COLORADO
The Weld County Public Works Department has reviewed this proposal. All issues of concern and critical
issues during further review must be resolved with the Public Works Department.
Access/Roadway:
The existing site accesses onto WCR 26 which is under the Town of Firestone's jurisdiction.
From the current information submitted, Public Works is unable to determine the potential construction
traffic impacts to County roadways and work with the applicant to mitigate those impacts. We request the
opportunity to review the construction schedule/plans and enter into an improvements agreement with the
applicant to define haul routes and ensure maintenance of those haul routes.
Flood Hazard Development Standards:
The most current floodplain mapping shows the treatment plant facilities as being at least partially in the
floodplain. Any construction in the floodplain will need an amended Flood Hazard Development Permit.

Environmental Health Services has reviewed this proposal for an expansion to the St.
Vrain Sanitation 208 boundary and to expand the existing treatment facility.
The North Front Range Water Quality Planning Association approved the site
application for the expanded treatment facility on August 26, 2010. Weld County
Environmental Health approved the expansion on August 17, 2010.
We have no objections to this request.

I have reviewed the submitted material pertaining to the First Amendment to the Saint Vrain
Sanitation District Service Plan and expansion, located at 6101 Weld County Road 26 in Weld
County (Case Number 2010-XX). The Fire District does not object to the change in boundaries
• and the expansion of the water treatment plant provided that subsequent construction meets the
requirements of the Fire District. All applicable codes as they pertain to water supply, fire
hydrant locations,fire department access,and building construction must be met.
Building construction plans and a final site plan must be submitted to the Fire District for review
and approval prior to the issuance of any building permits.

Dear Mr. Ogle:
The North Front Range Water Quality Association has received a referral notice from
your office regarding a change to the service plan for the St. Vrain Sanitation District.
This change includes an expansion of the service area for the District. The maps included
with the information show the existing 208 service area for the District as well as the
proposed boundary change. The existing 208 service area for the District has been
approved by the Association and was included as part of the District's approved Utility
Plan and the 2007 Update to the Areawide Water Quality Management Plan (the 208
Plan).
• I have discussed the proposed boundary changes with the District. It is my understanding
that once the service plan revisions are complete the District will be preparing an update
to their approved Utility Plan for submission to the Association for review and
consideration in accordance with Association policies. This update will request that the
208 service area be expanded to reflect the proposed boundary change included with the
service plan updates. The update will also provide the necessary planning information to
demonstrate the ability to provide service to this area in the future. Once this update to
the Utility Plan has been reviewed and approved by the Association, the District can then
request a formal 208 Plan Amendment to modify the 208 service area.

The Town of Erie (Town) has received a referral from the Weld County Department of
Planning Services in regards to the above captioned case.
For the record the Town is not in support of the proposed amendment at this time.
• Currently the Town is in discussion with St. Vrain Sanitation District(SVSD) about
potential service area conflicts between the Town and SVSD, these areas of potential
conflict are located within the Town's planning area(see attached).
The Town believes it is premature to amend the service area plan at this time and that it
would be more appropriate to resolve the service area issues between the Town and
SVSD prior to approval of any proposed amendments to the current SVSD Service Plan.
Resolving the current issues would facilitate the Town's ability to support an amendment
and necessitate only one amendment to the Service Plan.
Thank you for your consideration of the Town of Erie's concerns.

The Town of Erie appreciates the St. Vrairt Sanitations District's consideration of our
request to reorganize borders in our respective 20K Boundaries. We think this issue
merits further discussion and arc responding to the points that you addressed in our
letter of September 21. _2010.
• The Town of Erie's new North Water Reclamation Facility will be able to sere ice all of
our proposed 20K Boundary changes by gravity service and do not think that the I own's
request Ibr the proposed changes is premature.
The row is currently updating our Wastewater 1!tilit Plan and helices that this is the
appropriate time to address the current 20K Boundaries. The Wastewater t'tility Plan is
the long range planning document required hk the Colorado Department of Public I lealth
and Environment 1brr the 1o' ii of Erie. the North Front Ranee Water Oualit Planning
Association. and the Denker Regional Council of Governments.
Me areas of the proposed _20K Boundary changes are within the Town of Erie's
municipal boundaries and-or the Town's Planning Area Boundaries in addition to being
within the DRCOG 1;0-Ian Growth Boundary Area for Erie.
The Town of Eric kk ill he the land use management agency liar these areas. The land use
management agenc.k is ultimately responsible for eater quality issues within its border;.
Erie desires to keep control of water quality issues within the fotkn's boundaries to
ensure the water rights for reuse purposes and to standardize wastewater Ices Ibr all Erie
residents.

We have rep iewed the St. Vrain Wastewater Utility Plan and collection systems maps. It
appears that the (kidding Hullo" Interceptor is required by the deg clopments east of I-?5
rather than the areas in Erie. West of 1-?5 (iodding I lollow would need to be upsi/ed tur
these developers. The Sweetgrass Interceptor has not been built into the area where it
would cross 1-25 to serve properties west of 1-25. Again. the low n of I':rie's 1101 North
Water Reclamation facility will he able to service all of the proposed 208 Boundary
areas by gravity service.
Finally. we do not believe that the proposed changes in the 208 area will cause checker
boarding. Some areas not included in the requested adjustment are already annexed into
another municipality. We would not presume to change an area than is controlled by
another land use management agency. I lowever. the areas that we are asking to adjust
are or w ill he annexed into Eric and it is the right time to address the long range planning
for those areas to avoid future redundancy and sub-optimal use of utility resources by ail.
For these reasons. we would ask the St. \'rain Board to support the proposed change to
our 208 Boundary and thank you in ads ance for your consideration.

Dear Mike:
At the St. Vrain Sanitation District's Board of Directors' regular meeting on September
15.2010,the Board discussed and considered the request of the Town of Eire to agree to
a change in the District's 208 planning boundary for certain areas lying both north and
south of Highway 52 and West of 1-25. The Board took no action to accept the proposal
and instructed me to respond.111 First, the request is premature. The specified area has not been annexed into the Town of
Erie. Although it appears that the current landowners of the majority of the property
lying within the two areas are amenable to annexation and are in consultation with the
Town concerning potential development, until such time as the property is formally
annexed into the Town, development on such property could occur within the
unincorporated portion of Weld County. As this recent economic downturn has taught
us. development plans can change quickly based upon numerous factors.
Second,the District has invested in lines and capacity to serve such areas pursuant to its
long range planning. Before the District agrees to release these areas to the Town and
abandon its financial investment,the District must be assured that the developers have
been made aware of the economics of the choice between District 's service by gravity
and the Town's service by lift stations.
Finally. the issue of having this region "checker boarded" by two different service
providers appears to be contradictory to the intent of the applicable regulations and the
spirit of long range planning.

quo at this time.
