator at the same time to validate the facilities free
chlorine procedure and results. The results of the color comparator test should be within 10%of
the Division Representative's results from the Hach Pocket Colorimeter.
a. If compared results of the free chlorine residuals are out of the 10%range, corrective
actions shall ensue; which could consist of either correcting your procedural errors or
purchasing new instrumentation.
b. The System will be given an additional thirty(30) days to correct its procedural errors and
contact the Division for revalidation of the chlorine procedures and results.

Dear Mr. Waddell:
On May 11, 2011, the Environmental Health Services Division of the Weld County Department of
Public Health and Environment (WCDPHE) completed a quarterly inspection of the cistern permitted
for the Poultry Processing Plant located at 18920 CR 100, Nunn, Colorado and verifies the completion
of phase 1 of the Corrective Action Plan (CAP) dated March 25, 2011. Phase I of the CAP was to
provide a free chlorine residual within the Colorado Primary Drinking Water Regulations of 0.20 ppm to
1.2 ppm and a bacteriological sample with analysis results of ABSENT for both Total Coliform and E-
Coli within thirty (30) days from the received date (Certified letter received by Lori Waddell on March
29, 2011). Results for these tests are enclosed.
During the May 11, 2011 inspection, additional options were discussed for Phase II compliance.
Therefore, one the following options may be employed as a temporary measure until a final CAP
design from the three choices given in the letter dated March 25,2011 is approved, installed and
operational:
1. Remove all items from the room where the chlorinator is housed aside from the water heater
and furnace.
1.1 Replace weather stripping on the door of the room to ensure a relatively air tight seal,
1.2 Lock the room during processing hours,
1.3 Create signage that indicates no entrance allowed at anytime during processing.
2. Remove daily work items from the room where the chlorinator is housed BEFORE processing
begins
2.1 Lock the door and do not open until processing is complete.

processing.
As a reminder, total chlorine pillows are not to be used when operator is testing the free chlorine levels
at the beginning or before plant operation. Additionally, operator MUST do supplementary free
chlorine tests if the chlorine is too low or too high (acceptable free range is 0.20-1.20 ppm). All
chlorine testing and water purchases must be documented on the approved form.
Furthermore, the design plans must be submitted to this Division no later than May 29, 2011. The
design must be installed, operational and, inspected no later than June 29, 2011
Finally, the six thousand (6,000) gallon tank must be completely filled with potable water before
processing commences.
