RE: ACTION OF THE BOARD CONCERNING ZCV #0900299 AGAINST MARK AND
KARLA STEVENS FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mark and Karla Stevens, ZCV #0900299, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Mark and Karla Stevens, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 10, 2011, to allow adequate time for the property owners
to acquire proper permits, have the mobile home set up, obtain a Certificate of Occupancy, and
to vacate the RV/Camper trailer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #0900299 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Mark and Karla Stevens to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until August 10, 2011, to allow
adequate time for the property owners to acquire proper permits, have the mobile home set up,
obtain a Certificate of Occupancy, and to vacate the RV/Camper trailer.

09/29/2009 Property Inspected Upon a visual inspection of the property, the following

items were noted: camper/trailer-RV appears to be
utilized as a dwelling unit. Connected to utilities. No
pictures were taken during this inspection.
12/03/2009 Property Inspected Upon a visual inspection of the property, the following
items were noted: camper/trailer still connected and
appeared to be still skirted. No pictures were taken
during this inspection.
12/21/2009 Property Inspected Upon a visual inspection of the property, the following
items were noted: the camper/trailer(5th Wheel) is still
set as their Principle Dwelling Unit(skirted, connected,
like an old fashioned clothes washer and a canopy type
cover for a back porch). I posted the property with a
Violation Hearing Notification sign. See pictures dated
12/21/09.
12/21/2009 Phone Call Mark Stevens (303-304-9451 cell) called. He stated he
had a yellow sign in his front yard. He said he thought he
could live in the 5th Wheel while they were working on the
property. He said their intent was to demolish the mobile
home(because it was too old to be remodeled). I
explained that we do have something called a Temporary
during Construction, but it requires a building permit for
the Principle Dwelling Unit. He said what if they just
submitted the demo permit. I said that would not be a
building permit for a Principle Dwelling Unit. He asked if
that meant he would need to submit the demo permit and
the building permit. I said yes and the Zoning Permit for a
Temporary during Construction. He said he would try to
get in here before the hearing so that a hearing would not
be necessary. He asked about the SW Weld Office. I
explained that due to a slowdown in the construction
business we are no longer located down there right now.
He said he would try to make it to Greeley today or
tomorrow.
12/22/2009 Office Visit Mark Stevens came to the Greeley Planning Office. He
picked up a building permit application for a demolition
permit, a building permit for the installation of a new
mobile/modular home and a Zoning Permit for a Mobile
Home(for a Temporary during Construction). He also
asked about the ZPAS and Temporary Seasonal permits
(thinking the RV would fall under one of those). I
explained both processes and uses.
02/23/2010 Phone Call I called Karla Stevens (303-857-1108)and left a voice mail
indicating that they would be receiving a Violation Hearing
Notification letter in the mail scheduling a Hearing for
March 9, 2010, but if a building permit for a Principle
Dwelling application was submitted prior to the hearing the
hearing would be canceled.
02/23/2010 Phone Call Mark Stevens called Wendi Inloes to discuss the violation
case. She explained that they needed to do as much as
they could before the Violation Hearing and then they
could request a short extension from the Board (maybe 30
days).
03/02/2010 Certified Mail Receipt Certified Receipt received -signed.
03/08/2010 Property Inspected Upon a visual inspection of the property, the following
items were noted: the derelict mobile homes(previous
principle dwelling)are still present as well as the
camper/trailer unit. See pictures dated 03/08/10.
04/06/2011 Certified Mail Receipt Certified Receipt received-signed.
04/07/2011 Other Updated letter sent—notifying of**Case Continued**to
May 10, 2011.

Dear Applicants:
This letter is in regards to your temporary zoning permit that was approved in March of 2010,
for a recreational vehicle to be used as a temporary use during the construction of a principle
dwelling. As you are aware, the Board of County Commissioners remanded this case back to
planning a year ago to work with you during your financial situation to place a permanent home
on your property. To date, the existing mobile homes have been demolished and removed, but
there has still been no progress as far as getting a permanent home on the site. The Weld
County Code states that a permanent dwelling is to commence within 90 days of approval of the
temporary permit. However, as stated, it has now been a year, and a recreational vehicle used
as a dwelling, is not a use allowed. At this time, we would like a status as to where you are in
the process of a principle dwelling, and will schedule you back before the Board of County
Commissioners through the violation process should you need additional time, as you are still in
violation.
Please contact me at the above address, telephone, or email address within five days of receipt
of this letter as to the status of your property.

Wendi Inloes, Planning Coordinator.
A building permit application was submitted on January 12, 2010 for the demolition of the existing
mobile home.
A Zoning Permit(ZPMH)application for recreational vehicle for a Temporary during Construction will be
completed and submitted by January 22, 2010.
A building permit application for the Principle Dwelling Unit will be submitted by February 22, 2010.
Failure to abide by the above time frames would result in a new Violation Hearing be scheduled before the
Board of County Commissioners.

completed and submitted by January 22, 2010.

Failure to abide by the above time frames would result in a new Violation Hearing be scheduled before the

unit shall be disconnected from all utilities, any skirting (if applicable) shall be removed and the
unit shall be vacated as a dwelling unit.
This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
