RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL
REVIEW PERMIT #1438 - HCP VENTURES, LLLP, AND CAREERS WORLD WIDE,
C/O CHARLES TWEEDY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 8th day of November, 2010, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine whether or not HCP
Ventures, LLLP, c/o Careers World Wide, Attn: Charles Tweedy, 26216 County Road 18,
P.O. Box 587, Keenesburg, Colorado 80643-0587, was in compliance with certain terms and
conditions contained in the Road Maintenance and Improvements Agreement, approved
August 9, 2004, and recorded at Reception No. 3213141, dated August 27, 2004, for Use by
Special Review Permit #1438 for a Business permitted as a Use by Right or Accessory Use in
the Industrial Zone District (truck driving school) in the A (Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as
part of the NW1/4 of the NW1/4 of Section 28, Township 2 North, Range 64 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, at said hearing, after hearing testimony from the Departments of Public
Works and Planning Services, the Board determined that pursuant to the procedure as set forth
in Chapter 2 Administration, of the Weld County Code, there was sufficient probable cause to
schedule a Show Cause Hearing to consider whether or not said Use by Special Review Permit
should be revoked for failure to comply with certain terms and conditions contained in the Road
Maintenance and Improvements Agreement, approved August 9, 2004, and recorded at
Reception No. 3213141, dated August 27, 2004, thus violating the following Development
Standards:
31. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 23-3-250, Weld County Code.
34. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
WHEREAS, at said hearing of November 9, 2011, staff from the Department of Public
Works advised the Board that HCP Ventures, LLLP, c/o Careers World Wide, Attn: Charles
Tweedy, is now in compliance, and the Board deemed it advisable to dismiss said matter.

Background History:
The associated Probable Cause Hearing, which was held before the Board of County
Commissioners of Weld County on November 8, 2010, was initiated after several years of citizen
complaints were received by Weld County related to excessive dust, and the inconsistent
application of dust suppressant materials by Mr. Charles Tweedy on WCR's 18 and 53. Several
years of non-compliance occurred after repeated attempts to remind Mr. Tweedy, on a yearly
basis, of the obligations to apply dust suppressants to his associated haul route, as identified within
the Road Maintenance Agreement(Doc. # 2004-2342)that he signed and agreed to on 8/4/2004.
Recommendation:
Weld County Public Works Department and Planning Services staff members have monitored the
situation and performed site inspections, at the above mentioned site, since November of 2010.
During that time period no activities have been observed that would be non-compliant with the
obligations found within the previously mentioned Road Maintenance Agreement (Doc. # 2004-
2342).
The Departments of Public Works and Planning Services are recommending that further
proceedings regarding revocation of USR-1614, as described in the ACTION OF BOARD AT
PROBABLE CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT #1438
-HCP VENTURES, LLP, AND CAREERES WORLD WIDE, C/O CHARLES TWEEDY (Doc.
# 2010-2674) be dismissed.
Associated County Departments will continue to monitor activities related to USR-1438 in order
to insure compliance with previously discussed dust suppression measures.

Overview:
This Probable Cause Hearing was initiated after several years of citizen complaints having been
received by Weld County related to excessive dust, and the inconsistent application of dust
suppressant materials by Mr. Charles Tweedy on WCR's 18 and 53. Several years of non-
compliance have occurred after repeated attempts to remind Mr. Tweedy, on a yearly basis, of the
obligations to apply dust suppressants to his associated haul route, as identified within the Road
Maintenance Agreement(Doc. # 2004-2342) that he signed and agreed to on 8/4/2004.
The majority of the participants with Weld County Road Maintenance Agreements apply the
appropriate dust control measures without having to be notified. A first reminder letter of Road
Maintenance Obligations is sent to the participant only after Weld County has received citizen
complaints related to excessive dust being generated. A second notice letter of Non-Compliance is
then sent to the participant if subsequent complaints are received or if Weld County staff
determines non-compliance via site inspections.

Recommendation:
The Department of Public Works is recommending to the Board of County Commissioners to

Dear Mr. Tweedy:
This letter is regarding your Site Specific Development Plan and a Special Review Permit (USR-
1438)for a Business permitted as a Use by Right or Accessory Use in the Industrial Zone District in
the A (Agricultural) Zone District, specifically the operation of a truck driving school.
Notice is hereby given that on Monday, November 8, 2010, at 9:00 a.m., or as soon thereafter as
the agenda of the Board of County Commissioners permits,the Board of County Commissioners of
Weld County will hold a Probable Cause public hearing pursuant to Section 2-4-40 A-C and E of the
Weld County Code. This meetinlg will take place in the Commissioner's Hearing Room, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado.
On September 28, 2010 letters were sent by the Department of Planning Services advising
noncompliance with the Road Maintenance and Improvements Agreement, recorded at the Weld
County Clerk and Recorders on August 27, 2004, Reception #3213141 under item #3B states
"HCP/CWW shall apply dust suppression chemicals (magnesium chloride or calcium chloride) on
said roads as determined by the Public Works Department twice a year or as needed..."
Department of Public Works Staff have sent numerous letters (April 19, 2010, June 22, 2010 and
June 30, 2010) requesting compliance with the approved "Road Maintenance and Improvements
Agreement"approved by the Board of County Commissioners on April 21,2004;therefore,violating
the following Development Standards approved for USR-1438 and the Conditions of Approval which
were set in place as requirements prior to recording the plat for this Use by Special Review:

Development Standards:
31. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 23-2-250, Weld County Code,
34. The property owner or operator shall be responsible for complying with all of the
foregoing Development Standards. Noncompliance with any of the foregoing
Development Standards may be reason for revocation of the Permit by the Board of
County Commissioners.3.The facility will consist of a large steel structure and
principal dwelling. All appropriate building and zoning permits must be obtained prior
to construction. The property is located within the One-Hundred (100) Year
Floodplain, as indicated on FIRM panel map #080266-0960D.
The purpose of this public hearing will be to review the Development Standards as approved on
April 21, 2004 to determine if probable cause exists to schedule a Show Cause hearing. At the
Show Cause hearing the Board of County Commissioners will determine whether the property is
operated in accordance with the Conditions of Approval and Development Standards of USR-1438.
If not, the Board of County Commissioners may revoke USR-1438 for noncompliance.

Dear Mr. Tweedy:
In accordance with the Road Maintenance and Improvement Agreement for USR-1438 (Truck Driving
and Heavy Equipment School), the County has been contacted by the company that will apply dust
suppressant for the following areas: 26030 CR 18 300'E & CR 53 300' N; also 26173 CR 18, 300'
centered on mailbox. The Public Works Department will be grading the road before the application.
From March 1st to Novemberls`, Weld County will work to protect the dust suppressant material on your
road. During this time, you may observe some maintenance to the treated section to improve the road
surface. If the road surface becomes unacceptable anytime after its treatment, the area will be graded to
restore the road surface to an acceptable condition. The County will not be responsible for re-applying
dust suppressant chemicals.
The treatment will not be protected from November l51 to March 151. During this time, the road will be
graded to return the surface to its desired shape and if necessary, add gravel. This will help protect the
dust suppressant if it is re-applied the following season.
For your information a copy of the current Weld County Fugitive Dust Control Policy that regards private
dust suppressant application is enclosed. Visit the County website to see the entire policy. Please feel

Dear Mr. Tweedy:
Notice is hereby given that the property listed above, is not in compliance with USR-1438 (Special
Use Permit). All conditions of the original permit must be in compliance by October 12, 2010 or a
Probable Cause public hearing, pursuant Chapter 23, Article 11(2), Division 4, Section 23-2-270 of
the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled,the purpose of this public hearing will be to review case
number USR-1438, for compliance with the Development Standards, as approved by the Board of
County Commissioners on April 21, 2004,to determine if probable cause exists to hold a hearing on
revocation of the permits.
The Department of Public Works has sent correspondence requesting compliance with the
approved "Road Maintenance and Improvements Agreement" approved by the Board of County
Commissioners on April 21, 2004; therefore, violating the following Conditions of Approval and
Development Standards approved for USR-1438:
Conditions of Approval:
K. The applicant shall enter into a Private Improvements Agreement According to Policy
Regarding collateral for Improvements and post adequate collateral for all landscaping,
transportation (access drive, parking areas, etcetera) and non-transportation (plant materials,
fencing, screening, water, signage, etcetera) or provide evidence that the improvements have
been completed. The agreement and form shall be accepted by the Board of County
Commissioners prior to recording the Use by Special Review plat.

Subject: USR-1438, Part of the NW4 of Section 28, Township 2 North, Range 64 West of the
6th P.M., Weld County, Colorado
Dear Mr. Tweedy:
Notice is hereby given that the property listed above, is not in compliance with USR-1438 (Special
Use Permit). All conditions of the original permit must be in compliance by October 12, 2010 or a
Probable Cause public hearing, pursuant Chapter 23, Article 11(2), Division 4, Section 23-2-270 of
the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review case
number USR-1438, for compliance with the Development Standards, as approved by the Board of
County Commissioners on April 21, 2004, to determine if probable cause exists to hold a hearing on
revocation of the permits.
In the Road Maintenance and Improvements Agreement, recorded at the Weld County Clerk and
Recorders on August 27, 2004, Reception#3213141 under item#36 states"HCP/CWW shall apply
dust suppression chemicals (magnesium chloride or calcium chloride)on said roads as determined
by the Public Works Department twice a year or as needed..."
Department of Public Works Staff have sent numerous letters (April 19, 2010, June 22, 2010 and
June 30, 2010) requesting compliance with the approved "Road Maintenance and Improvements
Agreement" approved by the Board of County Commissioners on April 21, 2004;therefore, violating
the following Development Standards approved for USR-1438:
Development Standards:
31. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 23-2-250, Weld County Code.

34. The property owner or operator shall be responsible for complying with all of the
foregoing Development Standards. Noncompliance with any of the foregoing
Development Standards may be reason for revocation of the Permit by the Board of
County Commissioners.
If it is determined at the public hearing that there is probable cause that you are not in compliance
with USR-1438, the Board of County Commissioners will schedule a Show Cause public hearing to
consider revocation of the Use by Special Review permit.

Tweedy on 6/22/10 to again remind him of his obligations , as
part of the requirements for "Road Maintenance And Improvements
Agreement" - (Doc . # 2004-2342 ) . Mel Everhart/Weld County Motor
Grader Supervisor informed me today 8/19/10 , that no attempt has
been made so far by Mr . Tweedy to apply the dust suppression
chemicals as outlined in Document # 2004-2342 . Development
Standards # ' s 15 and 34 for USR-1438 are perhaps the standards
related to this non-compliance . Weld County Public Works
Department requests that proceedings be initiated to bring Mr .
Tweedy into compliance with the road maintenance requirements
found within Document # 2004-2342 .
This chronic non-compliance by Mr . Tweedy has been occurring for
the last several years and generally culminates with only one of
the two required dust applications being applied to the various
residences .

Dear Mr. Tweedy:
In accordance with the Road Maintenance and Improvement Agreement for USR-1438 (Truck Driving
and Heavy Equipment School), the County has been contacted by the company that will apply dust
suppressant for the following address: 26030 CR 18. The Public Works Department will be grading the
road before the application.
Weld County will work to assure that the dust suppressant material remains on your road as long as
possible. You may observe some minimum maintenance to the treated section after rain events to
improve the travel conditions. From March 1st to November1st, if the road becomes unacceptably rough
anytime after its treatment, the area will be graded. The County will not be responsible for reapplying
dust control chemicals.
The treatment will not be protected from November 1st to March 1st. During the winter months, the road
will be graded to return the surface to its desired shape and add gravel, if necessary. The road will be in
much better shape when the suppressant is applied again the following season.
For your information, I have enclosed a Weld County Fugitive Dust Control Policy. Please feel free to

I am writing this letter to tell you,that I am in compliance and I know that you're getting a lot of
complaints from Mr. Ries. I am inclosing a copy with the agreement made between Careers World Wide
Inc.and COUNTY OF WELD, STATE OF COLORADO ROAD MAINTENANCE AND
IMPROVEMENTS AGREEMENT.Which states that Careers World Wide Inc.shall apply dust
suppression chemicals approximately 300 ft.in front of the existing homes along WCR. 18 and WCR53.
Mr Ries's home address is listed on WCR. 18.As you know his house sits on the corner of WCR 18 and
WCR 53.I'm aware the Mr.Ries feels that I should apply dust suppression chemicals on both roads.I did
try to appease Mr.Ries by applying 150 ft.of dust suppression chemicals on both roads.Mr.Ries
apparently is very unhappy. Since there is no way to make Mr.Ries happy,next year I will apply the full 300
ft.on WCR 18 which is his mailing address and we will address this issue next year,I'm quite sure.If Mr.
Ries wants 300 ft. I suggest you give him ENVIROTCH SERVICE INC.phone number which is 303-477-
1919 and inform him,he can pay for it himself.I have addressed a letter to the Department of Planning
Services for your review.Upon your review you'll see that it is well documented that it is not my school
trucks creating all the dust.
The reason I am writing you this letter is because of a conversation I had with my neighbors.They said,
they called you with concerns of the dust from all the vehicles traveling up and down WCR 18.And you
replied to them,that it was due to the Truck Driving School.I want you to know that I don't appreciate this
comment.My trucks that use the haul route,WCR 18 and WCR 53 are not allowed to exceed 25 MPH.
With the cameras I'm installing it will show that my trucks produce minimal to no dust on the haul route. If

I'm writing this letter in reference to the letter I received dated July 9,2009.This letter basically states
that I am in violation of case number USR- 1438 for compliance with the Development Standards and
Conditions of approval, as approved by the board of County Commissioners.
Development Standard#7-
The training trucks are limited to four in and out trips per day.The County Roads that serve this facility are
County Road 18 and 53.One hundred percent of the truck traffic shall use this haul route.The trucks
leaving this facility shall turn left of County Road 18,travel approximately'A mile,turn left of County Road
53,proceed south under 1-76 to State Highway 6(Frontage Road)to the Kersey Road(County Road 49)to
1-76 access,and return to the training facility using the same route. Students and employees should also use
this route to minimize additional traffic in the area.
The complaint has been that the Department of Public Works has received information that the number
of truck trips(four in and out trips per day)has been exceeded.The property is not in compliance with the
following Development Standards.
We all know that this complaint stems from one person,Mr.Ries,who lives on the corner of County
Road 18 and County Road 53.For the record,my training program has been the same since April 21,2004
to date. My road training trucks leave my yard at approximately 7:30 A.M.and return approximately 12:00
P.M. (noon time)Once again,they leave the training yard approximately 12:30 P.M.Returning to the yard
approximately 5:00P.M.Monday through Friday.We do follow the proper route to I-76 to continue the
training.We are not coming and going all day long like Mr.Ries says.I have included pictures of road 18
in which all types of vehicles have been photographed.Cars,Trucks,Tractor-trailers,Farm Implement
Equipment,and Sheriffs Cars,there are many truck-driving schools that bring their trucks up and down road
18,that are not required to follow procedures under Development Standard 7.Mr.Ries must be mistaking
all of these other vehicles that use this road.Mr.Ries might want to invest in a pair of glasses.
I am installing security cameras on my property. These cameras will give me a video record of all
vehicles using WCR 18 every time a vehicle goes by,will be photographed with the date and time.This
will give us all a valid record that Mr.Ries is lying.
I am also including previous letters that I have received from the DEPARTMENT OF PLANNING
SERVICES. Which shows Mr.Ries files this complaint every year.The true reason for the complaint is,
Mr.Ries thinks I should apply dust suppression chemicals on all WCR 18 and WCR53 which my trucks
travel on. I am also including a copy of the agreement entered between,CAREERS WORLD WIDE INC.
and COUNTY OF WELD,STATE OF COLORADO ROAD MAINTENANCE AND IMROVEMENTS
AGREEMENT,which says,that I have to apply 300 hundred feet of dust suppression chemicals in front of
the existing homes along WCR.18 and WCR 53 on the haul route. It does not say,that I have to spray 300
feet on both sides of Mr.Ries's house.Mr Ries's home address is WCR. 18 and does not require me to put
any dust suppression chemicals on WCR.53.Mr Ries does not have a home address on WCR. 53. This can
be verified through your records.I will be happy to continue taking more pictures on a daily basis because
as you know digital equipment never runs out of film until my security cameras are install.

Permit). All conditions of the original permit must be in compliance by July 31, 2009 or a Probable Cause
public hearing, pursuant Chapter 23, Article 11 (2), Division 4, Section 23-2-270 of the Weld County Code,
will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review case
number USR-1438, for compliance with the Development Standards and Conditions of Approval, as

to hold a hearing on revocation of the permits.

Dear Mr. Tweedy:
In accordance with the Road Maintenance and Improvement Agreement for USR-1438 (Truck Driving and
Heavy Equipment School),Envirotech has requested dust suppressant for the following addresses: 26216 CR
18, 26030 CR 18, and 7700 CR 53.
The Public Works Department will work in conjunction with Envirotech to assure that the dust suppressant
material will remain on your road as long as possible.Before the company applies your chemical,the road will
be prepared by a grader operator. You may observe some minimum maintenance to the treated section after
rain events to improve the travel conditions. From March 1st to Novemberls`, if the road becomes
unacceptably rough anytime after its treatment, the area will be graded. The County will not be responsible
for reapplying dust control chemicals.
The treatment will not be protected from November 1st to March 1st. During the winter months,the road will
be graded to return the surface to its desired shape and add gravel, if necessary. The road will be in much
better shape when the suppressant is applied again the following season.

Attached please find the 2nd Notice letter sent to Charles Tweedy on 5/5/09 to again remind
him of his obligations, as part of the requirements for "Road Maintenance And Improvement:
Agreement"- (Doc.# 2004-2342). Mel Everhart/Weld County Motor Grader Supervisor
informed me today 5/19/09, that no attempt has been made so far by Mr. Tweedy to apply
the dust suppression chemicals as outlined in Document # 2004-2342. Development
Standards #'s 15 and 34 for USR-1438 are perhaps the standards related to this non-
compliance. Weld County Public Works Department requests that proceedings be initiated
to bring Mr. Tweedy into compliance with the road maintenance requirements found within
Document # 2004-2342.

It has come to the attention of the Department of Planning Services' staff that the uses on your property
may not be in compliance with the conditions of approval as stated in the resolution passed by the Board
of County Commissioners on April 21, 2004. The potential noncompliance with the resolution is the
following condition.
The Department of Planning Services has been informed that this number of truck traffic has increased
on site. The training trucks are limited to four in and out trips per day. The County Roads that serve this
facility are County Road 18 and 53. One hundred percent of the truck traffic shall use this haul route.
The trucks leaving this facility shall turn left of County Road 18, travel approximately % mile, turn left of
County Road 53, proceed south under 1-76 to State Highway 6 (Frontage Road) to the Kersey Road
(County Road 49) to 1-76 access, and return to the training facility using the same route. Students and
employees should also use this route to minimize additional traffic in the area. (Department of Public

It has also been brought to our attention that the hours of the operation have been extended. The hours
of operation shall be from 8:00am to 5:00pm Monday through Saturday, closed on Sunday and Holidays,

Dear Mr. Parko:
This is in response to a letter we received from you dated October 19, 2010. Concerning the
compliance of the above mentioned property.
My concerns are as follows:
1. The amount of trucks stored or used on the property greatly exceeds the amount that
was originally allowed by the commissioners. Also,the amount of trucks in and out of
site are out of compliance.
2. The amount of traffic in and out morning and night is at any given time between ten
(10)to twenty(20)personal vehicles.
3. Late October of 2010 is the first time since this USR was issued that adequate dust
control was applied on the corner of WCR 18 & WCR 53.
4. Since the USR for this property was issued the amount of truck traffic for other trucks
has increased dramatically. We understand the truck traffic will increase during harvest
but this has become a year round occurrence. The additional truck traffic has caused
additional road damage and additional problem with dust to WCR 18 and WCR 53. The
condition of these road can be a big hazzard at times.
5. There has been several incidences on these roads in the past. There has been no
fatalities to our knowledge, but there has been accidents caused by lack of visibility(due
to excessive dust),and poor road conditions.

6. We do not believe any of the enterstructer for this USR has been permitted or installed
to allow the operation of this school.
7. We understand the county has to send numerous letters to remind the user of his
obligations. We believe the dust control should include all properties on WCR 18 and
WCR 53. They have added 26177 WCR 18,which sets a precedence to include all other
properties,and it appears as though they have eliminated 7700 WCR 53 which was
included originally.
8. The county has reworked and applied dust control on WCR 18 east of WCR 49 to
WCR 51 and then from Market Street in Keenesburg west for about a quarter of a mile
past WCR 57. There are areas that are in a lot worse condition then these were. Where
do these vehicles go? The only exits to the south off road 18 is 49,53,and Market Street.
The county has elected to ignore the section of road from 51 to 57 for some reason.
We invite the commissioners to drive these roads themselves and make a decision as to whether
they are safe in comparison to other roads in weld county. We are long time residents of the area
and understand what it means to live in a rural environment,but this is definitely not normal.
The roads have been greatly improved through the years,but are not up to standards concerning
the changes in speed and quantity and type of traffic that travels them now.
