Just wanted to touch base with you regarding Lucky Stars Car Wash. Back in March, we corresponded about Lucky Stars Car Wash because I had received a letter from the bank stating the Letter of Credit will expire on May 24, 2011, and they requested the original Letter of Credit be returned to them as of that date. I haven't heard anymore about them since we corresponded in March. Is their collateral ready to be released, or do they need to get a replacement? Probably not a good way to start off a Monday morning©, but thought I better ask about it since May 24th is tomorrow. As you can see from the emails below, with the consent of Weld County we reduced the amount of the collateral last May because most of the improvements had been completed. At that time, the only landscaping that we were lacking was the hydroseeding of the western portion of our property which was done late last spring/early summer. We are now requesting that this agreement be finalized and that the collateral be released entirely as all improvements have been completed. Because we are required to give notice to cancel the Letter of Credit through our bank, we would like to know what we need to do to satisfy Weld County that the improvements have in fact been completed and allow for this requirement to be removed. We would be more than happy to send pictures of the property showing that the improvements are complete, if needed. We spoke with Chris Gathman this afternoon and he suggested that we contact you regarding an Improvements Agreement that we have between Weld County and Paul Gonzales Jr. /Lucky Stars Car Wash, LLC. (It may also be known as the Trigger Time Gun Club project.) The Letter of Credit for this Agreement expired on April 17th and we have been working with our bank, AmFirst Bank, to renew it. We are hereby requesting partial release of this Letter of Credit due to the fact that most of the improvements have been completed. Exhibit A attached to our agreement specifically breaks down the estimated costs for the improvements and the total amount is $68,844.65. Of this amount, all improvements have been completed except for hydroseeding the area on the west side of the property which we anticipate to be complete by the end of May. We are requesting that the renewed Letter of Credit amount be reduced from $68,844.65 to $11,000 which is about half of the total landscaping costs. We would be happy to send photographs of our property, if that would be helpful in making the determination to reduce this amount. 4 Please let us know what we need to do so that we can finalize this portion of the paperwork with our bank, as soon as possible.
