Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Health Department representative, Mary Evett Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 14, 2011, and duly published October 19, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Jeffrey Reck, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0010, for an Oil and Gas Support Facility (roust-a-bout, excavating and port-a-let service) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and explained the site is currently in violation for operating without the appropriate zoning permit. Mr. Ogle gave a brief description of the location and size of the parcel, reviewed the surrounding land uses, and stated staff received no correspondence from surrounding property owners. He stated 14 referral agencies reviewed the proposal, six responded with comments which have been addressed in the Conditions of Approval and Development Standards, and he displayed an aerial vicinity map and photographs of the site and surrounding area. In response to Commissioner Conway, Mr. Ogle confirmed the site is currently occupied. Don Carroll, Department of Public Works, stated the site is accessed from County Road 48, which has an average daily traffic count of approximately 100 vehicles, and the nearest paved road is County Road 35, which has an average daily traffic count of 400 vehicles. He reviewed the standard requirements for the plat and the designated haul route, and stated a traffic study is not required, as the facility will only generate ten round trips per day. Responding to Commissioner Rademacher, Mr. Carroll stated the Sheriff's Office and Colorado Department of yu ()lA) 4L, cA 2011-3108 `71 - 1 PL2141 HEARING CERTIFICATION -JEFFREY RECK (USR11-0010) PAGE 2 Transportation (CDOT) each expressed concern with the limited sight distance at the intersection of County Road 48 and U.S. Highway 85. Mary Evett, Department of Public Health and Environment, stated the site is served by a septic system, which was reviewed and found to be inadequate, which is addressed in Condition of Approval #1.F.3. She stated the water well will also need to be re-permitted for commercial use for sanitary or drinking purposes only, the applicant is proposing to use Colorado Big Thompson (CBT) water to supplement the well water, and Condition #1.F.8 requires the applicant to address the concerns of the Colorado Division of Water Resources. Ms. Evett reviewed the washout and disposal process and noted all routine maintenance and washing of trucks will be conducted off-site. She stated the applicant plans to withdraw the request for a Solid Waste Transfer Station and the existing aboveground storage tank will be removed; however, Conditions #1.F.5 and #1.F.6, and Development Standards #14 and #15 should remain until the tank is removed. Responding to Commissioner Rademacher, Ms. Evett reiterated the applicant still needs to apply for a new septic permit. Jeff Reck, applicant, reviewed his business operations plan. In response to Commissioner Rademacher, Mr. Reck requested an increase to 20 employees. Mr. Carroll expressed no concern with the additional employee traffic. In response to Commissioner Conway, Mr. Reck confirmed the on-site resident is an employee. Responding further to Commissioner Rademacher, Mr. Reck confirmed the designated hours of operation are appropriate and the trucks will travel west and will not impact the neighbor to the east. No public testimony was offered concerning this matter. Chair Kirkmeyer proposed extending the hours from 6:00 a.m., to 9:00 p.m., to account for longer summer days. Following discussion, the Board indicated agreement with deleting Development Standard #24 and the hours of operation. Responding to Commissioner Rademacher, Mr. Ogle stated the entire property is currently screened. Responding to Chair Kirkmeyer, Mr. Reck stated sixty (60) days is adequate time to record the plat, and he indicated agreement with the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Rademacher moved to approve the request of Jeffrey Reck for a Site Specific Development Plan and Use by Special Review Permit, USR11-0010, for an Oil and Gas Support Facility (Roust-a-bout, Excavating and Port-a-let Service) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Development Standard #24, amending Development Standard #25 to increase up to twenty (20) employees, and renumbering as appropriate. The motion was seconded by Commissioner Conway, and it carried unanimously.
