Subject: St. Vrain Sanitation and Floodplain
Commissioners,
This morning Clay Kimmi and I met with Rob Fleck of the St.Vrain Sanitation district and his engineering consultant Bob
Orsatti. The meeting topic was flood hazard permitting for the planned expansion of their wastewater treatment plant
to be located a quarter mile west of WCR 15 in the St.Vrain floodplain. They left much happier than when they arrived.
Their expansion construction Notice of Bid Award is next week with Notice to Proceed in early June. They have not
pulled any building permits yet. For the County to have appropriate documents to meet FEMA requirements, we've
asked for, and they have agreed to update an older flood model of the area and submit that to FEMA for a LOMR and so
doing verify that their site is safe from flooding. We would use that same information to issue a conditional Weld
County Flood Hazard Development permit. Worst case they might have to flood proof per FEMA requirement, best case
they prove their site is out of the floodplain.
Their contractor can pull a grading permit in June to start preliminary site work; their project moves ahead on schedule.

The existing St. Vrain Sanitation District facility was built on fill in 1987. They did not report that construction to FEMA
so FEMA has written them a letter(3/22/11) asking that they provide data and modeling to document that floodplain fill
and any impact on adjacent properties(submit a LOMR). Once FEMA approves the LOMR for the old fill and if the
expansion of their facility is on that area of fill, it would be considered out and not subject to floodplain regulations.
However, any activity outside the area released by FEMA would still need to be evaluated for compliance with both
FEMA and Colorado Water Conservation Board rules. We are asking that they provide whatever they submit to FEMA
to us so we stay compliant with FEMA. Their site is in the center of the floodplain, if they have any floors below flood
elevation, they will probably have to flood proof. Clay has a meeting with St.Vrain's operations manager on Friday
where we will discuss how to get through the Federal process. The County is not holding up their permits.

Dear Commissioner Rademacher and Conway,
St. Vrain Sanitation District(SVSD) appreciates the recent approval by the Board of
Commissioners regarding our plant site in Weld County near the St. Vrain River. Your
assistance will provide us the opportunity to soon begin construction on this important
sanitary sewer project in the southwest Weld County area.
An issue arose following our discussion and approval from the County that I would
appreciate your assistance and thoughtful direction regarding. We have been told by
Clay Kimmi of the Planning Division, of the possible need to submit a floodplain change
including a LOMAR. This seems unnecessary since we are not altering in any manner
the placement of facilities, buildings or processes with the design and build of the new
plant. Bottom line, nothing on the 45 acre site that SVSD owns is neither changing from
our previous plant design last built in 2002, nor floodplain specifics that were included in
the 2006 CLOMR approved by Weld County for the CARMA subdivision St. Vrain
Lakes. The 2006 approved CLOMR reflect the past work performed by the Corp using
the NAVD 1988 Datum.
We are anticipating a meeting with staff of the County this coming week. We have
performed cross section surveys of the area specific to the plant site to demonstrate no
significant change to the plant site. Our concern is the cost and delay that potentially is
involved with the necessary steps that may be sought from the County to meet standards
that do not seem applicable to our project or situation. We have been approved for the
site plan design by the State Public Health and Environment staff and our site plan (as
previously mentioned) does not take up any additional footprint or encroach upon the
floodplain areas of our property. We are at the point of award of bid to a contractor and

anticipated that they would be on site in late May to begin this $28 million and 21 month
project.
