RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR A HOG OPERATION FOR
DON ANDERSON, INC. , ROUTE 2, BOX 36, EATON, COLORADO 80615.
WHEREAS , the Board of County Commissionersof Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 30th day of November,
1977 , at the hour of 2 : 00 o' clock p.m. , in the Chambers of the
Board of County Commissioners, for the purpose of hearing the
application of Don Anderson, Inc. , Route 2, Box 36, Eaton,
Colorado 80615, for the granting of a Special Use Prmit for a
hog operation on the following described real estate, to-wit:
Part of the West Half (W1/2) of the Northwest Quarter (NWa) of
Section 2, Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described
as follows:
Beginning at the Northwest Corner (NW Cor) of said Section 2,
and considering the West line of said Section 2 as bearing
South 00°00'00" West, with all other bearings contained herein
being realtive thereto;
Thence South 00°00'00" West, along said West line, 641.13 feet
to the True Point of Beginning;
Thence South 85°54'30" East, 540.00 feet;
Thence South 00°00'00" West, 242.00 feet;
Thence North 85°54'30" West, 540.00 feet;
Thence North 00°00'00" East, 242.00 feet to the True Point of
Beginning
Said described parcel of land contains 2.992 acres, more or less,
including a strip of ground 30 fcct in width along the West line
of said described parcel of land, reserved for County Road ROW
purposes and is subject to any rights-of-way or other easements
as recorded by instruments of record or as now existing on said
described parcel of land.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of
the Special Use Permit for a hog operation on the above-described
real estate, and
WHEREAS, Section 3. 3.E. 4.d. of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District
on the grant of a Special Use Permit by the Board of County Com-
missioners , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations

of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully
informed and satisfied that the request for a Special Use Permit
for a hog operation on the hereinabove described real estate,
complies with all of the conditions as set out in Section 3. 3.E. 4.d.
of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
the petitioner for a Special Use Permit for a hog operation on the
hereinabove described tract of land, be, and hereby is, granted
subject to the Development Standards contained in the Special
Use Permit.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated October 18, 1977, be, and hereby are, incorporated as the
findings of fact of the Board of County Commissioners in this
matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 30th day of

2. It is the opinion of the Planning Commission that this
proposed operation is in compliance with the provisions of
Section 3. 3(E) (2) of the Weld County Zoning Resolution.
The proposed use will be compatible with the surrounding
area, in harmony with the character of the neighborhood and
existing agricultural uses, compatible with the future
development in the area and will not adversely affect the
health, safety, and welfare of the inhabitants of the area
and the county.
This determination is based upon the following:
A. The hog operation and management practices as outlined and
controlled in the development standards will make this
operation compatible with the surrounding area by
minimizing the potential adverse impacts.
B. The proposal is for an agri-business in an agriculturally
zoned area, with existing land uses being predominantly
agricultural.
C. The Weld County Extension Agent has indicated the
facilities will provided adequate space for proposed
number of animals. He did not observe any problems with
the proposed operation.
D. The Weld County Health Department has indicated the
proposed operation is in compliance with all applicable
Weld County and State Health Standards and Regulations.
E. The Eaton Planning Commission has indicated they have no
objections to the proposed hog operation.
F. The Weld County Engineering Department indicated no
engineering problems could be identified with the proposed
expansion.
G. The State Engineer, Division of Water Resources, indicated
the existing unregistered livestock well is adequate for
the proposed hog operation and they have no objections to
the approval of this application. However, they suggest
the owners contact their office concerning late registration
of the existing well.
Comment :
1. A letter of opposition was submitted from Alda Collins,
an adjoining landowner to the north (see copy of letter
in attached packets) .

DEVELOPMENT STANDARDS
1 . The open hog farrowing and finishing operation on the hereon
described parcel located in Part of the Wz of the NW* of
Section 2, T6N, R66W of the 6th P.M. , Weld County, Colorado ,
shall be limited to the facilities shown which are designed
to handle approximately 240 sows and gilts, 15 boars, 350-
700 baby pigs, and 480-1 , 000 feeders.
2. The Special Use Permit area shall be maintained in such a
manner as to prevent fugitive dust, soil erosion, and the
growth of noxious weeds.
3. All buildings shall be set back a minimum of 20 feet from
the Special Use Permit area boundary and a minimum of 50
feet from County Road ROW line.
4. Access shall be limited to the one existing access from
County Road 74.
5. All sewage disposal facilities installed on the site and
management practices for the hog operation shall conform
with all applicable Weld County and State Health Standards
and Regulations.
6. The Special Use Permit shall be limited to the plans sub-
mitted and governed by the Development Standards stated
above and all other applicable Weld County regulations.
Any changes to the plans and/or the Development Standards
shall require approval of another Special Use Permit before
such changes shall be allowed.
The Weld County Planning Commission held a scheduled meeting on
October 18, 1977 , at 1 : 30 p.m. in the Weld County Centennial
Center County Commissioners Hearing Room, 915 10th Street , Greeley,
Colorado .

DISCUSSION: Mr. Wood explained his request in that the borrow pit
would be used for enbankment construction for the proposed highway
project . There is an existing cut there at present . The cut will
be dropped on the north side. The land is dryland pasture and
approximately 42, 000 yards will be used. The area will be fenced
off for reclamation purposes. Representatives from the Division
of Wildlife and the Soil Conservation Service have recommended
approval . Ken McWilliams then read the staff recommendation. Some
discussion then followed regarding reclamation procedure. Mr.
Carlson asked if the site was above the ditch. Mr . Wood responded
by saying that it was and none of the water will be used during
the excavation.
MOTION: Be it therefore resolved to recommend approval to the Board
of County Commissioners . Motion by Frank Suckla, seconded by
Percy Hiatt . A vote of "aye" by Marge Yost , Percy Hiatt , Chuck
Carlson, Frank Suckla, Jerry Kiefer. A vote of "abstention" by Ben
Nix. Motion carried 5 to 1 .

Cowan desires to create nine lots on a 14 . 28 tract of land with
seven of the lots approximately one acre in size and two
approximately 2 acres in size with the rest of the land to be
dedicated roadways and one cul-de-sac road to serve the nine lots.
Ken McWilliams then read the staff recommendation . Some discussion
followed regarding the area to the west of the proposed site. Herman
Feit , surrounding property owner, stated that he was in favor of

operation and he did not want any negative feedback on his

APPEARANCE: Barry Anderson
DISCUSSION: Mr. Anderson explained his request stating that he and
Glenn Babock would like to start a hog operation . They are leasing
three acres of land from Don Anderson, Inc. south of an existing
feedlot . They anticipate 240 sows and 1 , 000 feeder pigs and fat
hogs. This will not be a farrowing operation at the present time.
Manure will be used on the adjacent farmland. Mr. Suckla asked
what he proposed to do about the fly and odor problem. Mr.
Anderson responded by saying that they will practice a fly control
program and the pens will be cleaned regularly. Mr. Nix asked if
he anticipates any more of a fly problem because of the hog
operation. Mr. Anderson said he feels there would be no more of
a problem. Ken McWilliams then read the staff recommendation and
stated that a subdivision procedure will need to be discussed with
the applicant since he is leasing from Don Anderson , Inc. He also
stated that he needs to clarify with the applicant the setback from
County Road 33 . Ken then read the Development Standards which Mr.
Anderson stated he understood. Alda Collins , surrounding property
V owner, spoke in opposition of the hog operation because of the dust
and fly problem. Some discussion followed .

LAFAYETTE WASTEWATER FACILITIES PLAN
DISCUSSION: Tom Honn then presented the referral from Boulder
County to the Planning Commission regarding the wastewater
facilities plan . He discussed with them two items which he
felt needed to be presented and discussed, these being : 1 ) Prior
to final plant design, Lafayette should coordinate with the Erie
Waste and Sanitation District regarding design standards of Erie ' s
facilities. This coordination is important because both facilities
as proposed will discharge into Coal Creek; 2) Prior to any
sludge or residual waste disposal in Weld County , Lafayette should
consult the developing Larimer-Meld Regional 208 Plan regarding
such activity. Some discussion followed.
MOTION: Be it therefore resolved to recommend approval to Boulder
County. Motion by Ben Nix, seconded by Jerry Kiefer. A vote of
"aye" by Ben Nix , Marge Yost , Percy Hiatt , Chuck Carlson, Frank
Suckla, and Jerry Kiefer. Motion carried.

1. The proposed hog operation agrees with the Weld County Compre-
hensive Plan. Said plan states : "Expansion and development of
agri-business and agriculturally oriented industry will be - --
encouraged, provided the enterprises do not adversely affect
the total economy or environment . "
It is the opinion of the Planning Department staff that the
installation of this hog operation adjacent to the existing_ cattle
feedlot will not adversely affect the surrounding environment .
2. It is the opinion of the Planning Department staff that this
proposed operation is in compliance with the provisions of
Section 3 . 3(E) (2) of the Weld County Zoning Resolution. The

proposed use will be compatible with the surroundtarea, in

harmony with the character of the neighborhood and existing
agricultural uses, compatible with the future development in the
area and will not adversely affect the health, safety, and welfare
of the inhabitants of the area and the county.

This determination is based upon the following:
A. The hog operation and management practices as outlined and
controlled in the development standards will make this
operation compatbile with the surrounding area -by -minimizing
the potential adverse impacts.
B. The proposal is for an agri-business in an agriculturally
zoned area, with existing land uses being predominantly
agricultural.
C. The Weld County Extension Agent has indicated the facilities
will provide adequate space for proposed number of animals.
He did not observe any problems with the proposed operation.

D. The Weld County Health Department has indicated the
proposed operation is in compliance with all applicable
Weld County and State Health Standards and Regulations.
E. The Eaton Planning Commission has indicated they have no
objections to the proposed hog operation.
F. The Weld County Engineering Department indicated no
engineering problems could be identified with the proposed
e-xs-i-ffPi.
G. The State Engineer, Division of Water Resources, indicated
the existing unregistered livestock well is adequate for
the proposed hog operation and they have no objections to
the approval of this application. However, they suggest
the owners contact their office concerning late registration
of the existing well .
Comment :
1. A letter of opposition was submitted from Alda Collins,
an adjoining landowner to the north (see copy of letter
in attached packets) .

A. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning immediately and lasting through September 30, 1979
the permittee is authorized to discharge as limited and specified below:
1 . Effluent Limitations
•
There shall be no discharge of process wastewater pollutants to the waters
• of the State, except that:
Process waste pollutants in the overflow may be discharged to the
waters of the State whenever rainfall events, either chronic or
catastrophic, cause an overflow of process wastewater from a
facility designed, constructed, and operated to contain all
process generated wastewaters plus the runoff from a 10-year,
24-hour rainfall event for the location of the point source,
specified as follows:
1) Whenever 2.6 inches of rainfall occurs during any 24-hour
period; or
2) Whenever 2.6 inches of rainfall occurs during any 15-day
period.
2. Monitoring Requirements
a. The permittee has the option of maintaining a rain gage at his facility.
If the permittee elects to exercise this option, he shall monitor and
record precipitation daily using a National Weather Service standard
rain gage or equivalent.
b. The official precipitation gage station identified with the animal
confinement facility shall be the Greeley Sugar Factory, Greeley, Colorado.
c. The permittee shall monitor and report any discharge resulting from a
precipitation event to the permit issuing authority within 24-hours or
during the first business day following a discharge that occurs on a
, weekend or holiday. Any discharge resulting from a non-precipitation
event (e.g. , dike or structural failure, equipment breakdown, human
error) shall be monitored and reported immediately by calling (303)
388-6111 Ext. 231 or (303) 366-5363 (non-duty hours) any time day or
night. The permittee shall provide the permit issuing authority with the
following information within five (5) days of either such notification:

1) A description of the discharge and cause, whether excess
precipitation, snow melt, or other specified causes (e.g.,

4) Name of receiving stream;
5) Name of person recording discharge;
6) Corrective steps taken, if appropriate; and
7) A record of the precipitation at the official gage station
identified with the facility or at a facility rain gage for
the period of inclement weather that resulted in the discharge.

B. MONITORING AND REPORTING
1 . Reporting
Discharge occurrences during the previous 12months shall be reported post-
marked no later than the 28th day of the month following the completed
reporting period. The first report is due on January 28, 1978.Duplicate signed

A. MANAGEMENT REQUIREMENTS
1 . Change in Discharge •
All discharges authorized herein shall be consistent with the terms and
conditions of this permit. The discharge of any pollutant identified in
this permit more frequently than or at a level in excess of that author-
ized shall constitute a violation of the permit. Any anticipated facility
expansion, production increases, or process modifications which will
result in new, different, or increased discharges of pollutants must be
reported by submission of a new NPDES application or, if such changes will
not violate the effluent limitations specified in this permit, by notice
to the permit issuing authority of such changes. Following such notice,
• the permit may be modified to specify and limit any pollutants not pre-
viously limited.
2. Facilities Operation
The permittee shall at all times maintain in good working order and operate
as efficiently as possible all control facilities or systems installed or
used by the permittee to achieve compliance with the terms and conditions
of this permit.
3. Adverse Impact
The permittee shall take all reasonable steps to minimize any adverse im-
pact to navigable waters resulting from noncompliance with any effluent
limitations specified in this permit.
4. Removed Substances
Solids, sludges, filter backwash, or other pollutants removed in the course
of treatment or control of wastewaters shall be disposed of in a manner
such as to prevent any pollutant from such materials from entering navigable
waters.
•
5. Power Failures '
In order to maintain compliance with the effluent limitations and prohibitions
of this permit, the permittee shall either:
a. In accordance with the Schedule of Compliance contained in Part I ,
provide an alternative power source sufficient to operate the
wastewater control facilities;
or, if such alternative power source is not in existence, and no
date for its implementation appears in Part i ,
b. Halt, reduce or otherwise control production and/or all discharges

upon the reduction,- loss, or failure of the primary source of
power to the wastewater control facilities.
B. RESPONSIBILITIES
1. Right of Entry
The permittee shall allow the head of the State Water/ Quality Control
Division, the Regional Administrator, and/or their authorized representatives,
upon the presentation of credentials:
a. To enter upon the permittee's premises where an effluent source is
located or in which any records are required to be kept under the
terms and conditions of this permit; and
b. At reasonable times to have access to and copy any records requir-
ed to be kept under the terms and conditions of this permit; to
inspect any monitoring equipment or monitoring method required in
the permit; and to sample any discharge of pollutants.
2. Transfer of Ownership or Control
In the event of any change in control or ownership of facilities from which
the authorized discharges emanate, the permittee shall notify the succeed-
ing owner or controller of the existence of this permit by letter, a copy
of which shall be forwarded to the Regional Administrator and the State
Water Quality Control Division.
3. Availability of Reports
Except for data determined to be confidential under Section 308 of the Act
and Regulations for the State discharge permit system (506) , all reports
prepared in accordance with the terms of this permit shall be available for
public inspection at the offices of the State Water Quality Control Division
and the Regional Administrator. As required by the Act, effluent data
shall not be considered confidential . Knowingly making any false statement
on any such report may result in the imposition of criminal penalties as
provided for in Section 309 of the Act, and C.R.S. (1973) 25-8-610.
4. Permit Modification
After notice and opportunity for a hearing, this permit may be modified,
suspended, or revoked in whole or in part during its term for cause includ-
ing, but not limited to, the following:

a. Violation of any terms or conditions of this permit;
b. Obtaining this permit by misrepresentation or failure to disclose
fully all relevant facts; or
c. A change in any condition that requires either a temporary or
permanent reduction or elimination of the authorized discharge.
5. Toxic Pollutants
Notwithstanding Part II , B-4 above, if a toxic effluent standard or pro-
hibition (including any schedule of compliance specified in such effluent
standard or prohibition) is established under Section 307(a) of the Act
for a toxic pollutant which is present in the discharge and such standard
or prohibition is more stringent than any limitation for such pollutant
in this permit, this permit shall be revised or modified in accordance
with the toxic effluent standard or prohibition and the permittee so
notified.
6. Civil and Criminal Liability
Except as provided in permit conditions on "Bypassing" (Part II , A-5) and
"Power Failures" (Part II , A-7) , nothing in this permit shall be construed
to relieve the permittee from civil or criminal penalties for noncompliance.
7. Oil and Hazardous Substance Liability
Nothing in this permit shall be construed to preclude the institution of
any legal action or relieve the permittee from any responsibilities, lia-
bilities, or penalties to which the permittee is or may be subject under
Section 311 of the Act.
8. State Laws
Nothing in this permit shall be construed to preclude the institution of
any legal action or relieve the permittee from any responsibilities, lia-
bilities, or penalties established pursuant to any applicable State law or
regulation under authority preserved by Section 510 of the Act.
9. Property Rights
The issuance of this permit does not convey any property rights in either
real or personal property, or any exclusive privileges, nor does it
authorize any injury to private property or any invasion of personal rights,
nor any infringement of Federal , State, or local laws or regulations.

10. Severability
.
The provisions of this permit are severable, and if any provision of
this permit, or the application of any provision of this permit to any
circumstance, is held invalid, the application of such provision to
other circumstances, and the remainder of this permit, shall not be
affected thereby.
PART III
OTHER REQUIREMENTS
1 . All land areas utilized by and operated under the authority of the
permittee for the disposal of manure, other waste solids, and liquid
wastes 'shall be isolated to prevent any pollutant from such materials
from entering the waters of the State, subject to the provisions
as provided in permit conditions on "Effluent Limitations" (Part I , A) .
Such provisions apply only to the discharge of pollutants from a
"point source" as defined in Section 502(14) of the Act. The diffused
drainage of natural precipitation on agricultural land resulting from
a "non-point source" is not subject to the conditions of this permit
under the referenced authority of the Act.

permittee for the storage or holding of manure; bedding materials;
silage, feeds, and feed concentrates; and other substances having
a waste contribution potential shall be isolated to prevent any
pollutant from such materials from entering the waters of the
S mate, subject to the provisions as provided in permit conditions
on "Effluent Limitations" (Part I , A) . Such provisions apply only to
the discharge of pollutants from a "point source" as defined in Section
502(14) of the Act. The diffused drainage of natural precipitation
on agricultural land resulting from a "non-point source" is not subject
to the conditions of this permit under the referenced authority of the
Act.
3. All wastes from dipping vats, pest and parasite control units, and
other facilities utilized for the application of potentially hazardous
or toxic chemicals shall be handled and disposed of in a manner such
as to prevent any pollutant from such materials from entering the
waters of the State, subject to the provisions as provided
in permit conditions on "Effluent Limitations" (Part I , A) , and then
only in accordance with the provisions of any toxic pollutant effluent
standards established pursuant to Section 307(a) of the Act.
4. If the permittee wishes to renew the permit, he shall reapply at least
180 days before this permit expires.
5. The permittee shall ensure that the earth sides and bottom of the runoff
retention ponds be sealed at all times to prevent seepage to the ground-
waters of the State.

I hereby certify that pursuant to a notice dated October 24, 1977
duly published October 26, 1977 and November 16, 1977 in the Greeley
Journal, a public hearing was held on the request of Don Anderson, Inc.
for a Special Use Permit for a Hog Operation. Mr. Barry Anderson
and Mr. Glenn Babcock, representing the applicant, were present and
made their request and answered questions for the Board. There was
no one in the audience in opposition to the request. Ken McWilliams,
Weld County Zoning Inspector, informed the Board that the request
also includes a subdivision exemption. After discussion, Commissioner
Dunbar made a motion to grant the special use permit and the subdivision
exemption to Don Anderson, Inc. Commissioner Carlson seconded the
motion and it carried unanimously. Commissioners Carlson, Dunbar,
Jacobucci and Roe were in attendance at the hearing. Chairman
Steinmark was absent.

RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 51 - DON ANDERSON, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Don Anderson, Inc. for
an exemption from the definition of subdivision and
"subdivided land" in Section 30-28-101 (10) , CRS 1973 , as
amended, and Section 2-1 of the Weld County Subdivision Regulations ,
and
WHEREAS, the Board of County Commissioners finds that Don
Anderson, Inc. is the owner of Part of the West Half of the
NWQ of Section 2 , Township 6 North, Range 66 West of the 6th
P.M. in Weld County, Colorado. Said Board finds that it would
be in the best interest of the public to exempt the lease
of the following descrihed real estate out of the above described
parcel of land as said lease does not come within the intent and
purposes of the Weld County Subdivision Regulations , and
WHEREAS, the parcel of land being leased is described
as follows, to-wit:
Part of the West Half 011/4) of the Northwest Quarter (NW n) of
Section 2, Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described
as follows:
Beginning at the Northwest Corner (NW Cor) of said Section 2,
and considering the West line of said Section 2 as bearing

being relative thereto;

exempting the aforementioned lease of land does not conflict
with the intent of the Weld County Comprehensive Plan, and
will not have an adverse impact on the existing use of the

the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the leasing of the
above-described parcel of land be, and hereby is, declared to be
exempt from the definition of "subdivision" and "subdivided land"
as set forth in Section 30-28-101 (10) , CRS 1973, as amended, and
in Section 2-1 of the Weld County Subdivision Regulations, and
further declares that said parcel shall not be considered a
separate lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of

Dear Sirs:
Re. a request from Don Anderson, Inc., for a hog operation
at N W 2 Sec 2 6N 66W.
We are very much opposed to granting approval for said hog
operation. We already suffer much from dust, odor and flies
from a cattle operation there, which is practically at our
front door. Our window screens have been solid with flies this
summer. No amount of spraying here could keep them away.
The dust on Road 74 at times is so thick, traffic is en-
dangered.
Once life was very pleasant here, now especiallyat the
dinner hour it is almost unbearable. To add the stench
of a hog operation would be just terrible.
This has been my home all of my life. There should be a
limit to what we must suffer.
The statment is made, it will be a limited operation.
I believe the same was said of the cattle operation, but it
grew, as will the hog operation.
The air flow from the south and south west is frequent enough
to create a serious health problem from just the cattle.
We will appreciate your earnest consideration of our
situation in this matter.

Dear Mr. Anderson,
This letter is in reference to your request for soil information as
required by the Weld County Planning Commission.
The soils underlying the proposed hog raising enterprise are known
as Kim Loam. It is a deep soil - 60 inches or greater. The surface
runoff is medium and the erosion hazard is low. It has good water
holding capacity.
The shrink-swell potential and potential frost action are low. This
allows the use of standard requirements for footings and other con-
crete work in the area.
The soil is good for septic tank absorption field and sewage lagoon
areas. There is a possibility that moderate problems can be encoun-
tered with seepage for a sewage lagoon, if the lagoon is deep. This
soil has a light clay loam in the profile and it will hold water if
it is used.
If standard construction procedures are followed, the area can readily
be sealed.
This does not preclude that an on site investigation is not needed.
