GREELEY, COLORADO 80631 COLORADO May 3, 1978 Mayor George Hall City of Greeley Civic Center Greeley, CO 80631 RE: Southeast Water Transmission Line Dear Mayor Hall and Council Members: On May 2, 1978, the Weld County Board of Commissioners met with representatives of the City of Greeley concerning the permits and easements required on the above project. Involved in the project are portions of 1st Avenue and 23rd Avenue which are owned one-half by the City of Greeley and one-half by Weld County. These half owned roads cause major governmental problenn of jurisdiction in the areas of police protection, repair and maintenance, determinations of upgrading specifications and liabilities. On the above project, the Board of Weld County Commissioners wishes to enter an agreement with the City of Greeley as follows: 1. That Weld County will grant the required easements and permits and waive all county permit fees involved in the project. 2. That the City of Greeley agrees to maintain the portion of 1st Avenue, approximately 2925 L.F. , and the portion of 23rd Avenue, approximately 2000 L.F. , which are presently one-half owned by the City and County. The City would maintain and accept responsibility for these portions of road from the beginning of construction through annexation by the City of Greeley. 3. That the sewer pipeline extension along 31st Street from 1st Avenue to Empire Street in Evans be granted required easements and permits with a waiver of the fee and the City agrees to maintain the County portion of the one-half County and one-half City of Evans portion of 31st Street from beginning of construction through annexation by the City of Greeley. 780514 SL a ar, 1)77c 5/3/ a) Page 2 Mayor Hall & Council Members / If you have any further questions, please feel free to contact our office.
