RE: ACTION OF BOARD CONCERNING REQUEST TO WITHDRAW RECORDED
EXEMPTION #4862- KS ENTERPRISES I, LLC, C/O DON CLAPS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on December 23, 2008, the Department of Planning Services administratively
approved the request of KS Enterprises I, LLC, P.O. Box 843, Brighton, Colorado 80601, for
Recorded Exemption#4862, to divide the property into parcels estimated to be approximately three
(3) acres and 2.9 acres, for property which is located on the following described real estate, to-wit:
Lot B of Corrected Recorded Exemption #3360, Part
of NW1/4 of Section 29, Township 1 North, Range 66
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Department of Planning Services staff notified the applicant, by certified
letters dated April 4, and May 5, 2011, that certain outstanding Conditions of Approval had not been
completed and that the matter would be scheduled for a hearing before the Board of Weld County
Commissioners unless written documentation was received requesting a withdrawal of the case,or
the outstanding items were completed and the mylar plat recorded, and
WHEREAS, on June 13, 2011, the applicant was present or represented, and
WHEREAS, after reviewing Department of Planning Services concerns and hearing the
testimony presented, the Board determined that said request shall be denied, and
WHEREAS, on June 15, 2011, the Board deemed it advisable to reconsider the matter, at
the request of Planning Services, due to evidence indicating the applicant had submitted a
withdrawal request which was not received by staff until after the meeting, and
WHEREAS,after further review, the Board now deems it advisable to accept the applicant's
request to withdraw the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request to withdraw the application for Recorded Exemption #4862,
submitted by KS Enterprises I, LLC, c/o Don Claps, be, and hereby is, accepted.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 15th day of June, A.D., 2011.
