The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Weld County Road Classification Plan: WCR 64 & WCR 49 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The County also has 60 feet of unmaintained County right-of-way (30 feet either side) along WCR 62.5 • alignment. 1. Verify, show and label all existing right-of-way on the Plat. Access/Roadway: The applicant is utilizing an existing access from WCR 49. Proposed traffic includes one employee visiting the site each day and a tractor trailer every other day to haul produced water from the site. 2. Please show and label on the Site Plan, the proposed access width (minimum 20' for emergency vehicles) and the turning radiuses into the site (45'-60' radiuses required to accommodate trucks). 3. Tracking control is required to prevent tracking of mud and debris on to the County roadway. Please show and label a double cattle guard (2 cattle guards placed back to back to allow for a full rotation of truck tires) at the access. Place the cattle guards far enough back from the County roadway to allow a tractor trailer to completely pull off the main roadway before crossing the cattle guards. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way. A special transport permit will be required for any oversized or overweight vehicles that may access the site and may be obtained by contacting Amy as well. Site: 4. Please place the following note on the Plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist • on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. M.APLANNING—DEVELOPMENT REVIEW VUSR-Use by Special Review\USR-1793 DCP-Libsack\USR-1793.docx • Stormwater: The applicant submitted a "Drainage Report for Libsack Compressor Station" dated June 2011 and signed and stamped by Pat Brunette, P.E. with Enercon. A full detention design was completed for the site but the County has consistently only required water quality detention for sites such as compressor stations. Enercon has indicated that they will provide a revised design for water quality capture only. 5. Please provide a revised drainage design for water quality capture only. 6. The water quality calculation in the submitted drainage report uses an WQCV drain time of 12 hours, please revise this calculation to use a drain time of 40 hours (a=1). 7. The project will disturb over an acre of land therefore, a State approved Stormwater Management Plan will be required. Please provide a copy of Storm Water Management Plan application as submitted to the State. Please provide a copy of the approved permit once it has been obtained. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. 8. The project will disturb over an acre of land therefore, a Weld County Grading Permit is required before construction. 9. Please place the following notes on the Plat: a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, • diversions, concentration and/or unplanned ponding of storm run-off. b. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. c. This is an unmanned site however, an employee will stop at the facility on a daily basis and one semi will access the site every other day. Due to the limited access to the facility, this Department would support the addition of a septic system and potable water when a full time employee is stationed at the site. The application indicates a portable toilet and bottled water will be provided during and after construction. A dust abatement plan was submitted which stipulates the site will be stabilized using native vegetation, the access drive and interior fenced area will be graveled and a water • truck will be used if necessary. A waste handling plan was submitted which indicates a spill prevention, control and counter measure plan (SPCC) will be followed and all waste will be removed by a contracted facility. A copy of the SPCC plan and the name, address and phone number of the waste removal company is required. The applicant should utilize best management practices to reduce noise as applicable. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. • • 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A copy of the SPCC plan. 2) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls • fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. 7. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when there is at least one full time employee located on the facility. 9. An Individual Sewage Disposal System shall be provided when there is at least one full time employee stationed on site. • 2 • 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 12.The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. A building permit shall be obtained prior construction of any new structures. 2. A plan review is required for each building or structure for which a building permit is required. Two complete sets of plans are required when applying for each permit. Include a Code Analysis Data sheet provided by the Weld County Building Department with each Building Permits Submittal plans shall include a floor plan showing the specific uses of each area for the building. 3. Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code. Buildings, structures and use shall conform to the requirements of the various codes adopted at the time of acceptance of the permit application. Currently the following codes have been adopted by Weld County: 2006 IBC; IMC; IPC; IECC; 2008 National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of the Weld County Code. 4.
