HomeMy WebLinkAbout20112350.tiff RESOLUTION RE: APPROVE MINOR AMENDMENT (MUSR-0002) FOR SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT#1232 - ANDERSON SOUTH FARM, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 31st day of August, 2011, at the hour of 9:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Anderson South Farm, LLC, 6876 County Road 5, Erie, Colorado 80516, for a Minor Amendment to the Site Specific Development Plan and Amended Use by Special Review Permit#1232 for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds to allow ten (10) fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass, or another suitable building material, on top of an existing silo, in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #281; located in Section 32, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the applicant was present and represented by Pam Hora, Tetratech, 1900 South Sunset Street, Suite 1F, Longmont, Colorado 80501, and WHEREAS, Section 23-2-285 of the Weld County Code provides standards for review of said Minor Amendment, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-2-285.J of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 23-2-285.C of the Weld County Code as follows: a. Section 23-2-285.C.1 - The proposed change(s) will be compatible with existing and allowed uses in the surrounding area and be in harmony with the neighborhood. The site and surrounding area is predominantly zoned A (Agricultural); two subdivisions are located northeast of the site (Reflection Bay PUD and Continental View Ponds PUD). The Weld County Department of Planning Services has not received any comments from the surrounding property owners regarding the proposed modifications. The applicant has proposed ten (10) fire pits, with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel �� CA 2011-2350 (5 , PL1322 to 5 0 MINOR AMENDMENT, MUSR#0002 (AMUSR #1232) -ANDERSON SOUTH FARM, LLC PAGE 2 - DRAFT train, and a pumpkin made out of fiberglass or another suitable building material on top of an existing silo. The proposed amendments fit into the overall character of the existing AmUSR-1232, which was approved by the Board of County Commissioners on September 16, 2009. 2. Section 23-2-285.C.2 - The proposed change(s) is consistent with the County Comprehensive Plan pursuant to Chapter 22 of the Weld County Code. a. ECON.Policy 3.1 states, "County activities and regulation should protect the rights of private property owners and the public health, safety, and welfare, recognizing that these basic rights and protections allow the free market to prosper and grow the local economy" b. A.Policy 7.1 states, "County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable." c. The applicant is requesting to expand the existing Amended Use by Special Review to include a few additional uses: 10 fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass, or another suitable building material, on top of an existing silo. The impact to the surrounding properties is minimal because no concerns have been received from the surrounding property owners and the majority of the referral responses did not seem to have concerns. 3. Section 23-2-285.C.3 - The proposed change(s) will not result in a substantial adverse impact on the other property in the vicinity of the subject property. The applicant, on May 25, 2011, sent letters to all the property owners within 500 feet of the subject property before they submitted their Minor Amendment application on July 1, 2011. According to the application materials, no comments have been received from the surrounding property owners. The County also notified all the property owners within 500 feet of the site and no responses were received. The referral responses from the Towns of Frederick and Erie indicated no conflicts. The City of Dacono, City of Longmont, and the Town of Firestone did not respond to the referral request. 4. Section 23-2-285.C.4 - The recommendations of the referral agencies have been considered. The attached Conditions of Approval and Development Standards address the requirements of the referral agencies. 2011-2350 PL1322 MINOR AMENDMENT, MUSR #0002 (AMUSR#1232) -ANDERSON SOUTH FARM, LLC PAGE 3 - DRAFT 5. Section 23-2-285.C.5 - Not deemed to be a major change. In a Pre-Application meeting on May 12, 2011, staff determined the proposed modifications are not a major change. 6. Section 23-2-285.C.6 - Must be consistent with the original development standards. The proposed modifications to allow ten (10) fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass, or another suitable building material, on top of an existing silo in the A (Agricultural) Zone District fits into the overall theme and is consistent with the original Development Standards of AmUSR-1232. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Anderson South Farm, LLC, for a Minor Amendment to the Site Specific Development Plan and Amended Use by Special Review Permit #1232 for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds to allow ten (10) fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass, or another suitable building material, on top of an existing silo, in the A (Agricultural) Zone District, on the parcel of land described above be, and hereby is, granted subject to the following conditions: 1. The plat shall be amended to delineate the following: A. All sheets of the plat shall be labeled MUSR-0002. B. The attached Development Standards. C. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. D. The applicant should remove the shaded area in County Road 3.25. 2. The applicant shall address the requirements/concerns of Weld County Department of Building Inspection, as stated in the referral response dated August 9, 2011. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. 3. Upon completion of Conditions of Approval #1 and #2 above, the applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board 2011-2350 PL1322 MINOR AMENDMENT, MUSR #0002 (AMUSR#1232) -ANDERSON SOUTH FARM, LLC PAGE 4 - DRAFT of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 4. In accordance with Weld County Code Ordinance #2006-7, approved June 1, 2006, should the plat not be recorded within the required sixty (60) days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge shall added for each additional three (3) month period. 5. The Department of Planning Services respectfully requests a digital copy of this Use by Special Review, as appropriate. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles or ArcGIS Personal GeoDataBase (MDB). The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to maps@co.weld.co.us. 6. The Minor Amendment activity shall not occur, nor shall any building or electrical permits be issued on the property until the Minor Amendment plat is ready to be recorded in the office of the Weld County Clerk and Recorder. A Minor Amendment to a Site Specific Development Plan and Amended Use by Special Review Permit #1232 is for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds, to allow ten (10) fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass or another suitable building material on top of an existing silo, in the A (Agricultural) Zone District. 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. 3. All liquid and solid wastes, as defined in the Solid Wastes Disposal Sites and Facilities Act, Section 30-20-100.5, C.R.S., shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, Section 30-20-100.5, C.R.S. 5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 6. The applicant shall operate in accordance with the approved Waste Handling Plan. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan. 8. The facility shall comply with Regulation No. 9, Open Burning, Prescribed Fire, and Permitting (5 CCR 1001-11) of the Colorado Air Quality Control Commission. Only clean, untreated wood and untreated wood products may be burned in the fire pits. 9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, as delineated in Section 25-12-130 C.R.S. 10. Permanent hand washing and toilet facilities shall be provided for 200 people per day. 11. The facility shall utilize portable toilets and hand washing units to temporarily supplement the sanitary facilities for the 26 temporary events per year. 12. The "Sewage Disposal and Portable Toilet Plan", dated June 30, 2009, shall be adhered to, at all times. 2011-2350 PL1322 MINOR AMENDMENT DEVELOPMENT STANDARDS (MUSR#0002/AMUSR#1232) - ANDERSON SOUTH FARM, LLC PAGE 2 13. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 14. The facility shall utilize the existing public water supply (Left Hand Water District). 15. If applicable, the applicant shall obtain a Stormwater Discharge Permit from the Colorado Department of Public Health and Environment, Water Quality Control Division. 16. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 17. If applicable, the applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 18. The operation shall comply with all applicable rules and regulations of state and federal agencies and the Weld County Code. 19. No parking or staging of vehicles on the County road is allowed; the facility shall use the on-site parking area. 20. The applicant shall continue follow Traffic Control Plans that conform to the Manual on Uniform Traffic Control Devices (MUTCD) for all events held at this facility. All Traffic Control Plans, at a minimum, must contain flagger control, temporary traffic control signing, and cones. 21. Ingress and egress to the facility shall be from the existing access along County Road 3.25. 22. Prior to the sale of any alcoholic beverages, the applicant shall apply for, and receive approval for, all appropriate local and State licenses. 23. The landscaping on the site shall be maintained in accordance with the approved Landscape Plan. 24. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. The applicant shall include a Code Analysis Data Sheet, provided by the Weld County Department of Building Inspection, with each building permit. Submittal plans shall include a floor plan showing the specific uses of each area for the building. The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code. The plans shall also include the design for fire separation and occupancy separation walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection shall conform to Chapter 9 and exiting requirements by Chapter 10. 25. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently, the following have been adopted by Weld County: 2006 International Building Code, 2006 International Mechanical Code, 2006 International Plumbing Code, 2006 International Fuel Gas Code, 2006 International Energy 2011-2350 PL1322 MINOR AMENDMENT DEVELOPMENT STANDARDS (MUSR#0002/AMUSR#1232) - ANDERSON SOUTH FARM, LLC PAGE 3 Conservation Code, 2008 National Electrical Code, and Chapter 29 of the Weld County Code. 26. Building permits will be required for the haunted theme area and the educational building if they will be utilized under this amended Use by Special Review Permit. 27. The Education Building is permitted to utilize more than one cargo container in the construction of this structure, per Section 23-3-40.AA. 28. All building plans shall be submitted to Mountain View Fire District Fire District, for review and approval, prior to issuance of building permits. 29. Annually the facility is restricted to six (6) events, with a maximum daily visitor population of up to 10,000 persons; ten (10) events, with a maximum daily visitor population of up to 5,000 persons; and ten (10) events with a maximum daily visitor population of up to 1,200 persons per day. On all other days of operations, the facility will be permitted for up to 499 participants at any one time, as approved under AmUSR-1232. For the purposes of this Minor Amendment, an "event" is considered to be one (1) day in duration. No Temporary Assembly Permit shall be necessary for the events as described and allowed herein. 30. The existing tail water ditch downstream of the overflow parking lot area shall be used as a water quality feature. It shall be maintained using the Best Management Practices. Should sediment from this water quality feature enter into the Boulder Creek waterway, additional measures will be required as determined by the Weld County Department of Public Works. 31. A right-turn deceleration lane is warranted for the project site access, based on the turning movement figures in the Traffic Study. The Weld County Department of Public Works is not requiring the construction of the right-turn deceleration lane; however, if the number of events or volumes increase beyond the submitted information within the Traffic Study, the construction of a right-turn deceleration lane will be required at the cost of the applicant. 32. The overflow (secondary) parking area shall place the single point of ingress and egress seventy-five feet from the southernmost property line of the Anderson Farm property. This access shall be gated, unless the maximum daily visitor population exceeds 1,200 persons. 33. The applicant shall maintain compliance with all the requirements of the Colorado Department of Labor and Employment's Public Safety requirements for Amusement Rides and Devices. Evidence of such shall be provided to the Department of Planning Services upon request. 34. Effective April 25, 2011, building permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. 35. Effective April 25, 2011, building permits issued on the subject site will be required to adhere to the fee structure of the County Facility Fee and the Drainage Impact Fee. 2011-2350 PL1322 MINOR AMENDMENT DEVELOPMENT STANDARDS (MUSR#0002/AMUSR#1232) - ANDERSON SOUTH FARM, LLC PAGE 4 36. The property owner or operator shall be responsible for complying with the Design Standards of Section 23-2-240 of the Weld County Code. 37. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250 of the Weld County Code. 38. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan. Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. No colored lights may be used which may be confused with, or construed as, traffic control devices. 39. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 40. Necessary personnel from the Weld County Departments of Planning Services, Public Works, and Public Health and Environment shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Conditions of Approval and Development Standards stated herein and all applicable Weld County regulations. 41. The Amended Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 42. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 43. For the purposes of this MUSR, an "event" is considered to be one (1) day in duration. No Temporary Assembly Permit shall be necessary for the events as described and allowed herein. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 43. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5- 102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, MUSR-0002 Anderson Farms Page 8 in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Review 1232 to allow for Construction of Pumpkin Structure Anderson Farms, which is permitted per AmUSR-1232, is owned by Anderson South Farm LLC. The property is located east of County Road 3.25, 1/2 mile north of Highway 52 in Weld County. The property is surrounded by agriculturally zoned land with the exception of a small parcel northwest of the site that has PUD zoning. Anderson Farms is Weld County's and Colorado's oldest corn maze and pumpkin patch. As allowed per AmUSR-1232, Anderson Farms offers several agri-tourism activities such as field trips for children in the spring, summer and fall; a barn that can be rented for group activities; a Fall Festival with activities such as hayrides, a corn maze, and opportunities to interact with farm animals; and a Terror in the Corn activity in October. On the property, there are two existing silos and Jim Anderson, the owner/operator of Anderson Farms would like to place a pumpkin structure on top of one of the existing 45±feet tall silos as a fun, aesthetic addition to his farm. According to the existing AmUSR-1232, Anderson Farms is a "Recreational Facility with uses similar to those seen at guest farms and fairgrounds". Therefore, adding the pumpkin structure at the farm would be consistent with the approved use. The addition of the pumpkin structure will be an aesthetic addition to the farm; it will not change the existing uses and activities currently happening at the farm. The pumpkin structure proposed to be added to the top of the silo is approximately 22 feet in diameter, 15 feet tall, and weighs approximately 1500 pounds. Mr. Anderson understands that structural engineering will need to be completed to ensure that the existing silo used to support the pumpkin will be able to support the weight of the pumpkin (if needed, structural reinforcements will be used inside the silo so that it can support the pumpkin). In addition, we understand that the structural engineering calculations will need to take snow load and wind into consideration and address how the pumpkin will be secured to the top of the silo. It should be noted that following a preliminary structural analysis of the silos, if it is determined that it will not feasible to use one of the silos for the pumpkin structure, as an alternative, Mr. Anderson will construct a structure specifically for the pumpkin. If a separate structure needs to be constructed, the thought would be to design it to look like a small agricultural water tower with the pumpkin on top instead of a water tank. Attached is a copy of the current AmUSR-1232 which shows the location of two existing silos. We have also attached a photo of a pumpkin structure on top of a silo at a farm in Wisconsin. The existing Use by Special Review is for a "Recreational Facility with uses similar to those seen at guest farms and fairgrounds". This really is just a modification to an existing structure. It is anticipated that Tetra Tech will perform an evaluation of the silo's structural integrity and will analyze wind and snow load for the structure. We believe that this is not a substantial change to the site, since no new building footprints are planned. It is understood that, at a minimum, a building permit will be required for this structure and we plan on applying for it as soon as the design is completed. Attached is a copy of the current AmUSR-1232 which shows the location of two existing silos. We have also included a photo of a pumpkin structure on top of a silo at a farm in Wisconsin. This would be the first pumpkin structure in the State of Colorado and we believe it would be an enhancement to Anderson Farm that would provide positive publicity for Weld County. So, by adding the pumpkin to the top of the silo, the total structure height will be approximately 60 feet. Explain how this proposal is consistent with the intent of the Comprehensive Plan pursuant to Chapter 22 of the Weld County Code. According to Chapter 22, Section 22-2-10.B, it is the intent of the agricultural Goals "to support all forms of the agricultural industry"and, according to Section 22-2-10.A, agri-tourism and agri-tainment uses are considered an agricultural industry. Anderson Farms is an agri-tourism/agri-tainment business and the family wants to make the four proposed improvements to their existing business to make sure it continues to be a successful agricultural business in Weld County. Therefore, approving this application will meet the intent of the Weld County Comprehensive Plan. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. With the approval of AMUSR-1232, the County already made the determination that Anderson Farms is a "Recreational Facility with uses similar to those seen at guest farms and fairgrounds"(Section 23- 3-40, C, 5 and 6). Therefore, this application which requests permission to make some improvements to the site, all of which will be similar to those seen at guest farms and fairgrounds, is consistent with the intent of the Weld County Zoning Code, Chapter 23. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). The uses that surround Anderson Farms are agricultural and rural residential. This Minor Amendment application is to amend AMUSR-1232 which already allows Anderson Farms to operate as an agri-tourism/agri-tainment business on the property. The amendment is a request to allow for the addition of a Train Station, ten fire pits, two pedal cart tracks and a fiberglass pumpkin on top of one of the existing silos at Anderson Farms. The existing business was already found to be compatible with the surrounding land uses and making these four additional agri-tourism/ agri-tainment related improvements will not affect the compatibility of Anderson Farms with the surrounding land uses. All four uses are internal to the site and most will not even be noticed by surrounding property owners. The only use that will probably be noticed will be the pumpkin structure because it will be seen from off-site. However, on May 25, 2011, we sent a letter to all property owners within 500 feet of the Anderson Farms property to explain all four uses. The letter included a photo of a pumpkin on top of a silo so that they neighbors would have an image of what is being proposed. We asked the neighbors to contact Pam Hora with Tetra Tech if they had any questions or concerns about any of the proposed improvements. None of the property owners contacted Ms. Hora to ask any questions or express any concerns. 5. Describe, in detail, the following: a. Number of people who will use this site. The four proposed improvements to Anderson Farms will not affect the number of people already approved to be on this site as part of AMUSR-1232. According to the Development Standards for AMUSR-1232, "Annually the facility is restricted to six events with a maximum daily visitor population of up to 10,000 persons; 10 events with a maximum daily visitor population of up to 5,000 persons; and 10 events with a maximum daily visitor population of up to 1,200 persons per day. On all other days of operations, the facility will be permitted for up to 499 participants at any one time as approved under USR-1232." b. Number of employees proposed to be employed at this site The proposed improvements associated with this application will not increase or decrease the number of employees at Anderson Farms. c. Hours of operation The proposed improvements will not affect Anderson Farms'existing hours of operation. d. Type and number of structures to be erected (built) on this site The structures and other improvements proposed as part of this application include: • One all-metal structure to be used as a Train Station for the barrel train that is already used on-site. Kind of vehicles (type, size, weight)that will access this site and how often We anticipate that semi-trucks will need to come onto the property to deliver the all-metal structure (Train Station) and the fiberglass pumpkin and a crane will need to be brought onto the site to install the pumpkin on top of the silo. We do not know the details related to the size and weight of these trucks and deliveries, but it will just be a one-time occurrence. Otherwise, the proposed improvements will not affect the types and number of vehicles that already access Anderson Farms on a regular basis. g. Who will provide fire protection to the site Fire protection will continue to be provided by Mountain View Fire Protection District. Jim Anderson, owner of Anderson Farms, already met with LuAnn Penfold at the District about the proposed improvements and she indicated that she had no concerns with any of the improvements as proposed. h. Water source on the property (both domestic and irrigation) Not applicable; the proposed improvements associated with this application will not require a water source. i. Sewage disposal system on the property (existing and proposed) Anderson Farms has a septic system for the kitchen and permanent restroom facilities and they use portable toilets. There is a "Sewage Disposal and Portable Toilet Plan"that was approved by the Weld County Department of Public Health and Environment as part of AMUSR-1232, that will continue to be followed. No new restroom facilities are needed in association with the proposed improvements to Anderson Farms. j. If storage or warehousing is proposed, what type of items will be stored. Not applicable; no storage or warehousing is proposed with this application. k. Explain how the storm water drainage will be handled on the site. Following is a list of each of your comments followed by our response. 1. A building permit shaH be obtained prior to construction of train station structure and pumpkin structures. Wet stamped Engineers plans for train station shall be complete with floor plan and exiting plan. The silo that supports the fiberglass pumpkin shall be reviewed by an Engineer for structural integrity;a complete analysis report must be submitted to the Building Department for review with plans for tie downs to resist all lateral loads for pumpkin. Building permits will be obtained prior to construction of the train station and pumpkin structures. A building permit application for the train station was submitted on August 5, 2011 and we are asking that it be approved by Friday, September 2, 2011. The dimensions on the structure aren't right- I had pulled them from the brochure for the structure Jim showed me. In answer to your question—I'm not a farm girl, but I'm told very few silos in this area have a roof and our engineer and I field verified that the one out at Anderson Farm also does not have a roof. So, I'm not sure what category of sign we'll be proposing, but I agree the pumpkin is a sign based on your definition. We will proceed as directed to get the pumpkin rolling! Before we submit an application, we're going to send a letter out to the neighbors to explain what Jim wants to do and ask them to contact me if they have any questions or concerns so we can gauge the neighbors thinking before we go too far. I'm very hopeful that the Commissioners will like the idea ... so,as long as the neighbors don't hate it, we should be good. In addition,we need to expand the application. Last week Jim came in to see me to talk about some other minor changes he'd like to make out at the farm. I advised him that we should put all additional changes he wants to make into one application so that he doesn't need to go through the process to amend his USR twice. I had him explain his 1 desired changes to me and they all seem o be minor enough to me that I think they an all be covered in a Minor Amendment Application, but I know that Trevor will need to make that call. Attached is map Jim brought me showing the area where he would like to place the additional improvements. The improvements that he would like to make are: • Construct a 36' wide x21' deep x 11' high all-metal structure to use as a train station for his barrel train that he already uses out there. The structure will be large enough for the children to be able to stand in line under the structure and the train will be able to pull up under the structure to pick them up. (see attachment for a picture of the structure he has in mind) • Add up to ten fire pits with hay bales for seating around each pit-visitors will be able to use them to have small group camp fires. • Construct two pedal cart tracks—one for kids to use and one for adults. The tracks would be constructed by building a 1' tall railing to keep the tires for the carts inside the track. When Jim explained his ideas to me, the concerns I had related to concerns the Fire District might have so I asked Jim to go and talk to LuAnn Penfold about his ideas. He reported back to me that she has no concerns with adding the non- combustible structure he wants to build. He said she was actually glad to hear he'd have the structure because it would prevent medical emergency situations by providing another place for visitors to take shelter in the event of a hail storm. She also said she didn't have any concerns with the fire pits as long as they were no larger than 3' diameter x 2' high and Jim said he is fine with that. In addition, he said she pointed out that the hay bales for seating would be good because they would serve as a wind break. I do want to point out that the existing USR shows that the area where he wants to place these improvements is shown on the plan as an overflow parking area. However,Jim has a lot other land within his USR boundary area that could be designated and used for overflow parking if that was a concern of the County. So, I hope Trevor will agree that this these uses can be covered under a Minor Amendment Application and I look forward to hearing from you on how we should proceed. This proposal includes the addition of 10 fire pits, 2 pedal cart tracks, a train station for the barrel train, and a fiberglass pumpkin on top of an existing silo. In accordance with the Colorado Air Quality Control Commission's Open Burning Regulation No. 9, fires used for noncommercial cooking of food, or for recreational purposes (fire pits) are exempt from the requirement of obtaining an open burning permit. Therefore, this minor amendment includes a new Development Standard for replacement of Development Standard No. 8 of AMUSR-1232 to allow open burning in the fire pits. Only clean, untreated wood and wood products may be burned in the fire pits. See Development Standard No. 6 below. Left Hand Water District provides water to the site. There is an existing Individual Sewage Disposal System (SP-0000030) which was designed to serve up to 200 people. Due to the large number of people that could potentially visit the site, portable toilets and hand washing units are used in conjunction with the existing septic system. The facility's "Sewage Disposal and Portable Toilet Plan", dated June 30, 2009, shall be adhered to at all times. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan". 6. The facility shall comply with Regulation No. 9, Open Burning, Prescribed Fire, and Permitting (5 CCR 1001-11) of the Colorado Air Quality Control Commission. Only clean, untreated wood and untreated wood products may be burned in the fire pits. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Permanent hand washing and toilet facilities shall be provided for 200 people per day. 9. The facility shall utilize portable toilets and hand washing units to temporarily supplement the sanitary facilities for the 26 temporary events per year. 10.
