RE: ACTION OF THE BOARD CONCERNING ZCV #1000121 AGAINST ALICE PEHR
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Alice Pehr, ZCV #1000121, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of February, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Alice Pehr, property owner, was not present; however, David Pehr,
representative, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until March 8, 2011, to allow adequate time for the property owner to
remove the remaining noncommercial junkyard items from the property and to submit all
documentation needed for the Amended Recorded Exemption (AMRE) application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000121 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Alice Pehr to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until March 8, 2011, to allow adequate time for
the property owner to remove the remaining noncommercial junkyard items from the property
and to submit all documentation needed for the Amended Recorded Exemption (AMRE)
application.

applications are submitted to the Department of Planning Services and deemed complete prior to the above
Violation Hearing (along with the following items), the hearing will be cancelled.
Additionally, necessary to cancel the hearing, the following needs to be completed:
As we have previously discussed, while the presence of a NONCOMMERCIAL JUNKYARD consisting of
DERELICT VEHICLES, iron/metal and miscellaneous debris as called out in the following definitions is an
allowed use within the Agricultural Zone District, it must be completely SCREENED from all adjacent properties

and public rights-of-ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of
current registrations shall be submitted to this office.
Additionally, the vacant and DERELICT MOBILE HOMES shall be removed from the property. The remaining
mobile home might be able to obtain a permit, but would need to qualify under a Temporary Zoning Permit use,
such as an Accessory to the Farm or a Medical Hardship; otherwise, it shall be removed as well. Please
discuss this issue with one of our On-Call Planners. They are available Monday thru Friday from 7:30 am -4:30
pm. If you would like to come to the office, please call ahead (970-353-6100 Ext. 3540) so a sufficient amount
of time can be set aside to discuss this non-compliance issue with you. Additionally, to better serve you

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is partially or totally
dismantled; has all or portions of its body work missing or is substantially damaged; does not have valid
registration with the State, as required by Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number
plate assigned to it is not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is
lacking proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or
otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202 to 42-2-227, C.R.S.
This definition shall not include implements of husbandry, farm tractors or vehicles customarily operated in a
FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand materials are stored or
handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials
and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT
VEHICLES registered last or currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES, If the Zone district allows, the NONCOMMERCIAL
JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually SCREENED from all
ADJACENT properties and public rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or
other materials USED with the approval of the Department of Planning Services to lessen the noise, light, heat
or visual impacts of a USE on surrounding uses. A SCREENING PLAN shall be submitted and approved by the
Department of Planning Services.
DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE) HOME that is partially or
totally damaged by fire, earthquake, wind or other natural causes, or is in a state of general dilapidation,
deterioration or decay resulting from improper lack of maintenance, vandalism or infestation with vermin or
rodents. Any such DERELICT MANUFACTURED (MOBILE) HOME shall be returned to and maintained in the
condition as originally established on site and as inspected by the Building Inspection Department, or it shall be
removed from site.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County
Attorney's Office for immediate legal action.

is David's sister. We discussed Scott's Diesel violation of their USR
and then we discussed Alice Pehr's violation case. David indicated
that Alice is his mother. I advised him that I would see about getting
a letter out regarding Alice's property. He asked that I e-mail it to

10/20/2010 Phone call I spoke to David Pehr(303-427-1516). He indicated that 3 semi
loads of scrap iron/metal has been removed from Larry & Teresa
Scott's property. He also stated they have emptied the mobile
homes and have arranged for an asbestos inspection. Once
determined free of asbestos, Fort Lupton Fire has agreed to burn
them. He indicated he will have the Pre-Application submitted no
later than next Tuesday(10/26/10), but will shoot for Friday
(10/22/10).

Inspection Result Comment Upon a visual inspection of the property, the following items were noted: There
are several mobile home situated on the property (those along the Eastern
property line appear vacant and sitting)and 1 along the Northern property line
that appears occupied. There is also a stick built(based upon aerial
photography)further back. There was a considerable amount of derelict
vehicles, commercial vehicles&equipment, iron/metal and miscellaneous debris
closer to the Scott's Diesel site, but situated on this parcel. No pictures were
taken during this inspection.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be
