HEARING CERTIFICATION DOCKET NO. 2011-27A RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1777 FOR A TELECOMMUNICATION ANTENNA TOWER (250-FOOT CELLULAR TOWER) IN THE A (AGRICULTURAL) ZONE DISTRICT - DEWAIN SHAPLEY TRUST, C/O VERIZON WIRELESS, LLC A public hearing was conducted on June 15, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Christie Peters County Attorney, Lee Morrison Planning Department representative, Michelle Martin Health Department representative, Mary Evett Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated April 15, 2011, and duly published April 20, 2011, in the Fort Lupton Press, a public hearing was conducted on May 25, 2011, to consider the request of Dewain Shapley Trust, c/o Verizon Wireless, LLC, for a Site Specific Development Plan and Use by Special Review Permit#1777 for a Telecommunication Antenna Tower (250- foot cellular tower) in the A (Agricultural) Zone District. At said hearing, the Board deemed it advisable to continue the matter to June 15, 2011, due to the applicant's request for the matter to be considered by a full quorum of the Board. At said hearing on June 15, 2011, Lee Morrison, County Attorney, made this a matter of record. Michelle Martin, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the site is located west of and adjacent to State Highway 71 and north of and adjacent to County Road 112, which is a Section Line; access to the site is provided through an easement on private property. Ms. Martin indicated the nearest resident/property owner is approximately 1,300 feet from the proposed tower site. She stated the tower is an unmanned facility which will be lighted and will generate little traffic to the site. Ms. Martin further stated the site is not located within the three-mile referral area for any municipality and displayed photos of the site and the surrounding properties. Heidi Hansen, Department of Public Works, stated access to the site is from State Highway 71 and the access is within the County Road 112 right-of-way for a short distance. Staff is not requiring a Non-Exclusive Agreement; however, they are requiring a minimum twenty (20) foot wide access, to allow emergency vehicles to access the site. C� ,GL19U\-, i-1L 2011-1413 ?-t - II PL2123 HEARING CERTIFICATION - DEWAIN SHAPLEY TRUST, CIO VERIZON WIRELESS, LLC (USR-1777) PAGE 2 Mary Evett, Department of Public Health and Environment, stated there will be no employees at the site; therefore, permanent water and sewer are not required, and portable toilets and bottled water will be allowed during the construction of the facility. She stated Development Standards#3 through #10 address environmental health items and staff has no concerns with this request. Kelly Harrison, representative for Verizon Wireless, stated there will be a 12-foot by 26-foot shelter at the base of the tower. In response to Commissioner Conway, Ms. Harrison indicated the small building at the base of the tower will be unmanned, it stores the equipment for the facility, the property owner will be present, and it has alarms in case of an emergency. In response to Commissioner Rademacher, she stated a wind farm has been proposed on the same site as a similar operation in Kit Carson County, and Verizon Wireless and the wind farm have agreed to provide each other with approximately 800 feet of clearance. Ms. Harrison added these types of operations do not interfere with wind farms; however, if someone were to construct a wind turbine in front of the facility it would block the signal. She reiterated as long as there is over 500 feet of clearance, the wireless signal will not be disturbed. In response to Chair Kirkmeyer, Ms. Harrison referred to maps which identified the existing coverage for Verizon Wireless in the area of the proposed site, and the enhanced coverage as a result from approval of the proposed tower. She further stated Verizon Wireless would like to eventually connect coverage up to Interstate 80. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Ms. Harrison stated the applicant has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed. Commissioner Long commended the applicants and stated the proposed tower and improved reception is going to be a great addition to Weld County. Commissioner Long moved to approve the request of Dewain Shapley Trust, do Verizon Wireless, LLC, for a Site Specific Development Plan and Use by Special Review Permit #1777 for a Telecommunication Antenna Tower (250-foot cellular tower) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
