IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, A PORTION OF CHAPTER 8, PUBLIC WORKS AND CHAPTER 22, ARTICLE VIII, SECTION 22-3-50.E TRANSPORTATION, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS,the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein, and WHEREAS, the first goal of Section 22-3-60.A of the 2008 Weld County Comprehensive Plan recommended developing a county-wide transportation plan, and WHEREAS, County staff and elected officials will be able to use the Weld County Transportation Plan as a guide and tool to classify roads, to build the annual Capital Improvement Program, and to better coordinate transportation issues with other entities, and WHEREAS,the Board of County Commissioners recently reviewed and approved the Weld County Transportation Plan. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado that certain existing Chapters of the Weld County Code be, and hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as follows. Repeal and Reenact, with Amendments, Chapter 8, Article VIII Amend Appendix with the addition of 8-N —Transportation Plan —ATTACHED Repeal and Reenact, with Amendments, a portion of Section 22-3-50.E Transportation CHAPTER 8 PUBLIC WORKS Article VIII Transportation Planning Element of Northern Colorado Regional Communitios 125 Corridor Plan Section 8-8-10 Weld County Transportation Plan. A. The Weld County Transportation Plan, as amended, is intended to summarize existing transportation conditions, recommend policy,funding, and roadway development for Weld County over a twenty-five year planning horizon. The Weld County Transportation Plan will serve an integral part in the decision making process for Weld County staff and elected officials. The primary purpose of this document is to provide technical information that can be used as a basis for formulating transportation related policies. The Transportation Plan, as amended, will also be an extension of the comprehensive plan focusing on basic travel characteristics unique to Weld County. B. The Functional Classification Plan is a component of the Transportation Plan and is the process by which county roads are grouped into classes according to the character of service provided. The purpose of grouping the roads into classes helps identify locations for future right-of- way reservation. It is recommended to update the Functional Classification Plan every two years. C. The Transportation Plan, as amended, is identified in Appendix 8-N of this Chapter, and is intended to be used in concert with Chapter 22 of the Code. It is recommended to update this plan annually, and revise every five years. Section 8-84020 Adoption of Chapter VI, Transportation Element of Northern Colorado Regional Communities 1-25 Corridor Plan CHAPTER 22 COMPREHENSIVE PLAN Repeal and Reenact, with Amendments, a portion of Chapter 22, Comprehensive Plan Section 22-3-50.E Transportation E. Any review of significant proposals for changes in land use should be accompanied by a corresponding review of this Section, and ail roads should adhere to the standards set forth in the most current adopted plans and budgets. Established standards should guide the development of the transportation system throughout the unincorporated areas of the County. Land use proposals shall be reviewed and approved with guidance from Weld County's Transportation Plan, more specifically, the Functional Classification Map, as amended, and located in Appendix 8-N of the code. For example, the Roadway Classification Plan identifies the roadway, railroad and airport facilities in the County. Pedestrian, bicycle trails and scenic road byways are identified on the Rocroational Transportation Facilities Map. Section 22-1-150.B.4.a.10 Expansion of RUA Boundaries 10) Include a prepared preliminary traffic impact analysis. All traffic analysis information and reports shall be prepared and certified by a state-registered professional engineer competent in traffic engineering and shall address impacts to on-site and off-site roadways,—and highways including strategie roadways within the County, State I Ighways and Interstate Highways. The intent of this analysis is to determine the project's cumulative development impacts, appropriate project mitigation and improvements necessary to offset a specific project's impacts. This analysis shall include the following information: Section 22-1-150.B.4.b.10 Modification to Land Use Classification of Property Already Within the RUA Boundaries 10) Include a prepared preliminary traffic impact analysis. All traffic analysis information and reports shall be prepared and certified by a state-registered professional engineer competent in traffic engineering and shall address impacts to on-site and off-site roadways,—and highways including strategie roadways within the County, State Highways and Interstate I lighways. This analysis shall include the following information: Section 22-1-150.B.5.1 I. Include a prepared preliminary traffic impact analysis. All traffic analysis information and reports shall be prepared and certified by a Colorado registered professional engineer competent in traffic engineering and shall address impacts to on-site and off-site roadways,—and highways including strategic roadways within the County, state highways and interstate highways. The intent of this analysis is to determine the project's cumulative development impacts, appropriate project mitigation and improvements necessary to offset a specific project's impacts. This analysis shall include the following information: BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and sub-sections in said Code. BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph,sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The meeting was called to order by Chair, Tom Holton, at 1:30 p.m. ROLL CALL ABSENT Tom Holton Mark Lawley Nick Berryman Erich Ehrlich Robert Grand Bill Hall Roy Spitzer Alexander Zauder Jason Maxey Also Present: Chris Gathman, Kim Ogle and Tom Parko, Department of Planning Services; Elizabeth Relford, Don Carroll and Heidi Hansen, Department of Public Works; Lauren Light and Mary Evett, Department of Health; Bruce Barker, County Attorney, and Kris Ranslem, Secretary. Erich Ehrlich moved to approve the February 1,2010 Weld County Planning Commission minutes, seconded by Bill Hall. Motion carried. The Chair read the first case into record. CASE NUMBER: Ordinance 2011-5 PLANNER: Elizabeth Relford REQUEST: In the Matter of Repealing and Reenacting,with Amendments,A portion of Chapter 8 Public Works and Chapter 22 Comprehensive Plan of the Weld County Code. Elizabeth Relford, Public Works, presented the 2035 Transportation Plan. She commented that they started this effort in 2009 as a result from the update to the Comprehensive Plan in 2008. The draft is currently on the website for review and comment. This Transportation Plan focuses on our roadway system and is a planning document which guides us in our decision making efforts as land use proposals are presented. This effort was a coordination among thirty-one municipalities. Ms. Relford commented that they met with all the communities and tried to get a feel for how they felt their transportation system worked in their communities and what their concerns were so that we could acknowledge some of the issues they may be facing. After all the data was collected and the alignment and planning studies completed they created a Regional Transportation Planning Chapter which recognizes some of the existing regional transportation planning efforts occurring right now, such as the North 1-25 EIS and the Highway 85 Coalition. Out of this chapter came the Road Classification Plan. This Plan is a needs based plan which identifies our needs for the next 25 years. The priority that came out of the Transportation Plan is safety as well as protecting the investment of existing infrastructure by placing an emphasis on maintaining and upgrading existing transportation facilities. Out of the eight Goals established by the Board of County Commissioners, safety was the highest priority. Commissioner Grand asked how the oil business will affect our thought process on what we do on our roads. Ms. Relford said that a Niobrara Group has been set up and this group has been meeting once a month. The members are essentially representatives of the Oil and Gas Industry. At the last meeting, the members 1 highlighted their routes and from this we will generate a route map so that we know which roads will be impacted. They recognize that this is an issue and are trying to be proactive regarding this matter. Commissioner Lawley referred to Section 22-3-50.E, specifically the proposed language change"Land use proposals shall be reviewed and approved in accordance with Weld County's Transportation Plan, more specifically,the Functional Classification Map....". Mr. Lawley asked if there is a project that the applicant has submitted and it doesn't meet those criteria does it get denied. Ms. Relford commented that it isn't that it doesn't meet those criteria but that you will use that as a guide in reviewing the case. It doesn't necessarily mean that it would be denied but may need to be amended in consideration of the proposal. Ms. Relford agreed that the ordinance language could be modified. Commissioner Lawley recommended that the submittal be taken into consideration rather than approved in accordance with the Transportation Plan. Bruce Barker, County Attorney,suggested amending the proposed language to read"Land use proposals shall be reviewed and approved with guidance from the Weld County Transportation Plan, more specifically, the Functional Classification Map, as amended, and located in Appendix 8-N of the code." Mark Lawley moved to amend the proposed language as suggested by Mr. Barker,seconded by Erich Ehrlich. Motion carried. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Robert Grand moved that Ordinance 2011-5 be forwarded to the Board of County Commissioners along with the amendments and the Planning Commission's recommendation of approval, seconded by Jason Maxey. The Chair asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: 2011-XX APPLICANT: Beebe Draw Farms PLANNER: Kim Ogle REQUEST: Amended and Restated Consolidated Service Plan for Beebe Draw Farms Metropolitan District No. 1 and No.2. LOCATION: East of and adjacent to CR 39; north of CR 32; south of CR 38(generally located approximately 6 miles east of Platteville adjoining Milton Reservoir). Kim Ogle, Planning Services, commented that the original Service Plan for District Number 1 was approved by Weld County in 1986. In 1999, the Consolidated Service Plan was approved to organize District Number 2. Under the 1999 Service Plan, the Districts are required to coordinate with one another for the financing, acquisition, construction, operation and maintenance of the public improvements serving the entire Beebe Draw Farms and Equestrian center development. The purpose of the 1999 Service Plan was to ensure that public improvements were constructed on a phased based when needed and not sooner so that no area within the Development becomes obligated for more than its share of the costs of public improvements and operations. Development has occurred more slowly than was anticipated at the time of approval of the 1999 Service Plan. There are currently 54 homes in the Development and another 746 anticipated to be constructed. Under the 1999 Service Plan,the Board of Directors of District Number 2 makes all decisions with regard to the timing, financing, construction, acquisition, and operations and maintenance of all public improvements serving the Development. During its development, we appreciated the opportunity to review the draft road classification map. Our review focused on the proposed Weld County classification of East County Line Road, also known as WCR 1. This roadway runs the length of the boundary between Weld and Boulder Counties. In the October 2010 comments that we submitted to Weld County,we expressed concern about the proposed Weld County classification of East County Line Road as a Rural Arterial road. While we observed consistency with the 2010 Boulder County Multimodal Transportation Standards and the proposed Weld County"Initial Phase"cross section,this assessment did not hold true for the proposed Weld County"Ultimate Roadway"cross section for a Rural Arterial road. Our specific concerns centered on the right-of-way needs for full build out. We also had questions about whether the anticipated future travel demand would merit this level of roadway improvement. In response to our comments,the Weld County Road Classification Plan now indicates a Collector road classification for East County Line Road. We appreciate Weld County's responsiveness to our comments. Next year we will initiate a feasibility study of East County Line Road to identify right-of-way needs and develop a cost estimate for improvements to the corridor. As we discussed with you and other Weld County staff in February, we will be in touch as this effort gets underway and anticipate working closely with you throughout the study and project implementation process. On a final note,we continue to appreciate your participation on the advisory task force for the development of Boulder County's first-ever Transportation Master Plan. It may just be a typo. Greeley's plan calls for just over 5000 vpd on CR 35 north of Greeley in 2035. Also, Greeley's plan shows at most 34,800 VPD on O St just west of HWY 257 as the heaviest travel portion of O St, as compared to the 42,000 show in the County plan. ❑ Advisory Page 44— Bicycle & Pedestrian Facilities: In urbanized areas as development happens make sure that roads are built to local agencies standards that includes bike lanes and/or multiuse sidewalks where appropriate. ❑ Advisory Figure 24—page 72—this is the most important aspect of the plan. We hope that this information will be useful to Weld County in finalizing its classification map and will also lead to further discussion between the two counties. We also appreciate that Weld County is represented on the advisory task force for the development of Boulder County's first-ever Transportation Master Plan and look forward to continued coordination of both counties' efforts. Boulder County staff took the following steps in reviewing the Weld County draft classification map: • reviewed right-of-way ownership along the East County Line Road corridor and identified areas of joint ownership and mutual interest; • compared how the respective functional classification systems of each county was applied to those areas of joint ownership and mutual interest; • evaluated the appropriate typical cross sections at each location to assess consistency in expectations of future geometry and use between each county; and • overlayed other relevant Boulder County plans, such as the Boulder County Capital Improvement Program, transit plans, and Bikeways Plan,.to identify any potential discrepancies in policy and use. The resulting analysis indicated a general consistency in east-west corridor alignments approaching the East County Line Road corridor between Boulder and Weld Counties. We also observed consistency for the East County Line Road corridor for the "Initial Phase" cross section proposed by Weld County. This applies Weld County's Rural Arterial roads classification, which generally corresponds to Boulder County's Minor Arterial classification as identified in Boulder County's Draft Multimodal Transportation Standards, which are anticipated for adoption in 2010. Staff also identified some specific areas that warrant further discussion, most important the conditions under which the proposed "Ultimate Roadway" cross section for a Rural Arterial Cindy Domenico Cr, , , ✓r Wilt Tour Cu 4y .), road would be applied on East County Line Road. We would like to focus the remainder of our comments here. East County Line Road Corridor East County Line Road, also known as WCR I, runs the length of the boundary between Weld and Boulder Counties. The ownership of right-of-way along this corridor changes frequently with joint county ownership occurring primarily from the northern boundary of Boulder County to US 66 and from the City of Longmont southern city limits to SH 52. The remaining right-of-way from SH 52 south falls in the jurisdiction of the Town of Erie or the City of Lafayette with short, intermittent sections located in the unincorporated areas of Boulder and Weld Counties. A significant number of parcels in unincorporated Boulder County and adjacent to East County Line Road are either designated as open space or hold conservation easements. This information should be taken into consideration during any planning efforts along this corridor. The Boulder County Capital Improvement Program has identified the section of East County Line Road from the City of Longmont to the Town of Erie city limits as a location for shoulder improvements. Such improvements generally dictate shoulder widths of four to six feet; this figure corresponds to the shoulder widths identified in the Weld County typical cross section for the initial phase for the Rural Arterial road classification and suggests alignment between county visions. The Boulder County Comprehensive Plan Transportation Element requires Boulder County to consider multimodal operational investments to improve the efficiency in a corridor before employing construction-based solutions. It would be difficult for Boulder County to justify an investment in East County Line Road, including potential right-of-way acquisition, to construct the "Ultimate Roadway" cross section without first implementing other efforts and evaluating their effectiveness. In order to further understand the needs that East County Line Road is intending to meet in the future, we suggest taking a closer look at this corridor during the development of Boulder County's Transportation Master Plan. We would like to better understand why Weld County has identified the future expansion of East County Line as a possibility. We would also like to identify the needs for this corridor and discuss how future improvements could be made in a way that uphold both counties' interests. The resulting information could be brought forward for further discussions with Weld County staff and elected officials either now or at the time that any changes to the cross section of East County Line Road would be considered. Intersections with East County Line Road Most county roads that intersect or cross East County Line Road have a Local road classification on both sides. Here we note one location where classifications change across county lines. As Pike Road intersects East County Line Road, its functional classification changes from Local Access in Boulder County to that of Rural Arterial as it continues in Weld County. Staff understands that there is substantial truck traffic that occurs between the quarries located on Pike Road in Weld County and 1-25. However, Boulder County has not experienced the same level of truck traffic at or near the county boundary. The right-of-way requirements are substantially different for each classification as is the difference between the potential geometry of each classification. I wish I was on the ball as much as you all are! Our TMP update project has been on my desk for about a year I have forwarded the information to a few others on our staff, and if I get any comments from them, I'll let you know. In the meantime, I checked the connection points between Larimer and Weld Counties to see if our func classes pretty much align as roads move from Weld to Larimer County - which for the most part they do. That's probably the only big item for us to coordinate on. On an aside, I'll share with you two items that we struggled with when we updated our TMP a few years ago shortly after I was hired on. We had lots of discussions (and varying opinions) about this and I don't know if this applies at all to Weld County, but it might be a point of interest for you: - Defining road classes. We used to have a whole bunch of rural mainline roads (on section lines) that were classified as 'local'. With the last update, we changed those roads to minor collectors. We were finding that residents that live on a'local' road very much expect it to be 'local' forever - which was causing issues with proposed developments (people opposing access onto 'their' road), opposition to paving, no room for widened approaches (or turn lanes) at intersections to arterials, and lots of discussions about'local' road speed limits etc. So we defined local roads as those typically with limited length and continuity, and for the most part, all mainline, county maintained, section line roads that are several miles long and connect to other roads are minor collectors. In recognition that lots of local roads were moving to minor collectors, we shrank the ROW requirement to 80 (used to be 100 like a major collector), and lessened the setback from 50 ft to 30 ft. The change seems to have worked pretty well for us. - Right of way widths and typical sections. Our old plan had a ROW width for rural local roads of 60 feet, and the typical section looked great (the drainage ditch wasn't dimensioned or to scale). What we were finding was that it really didn't fit in the field. Roadside drainage ditches require 16 feet of width on level ground. A 32 foot wide road (12 foot lanes and 4 foot shoulders) together with 16 feet of drainage on each side was a total of 64 feet. Even shrinking shoulders to 2 feet, we had the edge of ditches butting right up against private fences, telephone poles were in the ditches etc. And if the ground wasn't level, the ditches were encroaching into private property. To address this, we did two things: The local road ROW requirement went to 70 feet. And on our typical sections, we dimensioned the drainage ditches at 16 feet, and showed how close those were coming to the ROW line. So now while our local roads don't have room for a turn lane(but the ditches fit in the ROW), our minor collectors have just enough ROW to accommodate a single turn lane if needed, or have a few feet to spare between ditch and ROW line. Like I said, I don't know if any of this is applicable to Weld County, but to the extent that we went through a lot brain damage during our update 4 years ago, I figured I would share it with you. What's your collector cross section look like? The City of Greeley is also showing WCR 27,29,31, and 33 as minor arterials. Are we consistent? I would suggest an 8' shoulder on your crosssections.
