All tanks are raised, with integral skids and do not sit directly on grade, thereby making them visible for leakage inspection. Soils are capable of supporting their weight. CR-122 Water Loading Dock No. 1: Proposed USE of the Property A& W Water Service, Inc. (A&W)proposes periodic,temporary storage of various portable tanks, 5th wheel type trailers &miscellaneous oil/gas field equipment on a 5.283±acre Site near Grover, Colorado (Lot A,RE-4158). An average of 5 round trip semi loads per day would occur (up to 85,000# GVW). In addition,2 commercial water wells will serve a"water loading dock"with up to 10 -20,000 gallon water tanks and appropriate manifolding to provide trucked water to oil/gas operations. An average of 34 round trip truck tanker loads per day would occur(up to 85,000#GVW). The elonly employees will be truck drivers and a supervisor occasionally. No employees will be stationed on the Site. Ingress access to the Site is via Weld County Access Permit Number AP 10-00041. No septic nor potable water will be required. Landscaping will be via non-irrigated natural grasses and no screening is proposed. Negligible grading and change of contours are planned. The Site is essentially flat with minimal change in elevation. A tributary of Crow Creek is located approximately 3,750'west,but the Site appears to drain easterly. No paved surfaces nor buildings are proposed. Gravel driveways will be on a portion of the site to serve the water loading operation. Hours of operation will be 24 hours/day, 365 days/year with the high majority during daylight periods. AGREEMENT FOR A&W WATER SERVICE, INC. THIS AGREEMENT ("Agreement") is made and entered into this Z/ day of November , 2011, by and through the County of Weld, State of Colorado, acting through the Department of Planning Services, and A&W Water Service, Inc. whose address is P.O. Box 887, Fort Lupton, CO 80621, Colorado. WITNESSETH WHEREAS, as explained in its letter of October 26, 2011, attached hereto and referred to herein as Exhibit "A," on real estate being more particularly described as Lot A of RE-4158, being part SW4 of Section 32, T10N, R61W of the 6th P.M., Weld County, Colorado (the "Property"), A&W Water Service, Inc. proposes to conduct a water hauling operation for use in construction, oil and gas operations, agriculture, ranching, and/or other areas where bulk water is needed, and WHEREAS, A&W Water Service, Inc., in its letter of Exhibit A, has provided adequate proof and justification for early release of building permits and the operation of a commercial water loading facility in accordance with the terms and conditions of this Agreement. NOW, THEREFORE, in consideration of the foregoing, County consents to A&W Water Service, Inc. for early release of building permits for the water tanks and the electrical work for the existing well on the Property and use of the property in accordance with Exhibit A. A&W Water Service, Inc. agrees to conduct the work in accordance with the following terms and conditions: 1. The above recitals are incorporated herein by reference. 2. A&W Water Service, Inc. shall be responsible to excavate, repair, or patch any damage as a result of ingree/egress to adjacent roadway. The County shall be consulted prior to any work being conducted on any County road. The type and method of repair will be determined by County. 3. Staging or parking trucks on the travel lanes of the adjacent public roads is prohibited. Nuisance conditions (mud, puddles on road) are to be prevented and cleaned up by A&W Water Service, Inc. if they occur. 4. If USR11-0014 is approved by the BOCC, A&W Water Service, Inc. shall have sixty (60) days from the date of the BOCC hearing to complete the conditions of approval and have a plat ready for recording. In the event the USR is not approved, A&W Water Service, Inc. shall have six (6) months after final action to dismantle any infrastructure constructed for the Pilot Project and return the Property to its existing condition. 1 5. A&W Water Service, Inc. shall comply with all of the promises and covenants set forth in its letter of Exhibit A. 6. A&W acknowledges that there is a pending sale, to the County, of the adjacent 5 acres (Lot B of RE-4158), and that the development of both sites may include sharing an access and drainage improvements. 7. A&W shall utilize the existing access on Lot A of RE-4158 for entry and exit until the shared access on Lot B of RE-4158 is functional. At that time, the access on Lot A of RE-4158 shall become an "enter only" access with all A &W traffic exiting on Lot B of RE-4158 shared access. 8. In exchange for the Property,the County intends to do the following: 1. Pay twelve-thousand five-hundred dollars ($12,500.00). 2. Draft the necessary documents to complete the sale of the Property. 3. Obtain a commitment to title insurance along with any documents,if possible,listed in the title commitment as exceptions to the title. • 4. Split any closing costs for purchasing the Property with A&W. 5. Construct at the County's sole expense,a paved driveway entering onto the Property from Weld County Road 122 and running north to south along the western boundary of the Property. The paved driveway shall lie entirely on the Property. A&W Water Service Inc.shall have access to the paved driveway in order to access its property to the west of,and adjacent to,the subject parcel. However,any additional pavement,grading,or other work necessary to facilitate access from the paved driveway to the A&W property will be at the sole expense of A&W. Access to the parcel north of,and adjacent to,the Property by way of the paved driveway and along the north-south boundary of the parcel shall also be allowed by the County. 6. Coordinate with A&W in the design of a water quality/drainage feature. Each party shall be responsible for its respective costs to construct their respective water quality/drainage feature. A&W shall be responsible for transferring the Property upon closing and splitting the closing costs. Additionally,prior to closing,A&W shall deliver to the County copies of all leases,surveys,easements, liens,or other title matters not shown by the public records of which A&W have knowledge. Should the sale of the Property not occur for whatever reason,neither the County nor A&W will be bound to the terms proposed in this letter of intent. No. 2: Consistency with Weld County Comprehensive Plan A. Section 23-2-220.A.1 —The proposed Use is consistent with Chapter 22 and other applicable code provisions or ordinances in effect. Section 22-2-20.C. A.Goal 3. states: "County land use regulations recognize and • respect the rights afforded by the State Constitution and associated statutes of Revised 10/19/2011 individually decreed water rights. Water rights are considered real property and should be protected as any other private property right." The State Engineer, Division of Water Resources has permitted two (2) wells for commercial use via truck hauling on a tract of land 22± acres in area owned by A & W Water Service,. Inc. Section 22-2-20.C A. Policy 3.3 states: "Land use regulations should consider the traditional and future operational viability of water-delivery infrastructure when applications for proposed land use changes are considered." The proposed facility will utilize ground water from 2 wells (74693 & 74694) that are permitted through the Division of Water Resources for commercial use via truck hauling. Section 22-2-20.G. A. Goal 7. states "County land use regulations should protect the individual property owner's right to request a land use change." Section 22-2-20.G 1.A Policy 7.1. states "County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture,to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. The proposed water • loading dock will support oil and gas companies within a fifty(50) mile radius by supplying water for their oil and gas drilling operations and industrial uses. Section 22-2-20.6. 2.A Policy 7.2. states "Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject Site is in an area that can support development and should attempt to be compatible with the region. The Site is `A mile northwest of the Town of Grover and is bordered by County Road 122. The facility will be located on a 5.63± acre parcel (Lot A). Ground water from the wells will be pumped to the loading dock. Section 22-2-80.D 1.Goal 4. Of the Weld County Code states: "All new industrial development should pay its own way." A & W Water Service, Inc. and their successors will be paying for all on-site and off-site improvements associated with this Use as required through an Improvements Agreement. Section 22-4-30.A.WA.Goal.1. states "Support the development of water that is put to beneficial use, along with associated infrastructure." The proposed loading dock will provide a valuable and indispensable service to oil and gas companies. The location for the load-out minimizes the removal of agricultural land from production. An occasional supervisor with pickup will inspect the operations. Traffic will comply with Weld County's Oil & Gas Haul Route Map dated April, 2011, as may be revised. The Site is 'A mile northwest of the Town of Grover and is bordered by County Road 122. The facility will be located on two (2) 5.63±acres adjacent parcels (Lots A &B). Ground water from the wells will be pumped to the loading dock. Section 22-2-80.D 1.Goal 4. Of the Weld County Code states: "All new industrial development should pay its own way." A& W Water Service, Inc. and their successors will be paying for all on-site and off-site improvements associated with this Use as required through an Improvements Agreement. Section 22-4-30.A WA.Goal.1. states "Support the development of water that is put to beneficial use, along with associated infrastructure." The proposed loading dock will provide a valuable and indispensable service to oil and gas companies. The location for the load-out minimizes the removal of agricultural land from production. States"Strive to maintain and protect water supply storage facilities, conveyances and infrastructure adequate to sustain continued water use"The allocation of groundwater and installing a loading dock is an appropriate use in an agricultural area. In fact, the proposed use would ultimately reduce the impacts of oil and gas operations in the area because utilizing local groundwater for production would generate less noise, dust, traffic and waste. Section 22-6-20.C.1 ECON Policy 3.1. County activities and regulation should protect the rights of private property owners and the public healthy, safety and welfare,recognizing that these basic rights and protections allow the free market to prosper and grow the local economy. B. Section 23-2-220.A.2—The proposed Use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.A.2 of the Weld County Code provides for Oil and Gas Support and Service as a Use by Special Review in the A (Agricultural)Zone District. C. Section 23-2-220.A.3 —The Uses which will be permitted will be compatible • with the existing surrounding land uses. The facility is located in a rural agricultural area on a parcel containing no improvements. Adjacent properties are utilized for grazing and similar farming/ranching operations. Oil and gas facilities are existing encumbrances on adjacent properties. There is one residence east of Lot B and the Town of Grover is some 1/2t miles to the southeast. Development Standards and Conditions of Approval will ensure that this Use will be compatible with surrounding land uses. D. Section 23-3-220.A.4—The Uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The Site is located within the 3-mile referral for the Town of Grover. E. Section 23-2-220.A.5 The application complies with Section 23-5 of the Weld County Code. The existing Site is not within a recognized overlay district, including the Geologic Hazard, Flood Hazard or Airport Overlay District. The existing Site is within the County Road Impact Fee Area and the Capital Expansion Impact Fee area. • • Effective April 25, 2011, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program (Ordinance 2011-2). The proposed site is located in SE 'A of the SW 'A of Section 32, Township 11 North, Range 61 West in Weld County. More specifically,the site is located approximately 1300 feet east of the intersection of Weld County Road (WCR) 87 and WCR 122. The site is bound on the south by WCR 122 and on the other three sides by undeveloped natural grasslands. The existing site is covered by natural grasslands and • is 10.6 acres.
