RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1100007 AGAINST DANIEL AND JANA STREVEY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Daniel and Jana Strevey, ZCV #1100007, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Daniel and Jana Strevey were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. (The legal description is Unit 109 Garagetown; Section 10, T2N, R68W of the 6th P.M.; Situs Address is 3656 Stagecoach Rd) Background Information: The applicant currently owns the subject unit and has divided it into two separate spaces. The applicant rents out one space to Summit Interlock which installs an ignition interlock device for persons who have received court orders. Water and sewer services are provided to the unit. Building Department According to the applicant, the demise wall was previously permitted. A change of use building permit will need to be obtained for changing it from storage to vehicle maintenance. Road Impact fees may be required if no fee was originally paid. Health Department The applicant indicated that restrooms are available in the clubhouse which is located in the same block of units. The applicant stated that there are no floor drains in the unit. No waste is generate onsite. Public Works There is existing curb and gutter requirements, according to the Regional Urbanization Area(RUA) standards. The existing access, drainage and parking are adequate. /gm") Planning Department Because Garagetown falls under SPR-387,the entire site will be under review and an amendment to the permit will be required. A letter of support will need to be provided by the HOA. Staff encouraged the applicant to visit with the HOA Board regarding the requirements. The application fee is$650. In addition, because the unit is in violation an investigation fee of$325 will be added to the application fee bringing the total to $975. A complete application must be submitted or the business removed from the property by May 2, 2011 to avoid violation hearings. Staff urged the applicant to contact staff for any questions: Planner On Call available Monday through Friday 7:30 a.m. to 4:30 p.m. Staff explained the SPR process. For the applicant to proceed with the SPR application, the applicant shall submit 4 packets for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. A SPR application does not include any public hearings; the application is reviewed by staff and referral entities. The applicant will meet with their Planner to discuss the referrals and address as many of the referrals as possible. Attachments: weld county.pdf I have been told that the area between longmont and 1-25 (The actual address is 3656 Stagecoach Rd. Unit 109-B. Longmont, CO 80504) was NOT zoning for commercial or business related operations. If so Summit Interlock is working out of a bay in "Garage Town". Unit 109B. Which is on the northeast side of the property almost exactly across from the grease monkey branch office. I have added a goggle map of the exact location. The��' ,nerally open on Tuesdays and Thursdays. And Thursdays will be the best time. I would have to say th will be a good time to catch them. They install vehicle interlocks into cars. where requires dismantling vehic a as es and other areas, which could be very hazardous for people in the bay with only one door. I think they have a"doorway" between them , but its covered by steel plates and the such. not a quick way to get out.. every so many days more people come into get work day or stuff downloaded. the numbering system of the garage town is very strange what you think will be unit 109, looks like it should be on the other side of the building. But it's actually facing east towards the grease money office.
