By letter dated May 19, 2011, Al notified the Colorado Department of Public Health and Environment(the"CDPHE")that Al required its original closure date of the Facility be extended to August 22,2011. By letter dated July 1,2011, the CDPHE conditionally approved Al's request to extend the Facility's closure date conditioned upon Al providing the CDPHE with certain information and details related to the closure of the Facility. Al submitted the requested information to the CDPHE on July 15, 2011. Al has made substantial progress to prepare the Facility for closure. All materials,fences,etc. will be off the site no later than September 1, 2011. However, due to several events and circumstances outside the control of Al, a complete closure of the Facility by August 22, 2011 is no longer feasible. Accordingly, pursuant to 6 CCR 1007-2, section 14.8.2,Al respectfully requests that the closure date for the Facility be extended to October 31,2011. Al has spoken with Mr.Trevor Jiricek, regarding extension of the Facility closure date. It was my understanding from that conversation that Mr. Sekich was pleased with Al's efforts to date and had no objection to extending the final closure date. As detailed in the attached Interim Update, Al submitted its Soil Sampling Plan ("Soil Plan")to the CDPHE and County on June 3, 2011. Al had estimated it would be able to achieve closure of the Facility by August 22, provided Al received an approved Soil Plan in place by June 30. The Soil Plan, however, was approved by the CDPHE and County on July 14,2011. Once approval of the Soil Plan was received, Al promptly proceeded to conduct the soil sampling authorized in the Plan. All soil sampling at the Facility was completed on July 27. Al is awaiting the laboratory results of the soil sampling, which are expected to be received on August 15. Until those results are received and evaluated,Al is unable to prepare a proposed final site grading and seeding plan for the Facility. Further, should the laboratory results indicate that remediation activities at the Facility more extensive than those currently anticipated are required, Al will require sufficient time to incorporate these changed circumstances into the final site grading and seeding plan. Al anticipates that once the laboratory results are received, at least two weeks will be needed for Al to evaluate the test results, and to prepare the proposed final site grading and seeding plan for submission to the CDPHE and the County. Not until approval of the final site grading and seeding plan is received by the CDPHE and the County will any grading or seeding at the Facility begin. Realizing that the CDPHE and County have very busy schedules and other pressing matters, Al proposes the Facility closure date be extended to October 31, 2011 to allow sufficient time for the CDPHE • and the County to review and respond to Al's final site grading and seeding plan. Extending the closure date to October 31, 2011, also provides that Al will have time to make any changes or revisions to the final site grading and seeding plan that the CDPHE and County may have before the plan can be approved and implemented. Al will promptly proceed with implementing the final site grading and seeding plan once approval is received by the CDPHE and the County,and will endeavor to have the Facility closed prior to October 31, 2011 assuming the necessary approvals have been received. Please note, however,that the extension of the closure date to October 31 assumes that no additional remediation will be required based on soil sampling test results. With respect to the status of the composted overs piles and static processed pile, as Al detailed in its Interim Update all composted overs piles have been removed from the Facility and are at Al's Rattler Ridge facility. On July 26,2011,the County approved Al's proposed screening and containment process for the static processed pile. Until County approval of the screening and containment process was received,Al was not able to proceed with the processing and removal of the static processed pile from the Facility. Further,with the heavy,daily rains that occurred throughout July and August,a total of 19-days were lost that Al could have conducted production and hauling activities related to the Facility's closure. Despite these weather delays, Al anticipates the Facility will be completely cleared of all materials and ready for final grading and seeding by September 1, 2011. Accordingly, once approval of the final site grading and seeding plan is received, Al will be in the position to quickly proceed with implementing the plan and closing the Facility. Below is a summary of activities and efforts undertaken by A 1 to implement the Board's directions. 1. No other waste shall be brought into the Facility. No waste products have been brought into the Facility and no waste materials are being accepted at the Facility. • 2. A-1 shall meet with the neighbors and find a solution to mitigate the damage they have already caused. Al has met on several occasions with Facility neighbor Mr. Seckich to review and discuss concerns related to Al's operations at the Facility. Recently, Al and Mr. Sekich reached an agreement in which Al will purchase a portion of Mr. Sekich's alfalfa crop. Following conversations with Mr. Sekich, Al understands that Mr. Sekich appreciates the debris clean-up was accomplished to an acceptable level and that he does not anticipate problems with any future cuttings of his alfalfa crop. A l has continued to also meet with (and maintain un-going communications with) the Salazar family. Al's understanding is that it has addressed all concerns raised by the Salazars to their satisfaction. Al will continue to work with Mr. Pete Salazar regarding the details of the Facility's closure plan. 3. Al shall work with the County Departments of Planning Services and Public Health and Environment, as well as the Colorado Department of Public Health and Environment, to work out key dates in regard to the closure. On June 1, 2011, Al submitted to the Weld County Department of Health(County) and the Colorado Department of Public Health and Environment (CDPHE) its revised Facility Closure Plan. No comments to the Facility Closure Plan has been received from either the County or the • 01 114381.DOCJ • State. However, by letter dated July 1, 2011,the CDPHE stated that its determination of the completeness for the Plan will be sent by separate letter. A post closure Platteville Soil Sampling Plan (Soil Plan) was submitted to the County and CDPHE on June 3, 2011. Comments to the Soil Plan were received from CDPHE on July 6, 2011. On July 11 representatives of Al, the County and CDPHE met by phone to discuss the Soil Plan. Based upon the comments received from the CDPHE and the County to the Soil Plan, Al revised the Plan and submitted a revised Plan to the CDPHE and County on July II. Al received additional comments to the Soil Plan from Mr. Swain, an Environmental Health Specialist for the County, on July 14. By email received July 14, Mr. Roger Doak of the Solid Waste and Materials Management Program at the CDPHE, approved the revised Soil Plan, which included Mr. Swain's comments. In the CDPHE's email approving the Soil Plan it was noted that a CDPHE letter approving the Soil Plan will follow once a hard copy of the Plan, stamped by Al's engineers, is received. A l anticipates that the final, engineer stamped copy of the Plan will be sent to the CDPHE by July 22, 2011. During the course of the July 11 meeting Mr. Swain stated that the County will accept Al's Soil Plan once it has been approved by the CDPHE. Al understands that the County supports and approves of the Soil Plan as approved by the CDPHE. • The ability of Al to achieve a closure of the Facility by August 22 is contingent upon the timely approval of the Soil Plan by the CDPHE and the County. The Soil Plan was approved by the CDPHE six weeks after Al submitted it on June 3. Al had anticipated having an approved Soil Plan in place by mid to late June, which would have permitted Al to begin soil testing by the latter part of June. With approval of the Soil Plan Al can begin taking samples of the soils at the Facility. Once the soil samples are taken they then must be sent to a laboratory for testing. The laboratory takes two-weeks to analyze and return to Al the results of the soil testing. Once the soil test results are received and reviewed by Al,Al will transmit the results along with a recommended course of action of how to proceed with grading and seeding at the Facility to the CDPHE and the County. Before Al can proceed with grading and seeding at the Facility it must receive the CDPHE's and County's approval. It is anticipated that the entire process from soil sampling to CDPHE and County approval to proceed with grading and seeding at the Facility will take a minimum of six weeks. This six week timeframe assumes that the CDPHE's and County's sign-off on the soil sampling results and approval to proceed with grading and seeding at the Facility is received within two-weeks of Al's submission. It also assumes that there are no unforeseen delays by the laboratory in conducting its testing of the soil samples. However, further complicating efforts to proceed with the implementation of the Soil Plan are the recent, significant daily rains. Over the last 14 days significant rain events have occurred on a daily basis that will result in delaying implementation of the Soil Plan. While Al did factor in weather delays when selecting a closure date for the Facility,the past two weeks of constant heavy rains are unprecedented and could not have been predicted by Al. . 2 01 114781.DOC:7 • Accordingly, Al believes that it is unlikely that the soil testing results will be known and that approval from the CDPHE and County will be in place in time to allow Al to proceed with grading and seeding the Facility in time to meet the August 22, 2011 closure date. 4. Al shall submit a letter requesting formal vacation of the USR and CD upon closure of the Facility, no later than August 22, 2011. On June 1, 2011, A l submitted to the CDPHE, with a copy to the County, a request for extension of its closure date to August 22, 2011. By letter dated July 1, 2011,the CDPHE stated that it is conditionally approving Al's closure date of the Facility to August 22, 2011, subject to Al providing to the CDPHE by July 15, 2011 certain information regarding the processing and removal of organic materials from the Facility. A copy of Al's letter responding to the CDPHE's request for additional information is included with this Interim Update. Al also included in its June 1st letter the request that once Al's post closure evaluation is determined to be satisfactory that its USR and CD for the Facility be vacated. The CDPHE's regulations require Al to provide written notification to the CDPHE and the County documenting"that all requirements and conditions of the closure plan have been achieved" 30 • days after closure of the Facility. 6 CCR 1007-2, section 14.8.4. 5. Al shall demonstrate the effectiveness of the litter control fencing, described on page 4 of the Updated Plan, to County staff no later than May 25, 2011, assuming weather cooperates. Due to weather delays, equipment availability, and County staff work and vacation schedules, Al has not yet been able to schedule a demonstration of the enhanced control netting system to County staff. As the County has been previously advised, Al will process the static pile through a 2 inch trommel screen. It is expected that the trommel screen will capture 50% - 60% of the organic material in the static pile, with the remaining debris to be isolated and transported to a permitted landfill. The netting system will surround the trommel work area, thereby preventing the migration of plastics that could come off the conveyor as the trommel is operating. Al's trommel screen was recently moved from its Las Vegas location back to the Facility. During the transportation of the trommel screen from Nevada to Colorado it did incur some damage, which delayed its set-up at the Facility. The minor repairs and replacements to the trommel screen have been made and Al is conducting testing to determine the optimal configuration of the trommel and netting system at the Facility. Al has contacted Mr. Swain to coordinate a day and time that he is available after July 25 to come and observe the testing of the netting system. • 3 01 I I4381.DOC:7 • 6. The composted overs piles and collected surface layer pile shall be encased with tackifier instead of the clean wood materials. Al has transported all of the composted overs piles to Al's Rattler Ridge facility. Al is also tackifying such piles at Rattler Ridge. As the composted overs areas are cleared, Al scrapes the top level of soil to remove any debris that may be imbedded therein. The scrapings are then segregated in a pile, that is both tackified and compacted. To allow for additional scrapings to be added to the pile the top of the pile is compacted, thereby preventing the migration of any debris from the pile. The scraping of these areas is expected to be completed by July 22"a 7. A-1 shall continue to provide ongoing plastic clean-up and deploy one to two crews, consisting of approximately four(4)to twelve(12)people,daily to pick up debris from the neighbor's properties. A-1 continues to deploy debris picking crews to clean up any debris that may have left the Facility, as well as debris that is at the Facility. All plastics that are picked up off-site, and in the course of the on-site clean-up process, will be hauled to a permitted landfill. Due to the efforts of Al to maintain containment of a majority of the debris on-site at the Facility, migration • of debris to neighboring properties has been greatly reduced. When the picking crews are deployed, they are effective in removing debris from the neighboring properties quickly. The picking crews swept the Sekich's hay fields and surrounding area and remain on call to collect any plastics as needed. From conversations with Mr. Randy Sekich, A l understands that he was satisfied with the results of the focused picking efforts. 8. There will be no grinding or movement of the static pile without the approval from the County for a test, and to the best extent possible,keep the plastic debris from being liberated from the site. No movement of the static pile has occurred. Al is working to schedule a demonstration to the County of the process it has designed to address the static pile, which would not include grinding the pile. Swain, Waste Program T Coordinator,EH Division-Department of Public Health and Environment DATE: April 13, 2011 SUBJECT: Actions Requested of Board for requested Show Cause Hearing for Lambland,Inc dba A-1 Organics Platteville Facility Cease acceptance of any and all feedstock from Arvada Treatment Center. The facility has shown an inability to control migration of plastic litter off-site, therefore the Department is requesting the following actions be taken by A-1 Organics and that a Show Cause hearing be scheduled • before the Weld County Board of County Commissioners: Immediately retrieve any and all litter released by the facility off-site. Cease processing (grinding) of covered food waste piles. Food waste stockpile: All unprocessed food waste be removed and disposed of at a sanitary landfill by May 6, 2011. The Weld County Department of Public Health and Environment's Environmental Health Division will request a nuisance control plan to be submitted for approval and implemented by A-1 Organics to control potential nuisance conditions from the piles of covered food waste until it is removed and disposed of at a sanitary landfill. The Department will conduct ongoing inspections of the property to determine if A-I Organics is removing the material and preventing nuisance conditions during the removal. If A-1 Organics fails to remove the material and control and/or prevent nuisance conditions the Department will seek an order that the nuisance condition on the property be abated within 24 hours, and if abatement is not completed within said 24 hours, ordering that the Department arrange for the abatement of said nuisance and assess the cost of said abatement against A-I Organics. Kuenning and Wilson: This Compliance Advisory provides notice related to information gained during an inspection conducted by the Colorado Department of Public Health and Environment, Hazardous Materials and Waste Management Division(the"Department")on March 9, 2011. This inspection was conducted jointly with officials from Weld County. The purpose of the inspection was to determine the facility's compliance status with respect to the Solid Wastes Disposal Sites and Facilities Act," Title 30,Article 20, Part 1 as amended(the Act)and the Regulations Pertaining to Solid Waste Sites and Facilities(6 CCR 1007-2,Part 1; the Regulations)developed for the implementation of the Act and the approved Engineering Design and Operations Plan (EDOP). The Department will take into consideration your response to the requested actions listed below for each cited deficiency in its consideration of enforcement options. Deficiency#1: Control of Plastic Litter: The offsite litter appeared to be sourced from the facility and constitutes a nuisance condition that is in violation of Section 2.1.3, 2.1.11 and 14.3.3(D)of the Regulations. Failure to control litter onsite led to an inability to control migration of litter off the site. Failure to exclude non-compostable plastic entering the site commingled with the raw feedstock makes it very difficult for the site to control litter at the future points in the material handling or composting process. Requested Action#1: The Department requests that all offsite litter be cleaned up within fourteen(14) calendar days of your receipt of this letter, and that all onsite litter be cleaned up within twenty one (21) calendar days of your receipt of this letter. Documentation of the deficiency having been corrected should be provided to the Department in the form of photographs and a description of corrective action performed no later than twenty eight(28)calendar days from your receipt of this letter. Requested Action#1 a: The facility should develop a plan for managing the plastic laden food waste, in- process and overs material onsite in such a manner as to prevent the offsite migration of litter,and for managing the unapproved wastes in such a manner that ensures their exclusion from any compost process. The plan should be submitted for review by the Department and Weld County within fourteen • (14)calendar days of your receipt of this letter. Deficiency#2: Food waste received at the composting site as long ago as 2009 remains on the site without having been introduced into the compost process. This is in violation of Sections 1.3.9 and 14.3.3 of the Regulations, for failure to follow approved operating procedures. Requested Action#2: Any stockpiled food waste not yet placed into windrows stands little chance of being rendered into product by the June 1,2011 closure date. Therefore,the Department requests: • A written estimate by April 15, 2011 of the amount of unprocessed food waste currently onsite • That the unprocessed food waste currently onsite be disposed of at an offsite permitted solid waste disposal site and facility no later than May 15,2011 • Disposal receipts with associated volumes that can be reconciled with the volume estimate in the first bullet be provided to the Division by May 23, 2011. Deficiency#3: The facility failed to maintain records on site and failed to provide records requested during the inspection within a reasonable time frame following the inspection. Such records include liquid waste profiles for the preceding twelve months,and current volumes of Overs,Unprocessed Food Waste and In-process Materials. This is in violation of Section 14.7.2 of the Regulations. Public Health&Environment Kim Ogle, Weld County Planning Department Inspection: Unannounced Facility Representatives: Greg Kuenning, Al Compliance Manager Pete Salazar,Jr.,Property Owner On March 9,2011,Jerry Henderson and Troy Swain,representatives of the Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment • (Division)and the Weld County Department of Public Health and Environment(WCDPHE), respectively,conducted an unannounced inspection of the Highway 66/Platteville Compost Facility located in Weld County,Colorado.The purpose of the inspection was to investigate a complaint and determine compliance of the facility with the requirements set forth in the Solid Wastes Disposal Sites and Facilities Act,CRS 30-20-100 et seq.,with the Regulations Pertaining to Solid Waste Sites and Facilities,6 CCR 1007-2("the Regulations")and the approved Engineering Design and Operations Plan. —Background— The WCDPHE received multiple complaints of windblown plastic litter escaping the composting facility via windblown transport. WCDPHE requested the assistance of the Division in investigating the complaints. —Site Inspection— Mr. Pete Salazar owns the property,a central portion of which is leased to Al Organics for use as a composting site. Mr. Salazar initially met the inspectors and granted permission to access the offsite areas that he owns adjacent to the parcel that is leased to Al Organics as a composting facility. He accompanied the inspectors for the duration of the inspection. Mr.Greg Kuenning of Al Organics,contacted by cell phone on the morning of the inspection,met the inspectors at the composting site and granted access permission to conduct the inspection of the composting site. Food Waste Storage: A large stockpile of organic material was observed just west of where the entrance road enters the southern boundary of the composting site. The stockpile extended in a north-south direction for a distance estimated at 750 feet and in an east-west direction for 200 feet • • at its widest point,with most portions being narrower in that direction. The pile was estimated between 10 and 12 feet high at most locations. There was some odor associated with the pile; both the odor and the appearance of the pile with identifiable pieces of black plastic used for yard waste bags(not biodegradable),food waste plastic bags(the plastic being transported offsite)and other debris embedded in the organic matter, suggested this was not finished compost. Mr. Kuenning identified it as a primarily food waste stockpile representing roughly 20,000 to 25,000 cubic yards of raw material yet to be composted and portions of which had been on the site without being placed into windrows since 2009,according to Mr.Kuenning. The approved design and operations plan states that all feedstock received at the facility will be initiated into the composting process within 72 hours of receipt. Mr. Kuenning stated that the site has an anticipated closure date of June 1,2011, and that the plan is to incorporate all of the food waste into windrows and complete the 60-day composting process by that date. That means all food waste would have to be incorporated into windrows by April 1,2011 or thereabouts in order to meet the closure date. Any food waste not able to be processed into windrows by then would have to be disposed of offsite. The food waste stockpile also contained large amounts of plastic similar to the type of plastic observed in offsite areas on the approach to the site. See Photos 2,3 and 4. The pile had been partially covered with overs screened from finished compost. Loads of construction debris containing painted wood were observed on the top surface of the food waste stockpile. See Photos 5, 6, 7 and 8. A small amount of furniture pieces were observed in the food waste stockpile. See Photos 8,and 9. Neither furniture nor painted wood are an approved feedstock or raw bulking material. Overs Pile: The oven pile located east of where the entrance road enters the site contains the • same type of white and green plastic that is located off of the site. See Photos 10 and 11. Mr. Kuenning stated that the oven piles would likely have to be disposed of at a landfill. Facility Fenceline: The south perimeter fence east of the entrance road had a large accumulation of plastic on it. See Photo 12. Offsite Area: The offsite area to the south of the composting facility and east of the entrance road had a large amount of plastic litter scattered in the field. The plastic offsite appeared to be the same material as what was found onsite. See Photos 13 and 14. Litter pickers hired by Al Organics were in the offsite areas east of the site picking up this litter,their presence effectively acknowledging that the litter in the offsite field was the responsibility of Al Organics. Indeed, there was no other plausible source for the litter than the composting facility. —Records— Material Volume: Because the records are housed offsite,Inspector Henderson requested the following volume records be provided by facsimile or electronic mail within a few business days inspection: • Volume of food waste feedstock onsite and not yet introduced into the compost process • Volume of in-process material • Volume of bulking material • Volume of overs • • Liquid Waste: Inspector Henderson requested the waste profiles including analytical testing and hazardous waste determination made by generators on incoming liquid waste streams to the composting facility in the last year. —Findings-- The facility was found not to be in compliance with the Regulations nor the approved plan on the date of the inspection,with specific deficiencies noted as follows. 1. Control of Plastic Litter: The offsite litter appeared to be sourced from the facility and constitutes a nuisance condition that is in violation of Section 2.1.3,2.1.11 and 14.3.3(D) of the Regulations. Failure to control litter onsite is leading to an inability to control migration of litter off the site. Section 2.1.13 of the approved operating plan,and the odor plan,state that the all materials received at the site will be incorporated into windrows as soon as possible, or processed and shipped to other locations. Failure to follow the approved plans is a violation of Section 1.3.9 and 14.3.3 of the Regulations. 3. Records: Portions of the operating record having to do with waste characterization and material volumes were not made available to the inspector within a reasonable time frame • as required by 14.7.2 of the Regulations. This meeting will take place in the Commissioner's Hearing Room, Weld County Centennial Center, 915 1(P Street, Greeley, Colorado. The purpose of this public hearing will be to review case number USR-1059 for compliance with the Development Standards as approved by the Board of County Commissioners on September 20, 1995 to determine if probable cause exists to hold a hearing of revocation of USR-1059. Notice is hereby given that the property listed above, is not in compliance with USR-1059 (Special Use Permit 1059), A-1 Organics, Platteville facility. Representatives of this office have determined that you are not in compliance with the following Development Standards and CD Conditions: Development Standard No. 3 which states: The Weld County Health Department and the Weld County Planning Department shall be notified in writing of any new materials (other than manure/bedding) proposed for composting. Written approval to proceed with composting shall be obtained from the Weld County Health Department prior to receipt of the new material. Submittal information shall include operational procedures and storage procedures. All materials considered for composting shall meet current and future regulatory requirements for that specific material. No dead animals shall be composted on site. • A-1 Organics has accepted unapproved liquid wastes from the Arvada Treatment Center, in • violation of Development Standard No. 3. Development Standard No. 5 which states: No stockpiling of raw material such as manure/bedding, food wastes, biosolids, or any other approved putrescible material shall be allowed on site. All raw uncomposted material shall be placed in windrows or other processing unit within 72 hours upon receipt at the facility. This shall not include bulking agents such as wood chips, grass clippings, etc., and liquid biosolids stored within approved containers; and, Development Standard No. 13 which states: Any solid waste as defined in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed of at an approved sanitary landfill. A-1 Organics failed to adequately screen food waste feedstock to exclude non-compostable material, which when ground results in the plastic debris referenced below. Food waste contaminated with plastic bags, plastic food containers and other non-compostable debris was found covered with wood waste and according to Mr. Greg Kuenning of A-1 Organics was left covered and unprocessed at the site since 2009. Development Standard No. 9 which states: that waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. Litter conditions on-site, at the site boundary, and off-site also are in violation of Section 2.1.3 of the Regulations Pertaining to Solid Waste Sites and Facilities (6 CCR 1007-2, Part 1), which states, in part, that nuisance conditions shall not exist at or beyond the site boundary, and Section 2.1.11 states that sites shall have a minimum of windblown debris. In • addition, the Composting Section, Section 14.3.3 (D) of this same regulation requires that composting facilities control on-site and prevent off-site nuisance conditions. Development Standard No. 19 which states: that the facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) the facility shall also comply with any composting regulations promulgated pursuant to the Solid Waste Act, Section 30, Article 20, Part 1 C.R.S. Plastic litter covers the site, border fence, and is partially imbedded in process windrows and overs stockpiles. Windblown plastic litter has continued to impact the adjacent properties in addition to the public right-of-way along County Road 17 and property west of County Road 17. Development standard No. 13 which states: Any solid waste as defined in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed of at an approved sanitary landfill. Painted building materials and furniture were found in exposed wood waste feedstock in violation of this standard. It is discovered that A-1 Organics has been burying food waste under wood wastes at the facility in large piles. A-1 Organics representative admits food wastes have been there since 2009. March 15, 2011: Weld County Dept. of Planning and Environmental Health Services and A-1 Organics have teleconference to discuss what measures will be taken by A-1 Organics to retrieve windblown litter and to control plastic litter from overs piles, inprocess windrows,and facility grounds. A-1 submits timelines and proposes new equipment for use at the site. Also claims litter on-site is imbedded and will not leave site and that the piles of covered foodwastes are almost finished • inprocess windrows and they will test the material for sales. Department disagrees maintains that this material is not compost informs CDPHE-HMWMD that A-1 is referring to the buried foodwaste/trash found during the March 9, 2011 investigation as inprocess windrows. March 28,2011: Department receives a litter complaint. March 31, 2011: Department receives 2 litter complaints. The purpose of the inspection was to assess the facility's compliance with the development standards set forth in Use by Special Review Permit#1059(USR-1059). Based on the inspection,the following actions need to be taken by A-1 Organics: • A-I Organics failed to implement agreed upon litter control measures(see attached photos and attached letters from Mr.Todd Loose of A-I Organics,dated March 3 and April 14,2009)to control migration of litter off-site. Plastic litter covered the site, border fence,and was imbedded in the in process windrows(see attached photos). Section 2.1.3 of the Regulations Pertaining to Solid Waste Sites and Facilities 6 CCR 1007-2,Part I states,in part,that nuisance conditions shall not exist at cr beyond the site boundary,and Section 2.1.11 states that sites shall have a minimum of windblown debris. In addition,Section 14.3.3 (D)of this same regulation requires that composting facilities control on-site and prevent off-site nuisance conditions. The Department expects the agreed upon controls to be fully implemented at the Platteville facility,as stated in the Department's December 2,2010 e-mail(attached)and that A-I Organics conduct and document regular on-site and off-site inspections to identify and correct any litter problems. A-1 Organics accepted unapproved composting feedstock in violation of Development Standard 3 ofUSR-1059,which is a condition of the Certificate of Designation for this facility and requires that this Department and the Weld County Planning Department be notified in writing of any new materials(other than manure!bedding)proposed for composting and that written approval to proceed with composting such material be obtained from this Department prior to receipt. In addition,according to the Regulations Pertaining to Solid Waste Disposal Sites and Facilities(6 CCR 1007-2)as promulgated by the Solid Waste Disposal Sites and Facilities Act,Title 30,Article 20,Part 1,of the Colorado Revised Statutes,as amended,it is unlawful to dispose solid wastes on your property without a Certificate of Designation issued under the provisions of the Regulations. Based on materials received records provided for January 2010 through November 2010,a total of 314,100 gallons of liquid waste were accepted from the Arvada Treatment Center(see attached product sales by customer receipt records provided during inspection). The Arvada Treatment Center is a hazardous waste treatment,storage,and disposal facility,whose waste streams arc likely not appropriate for composting and are subject to review and approval by this Department and the Colorado Department of Public Health and Environment(CDPHE)prior to acceptance. Provide all available information on this load(s) to the Department including actual dates received,amounts.analytical and material source information Cease acceptance of any and all waste from this facility at your composting sites without the written approval of this Department and CDPHE A-I Organics Platteville Facility • Mr.Greg Kuenning January 6,2010 Page 2 Based on the Department's inspection,A-I Organics failed to screen feedstock carbon sources to exclude painted and finished materials. See attached photos of painted building materials and furniture found in imposed carbons feetWOek. This feedstock should not only be source separated but needs to be screened by A-1 Organics prior to acceptance ce processing. Failure to adequately screen feedstock has also contributed to the plastic windblown debris referenced above The facility is in closure, therefore,this matter can be best resolved at this facility by removing material unsuitable for composting and disposing of it as solid waste at an approved sanitary landfill per Development Standard 13 of USR•1059. Please be advised,failure to operate in compliance with all Development Standards of USR-1059 may result in a hearing before the Weld County Commissioners,where the Department can seer action up to and including the revocation of your Use by Special Review Permit and Catificate of Designation. Based on this Department's observations, the current degree of source separation is • inadequate for this foodwaste, due to the plastic shreds produced when the foodwaste (contaminated with plastic bags) is ground. The plastic shreds have proven difficult to manage. If this feedstock cannot be managed properly and in accordance with applicable requirements, the Department may not allow this material to be accepted (at any composting facilities using same processing and/or same type of sources for foodwaste), unless and until adequate controls are in place or the plastic material is separated from the foodwaste prior to grinding or an alternate foodwaste processing procedure is employed. The Department will prepare inspection letters for your facilities but wanted to inform you of actions, which need to he taken immediately (see attached letters). Also, the pallet wood waste piles at the Eaton Facility appear to exceed the feedstock & in process material limits but more importantly may be a fire hazard due to the amount of material, pile height, and inability to access with firefighting equipment.
