Item 1 — The Division is requesting that the applicant establish a "Trigger Point" at which mitigation or the evaluation of mitigation will occur. As written, the Division's proposed criterion is not only impossible to comply with but also reflects its failure to recognize the basic fundamentals of groundwater hydraulics and totally ignores the purpose and content of the dewatering evaluation. The drawdown associated with such operations is not fixed in time or space and trying to impose a single limit is not appropriate or achievable as the drawdown will vary greatly across the site and exceed the Division's recommended criteria in close proximity to the mine face. Natural groundwater levels cannot be practically maintained in close proximity to mining operations. Obviously,Varra Companies does not have concerns regarding drawdown beneath its property. We propose that sentinel wells be established as close as possible to its property boundaries and the trigger point be used at these points. However,the Division should acknowledge that during mining of the southern tracts, and possibly other areas, that water levels will fall below the recommended trigger level. Both the Division and applicant should recognize that mitigation may or may not be required even if the proposed trigger level is exceeded or not. Varra also contends that its operations considers and maintains the hydrologic balance as required by the Water Resources Division. Item 2—The wells that are appropriate for Trigger Point monitoring are monitoring wells 1,2, 11 and proposed VCI wells 12 and 13. Well locations are presented on Exhibit C-1. Item 3 —We concur with the three month criteria. As significant water level changes can take months to occur we do not feel more frequent monitoring is warranted; however, we propose that off-site wells in areas of concern may be added to the monitoring program if access can be obtained.Areal extent, not frequency should be the issue of concern. Item 4 —When the trigger point is met Varra will increase its assessment of surrounding land use. It will obtain opinions from a qualified hydrogeologist as to possible impacts to surrounding P.O. Varra will attempt to obtain access to monitor off-site wells in areas of concern. If a complaint is received an assessment will be made as to the cause of the injury, if any. If any adverse impacts are the result of mining operations,Varra will implement the most appropriate remedy,which may include items a through d of this section. In all situations,the Division will be contacted prior to implementing any corrective measures. Item 5 — Varra Companies will continue to monitor water levels on a monthly basis and will Include these data in its annual report. Item 6 — Varra will commit to installing two additional monitoring wells at the locations presented on Figure 1. However, it should be noted that these wells will have little use other than verifying model results once mining approaches the southern mine face as water levels will be well below the Division's trigger point criteria. Item 1—It is our understanding that mining will not exceeded 45 feet in the northern tracts due to engineering issues and less valuable aggregate. Item 2(a) — The last sample obtained from boring 2 was in the transition zone between unconsolidated deposits and the Pierre shale. After conversations with Terracon, the geotechnical contractor, the upper portion of the last sample was used for the grain sized analysis and the lower portion was used for strength testing.The lower portion apparently had a much higher clay/weathered shale content. We used the values reported by Terracon which are reasonable for weathered shale. Item 2(b) —The values used were either reported by Terracon or in the absence of measured values we used table values provided by your agency. For the second soil layer varied across the site from silty sandy gravel to lean clay.To be conservative in our analysis lean clay strength and weight values were used.The table provided by the Division is presented as Attachment A. Item 2(b) — The model can run multiple simulations and then compares the results only reporting the most conservative result. One method can also be selected and I have provided the Spencer method output for an example (Attachment B). As can be seen the Safety Factor is less conservative than the Bishop method. Item 3—As we modified a previous report the reference was inadvertently left in. Item 4—We have labled the three Plates for reference and have provided color reproductions in Attachment C. Item 4(a)—The soils were not named in the original simulations.The model attempted to input names based on available data. We generated a color soil profile with an appropriate legend, which is provided as Attachment D. P.O. From personal observations at other operational mines groundwater will daylight on the mine wall up from the toe of the excavation. The water table was drawn to simulate this condition and there is some artistic interpretation based on my 24 years as a practicing professional. However, simulating the water table near the exposed mine wall,weather accurate or not,will provide the most conservative analysis. Item 4(c) — The geotechnical report provided a range of values for the gravel deposits. The difference between the two simulations is that friction angles (4)) of 40 and 45 degrees were used for the poorly graded gravel as a sensitivity analysis. Item 5—Please refer to Item 2.
