RE: ACTION OF THE BOARD CONCERNING ZCV#1100083 AGAINST JOSE AND ROSA
MARIA MEZA FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jose and Rosa Maria Meza, ZCV#1100083, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of August, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jose and Rosa Maria Meza, property owners, were present, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 9, 2011, to allow adequate time for a physical
inspection of the property to be conducted by the Department of Planning Services to verify
there are no more than the allowed amount of animal units on the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1100083 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Jose and Rosa Maria Meza to remedy the violation of
the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until September 9, 2011, to allow
adequate time for a physical inspection of the property to be conducted by the Department of
Planning Services to verify there are no more than the allowed amount of animal units on the
property.

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews
are required prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public
Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in
the Greeley office. To be on the pre-submittal agenda, the request and required checklist items must

Evans horse owner charged with seven misdemeanors,
expected to reclaim horses

A man whose 13 horses were confiscated from his rural Evans property two weeks ago — many of them with ribs
showing and other ailments — was issued summonses Thursday, charging him with seven counts of misdemeanor
cruelty to animals.
However, the owner of the horses and the man who received the summonses, Jose Louis Meza-Franco, 33, may
pay a bond today and reclaim the horses.
According to Colorado law, Meza-Franco has the right to pay for the horses' feeding and care, and then take
them back to his property until the case is resolved, or other charges are filed.
According to Gary Schwartz, the head Animal Control Officer for Weld County, Meza-Franco told him Thursday
that he was planning to reclaim his horses today.
Although 13 horses were first removed from Meza-Franco's property southwest of Evans, only seven summonses
were issued.
According to Schwartz, a horse body-condition scoring system was used to rate the horses on their health
condition. The score usually rates 1 to 9 points, with 1 being the lowest. One of the horses had a 1 rating, and
others ranged at 3 or above.
"The DA's office said it would be difficult to prove the cruelty charges if the rating was 4 or 5," Schwartz said.
"And there were six horses that fell into that category. He wasn't charged in those cases."
Many of the horses had ribs showing and some had other ailments because of injuries or disease. Two of the
stallions were allegedly kept in an enclosed corral, 10-feet square, with no light. Officials said those horse were
left standing in their own urine and feces.
Meza-Franco has been arrested on animal cruelty charges before, according to sheriff's affidavits. They stated he
was once charged with cruelty to dogs, and a family member was charged with possessing roosters used in
cockfighting.
Officials said the horses' health has improved in the past two weeks while they were checked by veterinarians
and fed at an undisclosed location.
If Meza-Franco reclaims the horses, Animal Control officers will check periodically on their health conditions.
