Gentlemen:
I have your inquiry asking my opinion on the following question:
"Does annual audit of all county accounts and funds, as specified in the
Charter, include the Weld County General Hospital?"
The answer is, NO,
This question is expressly answered in CRS 1973, 25-3-304 (1),
which states, among other things, that:
"All tax moneys received for hospital purposes shall be paid
out of the county treasury only upon warrants drawn by the
county commissioners upon sworn vouchers approved by the
hospital board.
All other moneys received for such hospital shall be deposited
in the treasury of the hospital and paid out only upon order of
said hospital board. " (emphasis mine)
Because tax money is the only hospital fund in the county treasury,
that is the only hospital account or fund that can be considered county funds.
The treasury of the hospital is the depository of all other moneys received
for such hospital; therefore, they cannot be considered county funds.
Article XIV, Section 14-4 of the Charter states, among other things,
that:
"The Board shall provide for an independent audit of all county
accounts and funds. . . . " (emphasis mine)

Accordingly, it is my opinion that pursuant to CRS 1973, 25-3-304 (1)
and the Weld County Home Rule Charter, Article XIV, Section 14-4, that
hospital funds are not included in the audit of county accounts and funds.
