RE: ACTION OF THE BOARD CONCERNING ZCV #1000157 AGAINST MILLER HFI,
LLC, FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Miller HFI, LLC, ZCV #1000157, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of February, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jerry Miller, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until April 8, 2011, to allow adequate time for the property owner to
apply for a USR permit and the Board to facilitate a work session giving direction to Staff and
Mr. Miller.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000157 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Jerry Miller/Miller HFI, LLC, to remedy the violation of
the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until April 8, 2011, to allow adequate
time for the property owner to apply for a USR permit and the Board to facilitate a work session
giving direction to Staff and Mr. Miller.

Barbara,
I live on WCR 54 between Wcr 49 and 51, It's been over a year
since trucks started hauling dirt from oil well sites to a location down
the road on WCR 51 and unloading the dirt. Since that time the truck
traffic has quadrupled along with the speed in which they travel down
the dirt road in front of my house.
My questions are
1. Does Parcel# 096329300002 have a permit to allow this beings
it's zoned agricultural?
2. If they do have a permit to allow this, is there a designated route
in which the trucks a suppose to take?
3. Doe's the dumpsite MILLER HFI LLC 25500 WCR 51 need to
provide dust control on the dirt road in from of my house?

II PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews
are required prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public
Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in
the Greeley office. To be on the pre-submittal agenda, the request and required checklist items must
be received one week prior to the review date, and shall include at a minimum, a description of the
property including surrounding lands and land uses, property owners name and contact information a
brief narrative and a map delineating the property location, in addition to the other items listed.
• The Property Information required below can be found on the Weld County Assessor website at
www.co.weld.co.us Please print a copy of the Assessors page and submit it with your pre-application
review request.
• Mail, fax or drop off the request and required checklist items to the address listed below, a minimum of
one week prior to your preferred meeting date.
