HomeMy WebLinkAbout20111000.tiff HEARING CERTIFICATION DOCKET NO. 2011-22 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1773 FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (FLOORING BUSINESS), PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR LOTS PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISION IN THE A (AGRICULTURAL) ZONE DISTRICT — KEN WOLF A public hearing was conducted on April 20, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tern Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Christie Peters Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Mary Evett Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated March 11, 2011, and duly published March 16, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Ken Wolf, for a Site Specific Development Plan and Use by Special Review Permit#1773 for any Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (flooring business), provided that the property is not a lot in an approved or recorded subdivision plat or lots part of a map or plan filed prior to adoption of any regulations controlling subdivision in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and provided a brief description of the site and the surrounding land uses. Mr. Ogle stated all of the employees, of the proposed flooring business, are subcontractors who drive their own vehicles to the site. He stated the site is not located within an Intergovernmental Agreement Area; however, it does lie within the three (3) mile referral area for the Town of Mead and Boulder County. Referrals were sent to The City of Longmont, Town of Mead, and Boulder County; however, Planning staff did not receive a response from either municipality, although they did receive one letter from a surrounding property owner who resides in Boulder County expressing concern about the possibility for a commercial strip development and a decrease in property values. Mr. Ogle also displayed photographs of the site and surrounding properties. In CIA,PL, Pw , 4A, 2011-1000 5 c�,t4 PL2114 HEARING CERTIFICATION - KEN WOLF (USR-1773) PAGE 2 response to Commissioner Conway, Mr. Ogle said the concerned property owner lives one half mile north of the site and owns an equestrian facility. Heidi Hansen, Department of Public Works, stated County Road 1 is classified as a collector road, which requires 80 feet of right-of-way at full buildout, and there are currently 60 feet of right-of-way. Ms. Hansen stated existing access to the property is on County Road 1, which has a traffic count of approximately 1,811 vehicles per day, as of February 2010. Mary Evett, Department of Public Health and Environment, stated the water for the site is provided by Longs Peak Water District. She stated there is an existing septic system on the site permitted for a three (3) bedroom home; however, if the applicant chooses to utilize it for employee use, she recommends the applicant have the existing septic system evaluated by a professional licensed engineer. Ms. Evett stated the applicant provides a dumpster on the site, and no vehicle maintenance or repairs will be performed on the site. In response to Commissioner Conway, Ms. Evett stated the existing septic system can accommodate six (6) people per day. Ken Wolf, applicant, was present and provided background information about his home improvement/flooring business. In addition to the two (2) office employees on the site, there are eight (8) contractors who utilize their vehicles/trucks to pick up carpet padding and access the facility's dumpster. Mr. Wolf added that since the majority of his business is completed off the premises, the vehicles/trucks are not parked at the site all day long. In response to Commissioner Conway, Mr. Wolf stated there are approximately ten (10) to twelve (12) people who access the site on a daily basis. No public testimony was offered concerning this matter. In response to Commissioner Rademacher, Mr. Ogle stated the applicant would like to construct an enclosed building to store the dumpster, to prevent the scattering of trash and keep it from being seen by the public. Mr. Ogle stated this request is adequate; however, the structure has yet to be constructed. Responding to Chair Kirkmeyer, Mr. Wolff stated he has reviewed, and concurs with, the Conditions of Approval and Development Standards, as proposed. Commissioner Conway moved to approve the request of Ken Wolf for a Site Specific Development Plan and Use by Special Review Permit#1773 for any Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (flooring business), provided that the property is not a lot in an approved or recorded subdivision plat or lots part of a map or plan filed prior to adoption of any regulations controlling subdivision in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously.
