Weld County mined the Bearson Pit from 2002 to early 2006 for the purpose of providing sand and gravel for public works projects within the County. Currently, all that remains at the site are two unlined ponds, which require a long-term augmentation plan to replace depletions associated with evaporation from exposed surface water. Weld County owns 52 shares of stock in the Lupton Meadows Ditch Company (LMDC) that it plans to use as a source of replacement water. Weld County filed a Plan for Augmentation and a Change of Use of Water Rights on December 28, 2006 in Case No. 2006CW274 to change its LMDC shares from irrigation use to augmentation, storage, and recharge. Under CRS §37-92-308(4)(b), Weld County must demonstrate to the Water Court that the delay in obtaining a Water Court decree is justifiable and not being able to continue to operate under an SWSP until a decree is entered will cause undue hardship. As such, Weld County's counsel has filed a motion with the Court for approval. SITE LOCATION The Bearson Pit consists of two ponds located approximately 2.5 miles north from the City of Fort Lupton in the north '/ of Section 19, Township 2 North, Range 66 West, of the 6th P.M., in Weld County as shown in Figure 1. WATER USE Mining of the Bearson Pit was completed in early 2006 and all remaining operational depletions accrued in 2010. Current consumptive uses can be accounted for as free water evaporation from two unlined ponds. A September 2006 aerial photo was used to delineate the maximum water surface area exposed at the Bearson Pit, which was determined to be 8.4 acres as shown in Figure 2. The calculated annual gross evaporation for the Bearson Pit was calculated from data published by Farnsworth, et al. (1982) in NOAA Technical Report NWS 33 and calculated to be 44.1 inches per year. This annual depth was multiplied by the surface area to determine the volume of gross evaporation and redistributed monthly according to guidelines provided in SB 89-120. Effective precipitation was calculated as 70% of the total precipitation and was taken as a credit against the gross evaporation. Precipitation data from 1941 to 1985 was used and recorded to average 13.48 inches per year. The net evaporation was determined by subtracting the effective precipitation from the gross evaporation. The calculated net evaporation, or replacement obligation, is 24.27 acre-feet (2.89 acre-feet per acre) for 8.4 acres of pond surface as shown in Table 1. Mr. Jeff Deatherage Bearson Pit, 2012 SWSP Renewal Request September 29, 2011 Page 3of8 STREAM DEPLETIONS Evaporation from the Bearson Pit results in out-of-priority depletions from the South Platte River. In order to account for these depletions, we modeled the Bearson Pit as a hypothetical well located 387 feet from the South Platte River using Glover methodology in a computer aided model named the Alluvial Water Accounting System (AWAS) developed by the Integrated Decision Support Group (IDS). This distance represents the approximate shortest distance from down gradient edge of the north pond to the South Platte River, or Glover line "X." The distance "B" was measured from the same down gradient edge of the north pond to the approximate nearest edge of the alluvial extent as delineated by Hurr and Schneider (1972). Since the two ponds are adjacent to one another, we modeled the two ponds as one structure. Transmissivity was calculated as the harmonic average of data points along the Glover line "X. LMDC REPLACEMENT WATER As part of Case No.2006CW274, Weld County has proposed to use LMDC water to replace the evaporation losses from the Bearson Pit. Weld County has acquired 52 shares of LMDC stock that was originally used on two properties identified as the Koenig and Bearson parcels. The LMDC is a mutual ditch company that obtains its water supplies through its ownership in various other ditch companies. Depending on the physical location of the property, the LMDC delivers water through other ditch company structures. The parcels historically irrigated with Weld County's 52 LMDC shares were physically located under and delivered water through the Lupton Bottom Ditch. The headgate of the Lupton Bottom Ditch diverts from the west bank of the South Platte River in the NW'/ of the SW% of Section 19, Township 1 North, Range 66 West, of the 6th P.M. in Weld County. The Lupton Bottom Ditch system is managed jointly by the LMDC and Lupton Bottom Ditch Company (LBDC). The LMDC owns 43 out of 82.5 active LBDC shares, or approximately a 52.1 percent interest. We quantified the amount of LBDC water historically available to LMDC shareholders based upon diversion records maintained by the State and conversations with the Mr. Jeff Deatherage Bearson Pit, 2012 SWSP Renewal Request September 29, 2011 Page 4 of 8 District 2 Water Commissioner. The proportion of LMDC water to LBDC stockholders by priority is provided below. Historically there were 4,084 total shares in the LMDC with 3,473 shares in the LMDC service area that took delivery through the Lupton Bottom Ditch. Weld County's pro- rata portion of river headgate deliveries are shown in Table 3. Our study period was selected based on the availability of crop data from interviewing past owners and/or operators and obtaining signed affidavits associated with the shares acquired by Weld County. The study period contains a representative sample of average, wet and dry, warm and cool years. Irrigated Acreage In order to determine the historically irrigated acreage over the study period, aerial photographs were obtained from 1941, 1950, 1963, and 1977. The specific parcels were delineated in each of these aerial photographs to determine the amount of land irrigated by the shares. The delineated acreages were assumed to be constant between the photograph years. Weld County originally acquired the Koenig parcel with 86 LMDC shares. Subsequently, the land and 60 LMDC shares were transferred out of Weld County's ownership. Our historical use analysis evaluated the entire parcel with 86 shares, which we prorated to reflect Weld County's 26 shares. The weighted average irrigated acreage for the Koenig Parcel, based on the historical aerial photos, is 50.2 acres. Today, the entire parcel has been permanently removed from irrigation and is actively being mined for aggregate. Historically, the Bearson parcel was a small part of a much larger farm operation. Weld County obtained a lease to mine the parcel along with ownership of 26 LMDC shares. The historical use analysis was completed for these 26 shares on the parcel. The weighted-average irrigated acreage for the Bearson parcel, based on the historical aerial photos, is 24.7 acres. Today, the Bearson Pit is located on the Bearson parcel, which is permanently removed from irrigation. Mr. Jeff Deatherage Bearson Pit, 2012 SWSP Renewal Request September 29, 2011 Page 5 of 8 Water Budget Weld County's 52 LMDC shares were analyzed using a computer aided consumptive use model (CU) developed by the IDS. The analysis is based on information gathered to date from signed affidavits provided by historical owners/operators, daily recorded climate data, and published data on crop growth characteristics. Our water budget analysis considered recorded diversion records on a pro-rata basis, ditch loss, a maximum estimated farm efficiency, net irrigation requirement, soil moisture reservoir, and return flows associated with the LMDC water right. From our analysis, we determined that, on an annual basis, an average amount of approximately 102.54 acre- feet of water was historically delivered at the farm headgate from the subject 52 LMDC shares, as shown in Tables 4— 5. Of the total farm headgate deliveries, ➢ Crops historically consumed approximately 52.78 acre-feet of water annually (1.02 acre-feet per share), which represents the total consumptive use credit available to offset current and future water use at the Bearson Pit as shown in Tables 6 - 7. ➢ The remaining 49.76 acre-feet (0.96 acre-feet per share) returned to the South Platte River as either surface or subsurface flows as shown in Tables 8 — 9. The portion of return flows that returned to the river as surface and subsurface flows were determined according to the parcel's distance to the South Platte River. Soils in the area are permeable and topography is relatively flat. We assumed that 50 percent of the total return flows were returned as surface flows (Tables 10— 11) and 50 percent were subsurface flows (Tables 12 — 13). Accretions are the portion of water that historically accrued to the river and will be replaced as a result of the proposed LMDC change of use. Depletions are available as a consumptive use credit associated with the propose change of use. A monthly summary of each parcel during the study period, including the pro-rata river headgate diversions, farm headgate deliveries, consumptive use credit, return flows, and accretions/depletions are shown in Tables 18 - 19. REPLACEMENT Irrigation Season (April— September) Weld County's LMDC water will be used to make direct replacements throughout the irrigation season, April through September, when the LMDC is diverting. During the irrigation season, the District 2 Water Commissioner will make replacements through the Weld County Augmentation Station, approve the timing and location of these replacement sources, and maintain records of daily releases. The Weld County Augmentation Station is located on the Bearson Augmentation Reach in the south 1/2 of the NW% of Section 19, Township 2 North, Range 66 West, of the 6'" P.M. in Weld County. Figure 3 shows both the Bearson Augmentation Reach and Weld County Augmentation Structure. The outfall of the Bearson Augmentation Reach is immediately upstream of where the historical return flows impacted the river. Mr. Jeff Deatherage Bearson Pit, 2012 SWSP Renewal Request September 29, 2011 Page 7 of 8 Winter(October— March) A perpetual lease with the City of Greeley (Greeley) will be used to make winter replacements, October through March, which totals 8.37 acre-feet in 2012 as shown in Table 20. The lease schedule is updated annually and is sufficient to fully cover winter depletions. The 8.37 acre-feet is only part of an annual 300 acre-feet agreement that Weld County has with Greeley. As part of the lease agreement, Greeley will return reusable effluent to the river just below the outfall of its wastewater treatment plant located on the south bank of the Cache la Poudre River in the SW% of the SW% of Section 4, Township 5 North, Range 65 West, of the 6th P.M. in Weld County. Sufficient replacement of evaporative losses at the Bearson Pit can be made in 2012 with the consumptive use portion of Weld County's LMDC and with leased effluent credit (Table 20). WELL PERMIT Weld County currently operates the Bearson Pit under Well Permit No.63397-F, which was issued on October 5, 2005, for a maximum consumptive use of 38.3 acre-feet. Since the actual consumptive use is estimated to be 24.27 acre-feet, the existing permit should be sufficient and not require updating. NOTIFICATION Proper notification of this SWSP will be made to the objecting parties of Weld County's pending Water Court application. Proof of this notification will be submitted to the State Engineer's Office when completed. Weld County submits this Application for Change of Water Rights and Approval of Plan for Augmentation to provide for long term augmentation of post pumping depletions and tributary groundwater that evaporates from the surface of the Bearson Pit. Decreed Use: Irrigation. H. Historic Use: Applicant owns 52 shares of the 4,184 shares outstanding of the capital stock of the Lupton Meadows Ditch Company. The Lupton Meadows Ditch Company owns 43 shares of the 82.5 shares outstanding of the capital stock of the Lupton Bottom Ditch Company as well as shares in other ditch companies. Applicant purchased 26 of its 52 shares from Darrell and Nelva Bearson on November 9. 1998. These 26 shares were part of 412 shares delivered through the Lupton Bottom Ditch Company historically used to irrigate land known as the "Bearson Parcel" in the West '/z of Section 19 and the Northwest '/ of Section 30, Township 2 North, Range 66 West of the 6th P.M. and the Northeast '/. of Section 25 and the South 1/2 of the Northeast % of Section 24, Township 2 North, Range 67 West of the 6th P.M.. The historically irrigated acreage of the Bearson Parcel under the 412 shares of the Lupton Meadows Ditch Company is 388.4 acres, and the prorated historically irrigated acreage for Weld County's 26 shares is 24.5 acres. Applicant's other 26 shares were part of 86 shares delivered through the Lupton Bottom Ditch Company historically used to irrigate land known as the "Koenig Parcel" described as all that part of Lot 7 in the South '/z of the Southwest 1/, of Section 18, Township 2 North, Range 66 West of the 6th P.M. lying south and west of the South Platte River, Lots 7 and 8 in the South `/z of the Southeast '/ of Section 13, Township 2 North, Range 66 West of the 6th P.M., lying west of the South Platte River. and a strip of land being 50 feet wide on each side of the centerline of the Denver, Laramie, and Northwest Railway Company. The historically irrigated acreage of the Koenig Parcel under the 86 shares of the Lupton Meadows Ditch Company is 47.8 acres, and the prorated historically irrigated acreage for Weld County's 26 shares is 14.5 acres. The historically irrigated acreage from Weld County's 52 shares of Lupton Meadows Ditch Company is 39.0 acres and the historically irrigated acreage per share is 0.75 acre/share. Analysis of the Bearson Parcel and the Koenig Parcel historically irrigated with 498 shares of the Lupton Meadows Ditch Company delivered via shares in the Lupton Bottom Ditch Company yields a prorata consumptive use credit for the 52 shares of 51.16 acre-feet annually. This credit accrues monthly as accretions and depletions as shown in Table 3 below. 4. Consumptive Reuse Credits from the City of Greeley (1) Water Source: Applicant has a contractual right to water provided by the City of Greeley under the Perpetual Lease of Fully Consumable Water shown in Exhibit B attached hereto and incorporated herein. Under this agreement, Applicant has the right to "water rights that are owned by or available to Greeley, and that are fully decreed and usable for augmentation purposes under Colorado water law." Perpetual Lease of Fully Consumable Water, Exhibit B, paragraph 1.1. Additionally, Greeley must provide this water "regardless of whether a particular year is wet, 2006CW_ Weld County Page 6 average, or dry in terms of precipitation or water availability." Perpetual Lease of Fully Consumable Water, Exhibit B, paragraph 1.5. (2) Case No.: Greeley's water rights available to satisfy its contractual obligation under the Perpetual Lease of Fully Consumable Water include, but are not limited to, rights changed or to be changed in Case Nos. 87CW329, 95CW42, 99CW232, 99CW235 and 2006CW258, and water rights to be decreed in Case No. 99CW234. (3) Type of Water Right: Fully consumable water made available for augmentation use. (4) Location of Point of Diversion: The City of Greeley will provide water for augmentation just below the outfall of its wastewater treatment plant located on the south bank of the Cache la Poudre River in the SW 'A of the SW '/ of Section 4, Township 5 North, Range 65 West of the 6th PM. (5) Amount: Total amount leased is 300 acre-feet annually. (6) Historic Use: Under the Perpetual Lease of Fully Consumable Water shown in Exhibit B attached hereto and incorporated herein Greeley must supply the Applicant with water legally decreed for augmentation use. (7) Name and Address of Owners of Land on which Structure Is Located: The Greeley water treatment facility is owned by the City of Greeley. The city's address is c/o Director, Water and Sewer Department, City of Greeley, 1100 10th Street, 3r° floor, Greeley, CO 80631. 8. Statement of Plan for Augmentation: A. Applicant has mined aggregate materials from the Bearson Pit located west of the South Platte River in Section 19, Township 2 North, Range 66 West of the 6th P.M., about 2.5 miles north of the City of Fort Lupton. This mining operation has exposed groundwater tributary to the South Platte River. Applicant currently replaces post pumping depletions and depletions due to evaporation from this pit under SWSP No. M-99-00I, which expires on December 31, 2006. Applicant has applied to the State Engineer for approval of a renewal of the SWSP for the Bearson Pit. Through this Application, the Applicant will augment depletions to the South Platte River caused by past pumping operations and surface evaporation from the Bearson Pit in an amount, time and location sufficient to avoid injury to other water rights as required by C.R.S. § 37-92-305(8) (2006). B. Net evaporation from the Bearson Pit is 2.97 feet per year and the Pit has an exposed surface area of 8.4 acres, therefore, the evaporation from the Bearson Pit totals 24.9 acre-feet per year. Depletions from the South Platte River do not occur instantaneously and therefore Applicant will replace lagged evaporative depletions and post pumping depletions monthly as shown in Table 3 below. The monthly accretions and depletions attributed to the Applicant's shares of the Lupton Meadows Ditch Company is shown in Table 3 above. Weld County will augment evaporative depletions and post pumping depletions from the Bearson Pit from April through October by discontinuing its use of its shares of the Lupton Meadows Ditch during these months and transferring the water to the South Platte River at an augmentation structure constructed on the Lupton Bottom Ditch East Lateral. The structure is located in the S'h of the NW'h of Section 19, Township 2 North, Range 66 West of the 6th P.M. in Weld County. The water flows through the County's headgate and is measured in a flume where it can then flow either to the gravel pits or back to the river. Ilia 2006CW_ Weld County Page 8 D. During the winter months, November through March, Weld County will augment its evaporative and post pumping depletions from the South Platte River using perpetually leased water from the City of Greeley. Applicant will make these replacements in the monthly quantities shown in Table 3 by delivery to the Cache La Poudre River just above its confluence with the South Platte River and just below the outfall of the water treatment facility located on the south bank of the Cache la Poudre River in the SW V. of the SW V. of Section 4, Township 5 North, Range 65 West of the 6th P.M.. 9. Applicant intends to propose adequate terms and conditions to prevent injury to holders of vested water rights including the following: A. Applicant will relinquish to the stream 51.16 acre-feet of water annually, which is represented by Applicant's 52 shares of the Lupton Meadows Ditch Company, to assure that this water will only be used for augmentation and replacement of annual net reservoir evaporation and post pumping depletions. B. Applicant shall provide the quantity of water shown in the rightmost column of Table 3, above from the Applicant's right to perpetually leased water from the City of Greeley to assure that this water will only be used for augmentation and replacement of annual net reservoir evaporation and post pumping depletions. C. Pursuant to C.R.S. § 37-92-304(6) the Decree shall be subject to reconsideration by the water judge for a period of five years on the issue of injury to holders of vested water rights. C.R.C.P. 121, Section 1-15(8) Certification: Undersigned counsel conferred or attempted to confer with counsel for opposers regarding this motion. Counsel for City of Aurora, City of Broomfield and United Water and Sanitation District have consented to the motion. Applicant has not received a response from the City of Englewood, City of Greeley, Harmony Ditch Company or South Adams County Water and Sanitation District. 1. Weld County filed an Application for Change of Water Rights and Approval of Plan for Augmentation in this matter on December 28, 2006. The application requests approval of a plan of augmentation to provide for the replacement of tributary groundwater that evaporates from the surface of the Bearson Pit and a change of certain shares in the Lupton Meadows Ditch Company to utilize as an augmentation supply in the plan. The City of Englewood, South Adams County Water and Sanitation District, United Water and Sanitation District, City and County of Broomfield, City of Greeley, acting by and through its Water & Sewer Board, Harmony Ditch Company and The City of Aurora filed statements of opposition. Case No. 06CW274 Page 2 2. Applicant's initial substitute water supply plan (SWSP) allowing temporary operation of the plan of augmentation was approved on January 1, 2007. Applicant's current SWSP expires December 31, 2011. 3. This case has not yet been set for trial. 4. Pursuant to section 37-92-308(4)(b), C.R.S.: If an applicant requests renewal of a plan that would extend the plan past five years from the initial date of approval, the applicant shall demonstrate to the water judge in the applicable water division that the delay in obtaining a decree has been justifiable and that not being able to continue operating under a substitute water supply plan until a decree is entered will cause undue hardship to the applicant. 5. Weld County currently has 3 separate water court applications pending; two for augmentation plans for separate dust control wells used by the County in addition to this application. The two dust control well augmentation plans have been re-referred to the water court and the County's undersigned counsel and engineering consultants have been diligently working to settle those cases. Failure to continue operating under a substitute supply plan until a decree is entered will cause undue hardship to the Applicant. If a substitute supply plan is not approved, Applicant will not have a legal mechanism by which it can utilize its Lupton Meadows Shares or any other water supply to replace the evaporative losses from the Bearson Pit so as to prevent injury to other water rights until such time as a decree is entered in this case. THEREFORE, Weld County respectfully requests a finding of the Court that the inability to continue to operate under a substitute water supply plan until a decree is entered will cause undue hardship to Applicant.
