Dear Peter: Following is our reply to your adequacy review of 24 may 2011. To aid your review, your original comments are shown, followed by our reply in blue (boxed), as follows: 1. As required by Rule 1.6.2(d) and 1.6.5(2), please submit proof of publication in a newspaper of general circulation in the locality of the proposed mining operation. Refer to attached proof. 2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of surface and mineral rights of the affected land and the owners of record of all land surface within 200 feet of the boundary of the affected land including all easement holders located on the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. Refer to the attached proofs. 3. The Division received comments from the Colorado Division of Water Resources, Colorado Ilistorical Society, the Corps of Engineers, Kerr-McGee and Weld County Public Works Department. The letters are attached for review. Please address the comments noted in the letters and make any changes to the application as necessary. 1 The Kerr-McGee line is an approximation for purposes of notification. No digging will occur within 10± feet of the right-of-way. Any extraction within the Right-of-Way will require notification of the utility through the UNCC locate and utility service rules. Weld County concerns for flood plain considerations will be complied with to the extent required by law. The applicant maintains that fill activity will not exceed historic elevations and will have no adverse impacts on the floodplain. There is no surveyed floodplain or established floodway for this location to our knowledge. 6.4 SPECIFIC EXHIBIT REQUIREMENTS - REGULAR 112 OPERATIONS The following items must be addressed by the applicant in order to satisfy the requirements of C.R.S. 34-32.5-101 et seq. and the Mineral Rules and Regulations of the Mined Land Reclamation Board: 6.4.3 Exhibit C - Pre-Mining and Mining Plan Maps of Affected Land 4. The copy of Exhibit C — Pre—Mining Plan Map submitted by the Applicant in the permit application did not indicate the following land and structure owners. Please revise Exhibit C to indicate the following owners: a. Merit Energy b. Xcel Energy c. Town of Firestone —Road Right—Of—Way a. Merit Energy was included by error and has no facilities within the permit boundary or within 200 feet outside of the boundary. b. The map was revised to show the approximate location of the Xcel Energy line, which is a buried line that runs north to south from WCR 26 and apx. 1-3 feet from the United Power overhead pole (Refer to S-11 on map. c. The approximate location of the Town of Firestone urban drainage Right-of-Way, runs from the centerline, and nine (9) feet either side of the centerline, of the ditch seen in the aerial image running along the east boundary of the permit, as shown on the previous and now revised Exhibit C - Pre-Mining Plan Map, under S-9. Varra Companies, Inc. Permit M1984-036 2 Varra Companies Project 110—March 2011 Amendment Correspondence of 5 July 2011 5. Please revise the list of adjoining surface owners of record as shown on Exhibit C - Pre-Mining and Mining Plan Map to indicate the following: a. The address for American Telephone & Telegraph Co. b. The names and address for the residential structures labeled "S15" on Exhibit C. American Telephone & Telegraph field operations are orchestrated through Qwest communications, which was notified as shown in proofs provided under Item #2, above. 6.4.5 Exhibit E - Reclamation Plan 6. Please define the term "agricultural stockpiles " used by the Operator on page 2 of Exhibit E - Reclamation Plan. Agricultural stockpiles includes any kind of material found in typical agricultural applications, including but not limited to, stockpiles of grains; feed in the form of baled or stacked hay, straw; or other organic materials such as manure, firewood, etc.; materials necessary to maintain agricultural operations and activities including maintenance of roadways, field equipment such as irrigation pipe; or other materials necessary to support the care and maintenance of livestock, fences, houses, barns, shelters, etc. A partial listing appears in the list provided with the original submittal. 7. The Operator states equipment and correlated processing of materials for recycling will remain in Area 3 as part of the revised reclamation plan. The Operator stated during the Pre-Operational inspection for the amendment (AM-02) the recycling equipment, concrete stockpiles and asphalt stockpiles would be removed from the site as part of reclamation. Please revise the proposed reclamation plan to indicate the recycling equipment and stockpiles will be removed from the site. Recycling equipment and stockpiles will be removed from the site as part of reclamation, unless otherwise provided for by an allowed or special use under Weld County Zoning Regulations. 6.4.12 Exhibit L - Reclamation Costs Varra Companies, Inc. Permit M1984-036 3 Varra Companies Project 110—March 2011 Amendment Correspondence of 5 July 2011 8. The Division prepared a reclamation cost estimate for the Varra Resources Project 110 based on the information provided by the Applicant in the amendment application. The Division estimates the total cost to reclaim the site is $87,788.70. A copy of the estimate is enclosed for your review. The Division currently holds a financial warranty in the amount of $87,200. The Division will reduce the amendment cost estimate to match the current financial warranty amount. Acknowledged. 6.4.13 Exhibit M — Other Permits and Licenses 9. Please commit to providing the Division with any of the approved permits and licenses required for the Varra Resources Project 110 site. There are no new permits or licenses required to effect this part of the Amendment. 6.4.18 Exhibit R - Proof of Filing with County Clerk and Recorder 10. Please provided an affidavit or receipt indicating the date on which the revised application was placed with the local County Clerk and Recorder for public review, pursuant to Subparagraph 1.6.2(1)(c). The proofs provided show the placement occurred at the Weld County Clerk to the Board. This is the location Weld County uses for placement of materials. The pit is proposed to be located at or near section 9, T5N, R65W. DMRS Rule 34-32.5-109(3) requires that the mining operator comply with local land use and zoning regulations. Since FEMA and the Colorado Water Conservation Board (CWCB) requires local jurisdictions to administer the Federal and State floodplain regulations, Weld County requests that a condition be added to the reclamation permit requiring a FEMA approved Letter of Map Revision (LOMR) prior to the release/vacation of the DMRS permit. The reason for the above request is that Weld County has recently been informed by FEMA in a letter dated January, 13, 2011, that in order to remain compliant with the National Flood Insurance Program, Weld County has to ensure that LOMRs are submitted to FEMA for gravel pits located in a floodplain (See attached letter). FEMA requires that chances such as 100-year flood water surface elevations, floodplain boundaries, and floodway boundaries be documented and accepted through their LOMR process. Subsequently, Weld County requires evidence of a FEMA approved LOMR prior to vacation of the County's land use permits. The Federal Regulations that apply can be found in 44CFR 60.3 and 65.3. FEMA, the CWCB, and Weld County have floodplain regulations which potentially impact how the site can be used after reclamation. The above mentioned agencies also have regulations in place regarding the erosional stability of any fill that may be left in the floodplain at the completion of mining. Gravel mining activity has potential adverse impacts on the hydrologic balance of the groundwater and surface water systems. The FEMA mapped floodplain is a part of the hydrologic balance and is therefore potentially impacted by gravel mining operations. DRMS Rule 34-32.5-116(4)(h) requires that changes to the hydrologic balance of the affected land be minimized. ORMS Rule 34-32.5-116(4)0) requires that areas outside of the affected land shall h. protected from damage occurring during the mining operation and reclamation. Mining and reclamation activities may have changed the conveyance of the floodplain in the 100-year flood. Since the currently mapped floodplain extends beyond the operator's property, the potential exists for surrounding property owners to be impacted or even damaged by the mining and reclamation activities that have occurred on the operator's property. The operator can reduce their liability by obtaining a FEMA approved LOMR which documents the impacts that mining has had on the FEMA mapped floodplain. To summarize, in order to be consistent with applicable Federal, State, and Local floodplain regulations, Weld County requests that the DRMS place a condition on the amended permit to require a FEMA approved LOMR prior to the release/vacation of the DRMS permit. This requirement will provide evidence that the mining operation has not adversely impacted the hydrologic balance or adversely impacted properties outside of the affected land from damage caused by the mining and reclamation operations. Weld County joined the NFIP Sept. 16, 1974 at which time a Flood Hazard Prevention Ordinance was adopted in exchange for flood insurance being available to anyone in the community. The currently effective FIRM was preceded by two maps; a Flood Hazard Boundary Map (FHBM) dated March 21, 1978 and a FIRM dated March 18, 1980. Weld County's current Flood Insurance Rate Map(FIRM) and floodplain prevention ordinance is dated September 22, 1999.The County currently has 268 flood insurance policies in force and has experienced 22 paid claims since 1978. There is currently a question whether a development activity that was permitted prior to the initial FIRM requires a Letter of Map Revision(LOMR) to be completed. Due to the current FIRM not reflecting the current physical features due to manmade actions, it is interpreted that a LOMR will be required to meet the minimum NFPP requirements codified in the Code of Federal Regulations (CFR) Title 44 Part 60.3, specifically 44 CFR 60.3 (b)(3): "Require that all new subdivision proposals and other proposed developments (including proposals for manufactured home parks and subdivisions) greater than 50 lots or 5 acres,whichever is the lesser, include within such proposals base flood elevation data."For the purposes of the NFIP, development is defined in CFR 59.1 as any man-made change to improved or unimproved real estate, including but not limited to building or other structures,mining, dredging, filing, grading,paving excavation or drilling operations or storage of equipment or material. This action is supported 44 CFR 65.3 Requirement to submit new technical data which states that: A community's base flood elevations may increase or decrease resulting from physical changes affecting flooding conditions. As soon as practicable,but not later than six months after the date such information becomes available, a community shall notify the Administrator of the changes by submitting technical or scientific data in accordance with this part. Such a submission is necessary so that upon confirmation of those physical changes affecting flooding conditions,risk premium rates and flood plain management requirements will be based upon current data. 44 CFR 60.3 (b) (7) also states...Assure that the flood carrying capacity within the altered or relocated portion of ay watercourse is maintained. www.fema.gov • • Clay Kimmi January 13, 2011 Page 2 With the changes that have been made within the floodplain, and for the County to remain in compliance with the NFIP,per 44 CFR 65.3.
