SUBJECT: USR11-0004, Soto Gonzales (Foster Trucking)
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
Add additional items to plat drawing (RED LINE) markup.
CR 60.5 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant
shall delineate or dedicate an 40-foot of right-of-way on either side of the centerline of the roadway.
Our most recent traffic count reflects 2988 taken in 2010 on CR 60.5 between CR 47 & CR 49.
Change the label from State Highway 263, and show CR 60.5.
The plat should reflect a vehicle tracking control pad. This should consist of 100 feet of asphalt with double
cattle guards. Please find attached our typical (preferred) option. This should be shown on the plat drawing.
The applicant needs to sign, date and return the Access Permit Application form. Please return this form to our
Traffic Engineer at Public Works Department.
REQUIREMENTS:
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum
height of 12 inches until the area is completely developed.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems. A drainage report was not required for this
location as it is located within the 100-year floodplain of the Cache La Poudre River. The applicant has
indicated that the stormwater runoff will follow historic drainage paths.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles
from extending beyond the boundary of the space and from coming into contact with other vehicles, walls,
fences or plantings.
Both Lots A and B shall share a joint access point. (Lots A& B, RE-4573)

The water quality feature calculations appear to be acceptable to Public Works.
lease add the following development standards to the resolution:
1. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
2. The applicant must take into consideration storm water capture/quantity and provide accordingly for
best management practices.
3. Weld County will not maintain on-site drainage related areas or medians. This must be addressed by
the homeowner's association or owner.
4. The applicant is required to comply with all Colorado Department of Health and Environmental
(CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on site.
5. The applicant is required to comply with all Colorado Department of Health and Environment, Water
Quality Control Division regulations regarding storm water quality permitting and protection and
construction storm water discharges.
Geotechnical Soil Report:
A geotechnical soils report is not required by Public Works at this time.
Traffic Study:
The applicant supplied a narrative describing the number of employees at the facility. Assuming a maximum of
60 trips entering or exiting the facility per day a traffic study is not required at this time. However, if the traffic
volumes increase a traffic study may be required. After reviewing the submitted narrative and visiting the
project site, the following comments have been prepared.
• 1. An annual road inspection will be performed in the spring to establish the condition of CR 60.5 to
determine if any road damage was caused by the operation of the loading facility.
2. The applicant will be responsible excavate, repair, or patch any damage on the roadway to mitigate for
heavy truck traffic created by the loading facility. The type and method of repair will be determined by
the Department Public Works. If road damage is beyond repair, the applicant will pay their proportional
share for the reconstruction to restore the road.
3. Roadways Improvements may be triggered due to heavy truck traffic associated with the facility
including turn lanes; the following is a list of the triggers for turn lanes:
a. 25vph turning right into the facility during a peak hour.
b. 10vph turning left into the facility during a peak hour.
c. 50 vph turning right out of the facility during a peak hour.
4. A stop sign will be required to be installed at the facility access onto CR 60.5. The access will have 60'
radius to accommodate the larger trucks entering and existing the site, as well as, a double cattle guard
tracking pad improvement.
5. No parking or staging of commercial vehicles on the county road is allowed. Use on-site parking area.
Special Flood Hazard Area:
Portions of the property south of the Ogilvy Ditch are located in the 100-year flood plain of the Cache la Poudre
River. Currently, there is no development shown south of the ditch. As long as the development stays out of
the flood plain, a Flood Hazard Development Permit (FHDP) is not required. If development is proposed in the
flood plain, an FHDP will be required.
FEMA has recently accepted the 2003 Army Corps of Engineers study as the effective floodplain for the
Poudre River. Please verify that the floodplain boundaries shown on the plat are based on the 2003 Army
Corps of Engineers study. If the boundaries are based on the September 28, 1982 FIRM, please update the
boundaries.
Please add the following development standards to the resolution:

1. A portion of the property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency
Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating
• Map (FIRM), panel number #080266-0645O, dated June 10, 2005. Portions of lots located in the
current effective FEMA 100-yr floodplain may not be buildable.
2. Flood hazard development permits will be required for development activities located within the FEMA
mapped Poudre Floodplain. The FEMA definition of development is any man-made change to
improved or unimproved real estate, including by not limited to buildings or other structures, mining,
dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials.
3. The installation of any septic system within the 100-year floodplain shall comply with the Weld County
I.S.D.S. Floodplain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic
system shall be installed within the floodway.
4. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any
development activities, the owner should contact Weld County to determine if the floodplain boundaries
have been modified.
Grading Permit:
Please add the following conditions to the resolution:
1. In the event that 1 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
2. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to
be utilized, and a copy of the approved CDPHE stormwater permit.

Environmental Health Services has reviewed this proposal for a trucking facility used for
hauling water to oil and gas sites. The applicant is proposing to construct a 100' x 100'
shop building for storage of equipment, office space and maintenance of vehicles,
including a wash bay. There will be up to 30 employees who will have access to the site
including office staff, shop/maintenance employees and drivers.
Water will be provided by the North Weld County Water District. The application
included documentation from the Water District indicating that they can serve the
proposed commercial facility.
There is an existing commercial septic system on the property that was designed and
permitted for 3 employees (Septic Permit No.1990016). The applicant is proposing to
install a new septic system for the proposed new shop/office building and abandon the
existing septic system. The proposed septic system will require to be designed by an
engineer. A watertight vault will be installed for containment of process wastewater
from the wash bay and floor drains throughout the shop. The process wastewater will be
removed and hauled to an off-site disposal facility. No process wastewater will be
discharged to the septic system.
General maintenance of vehicles, along with truck fabrication will be performed in the
shop. Many chemicals will be used for maintenance and repairs of the vehicles, such
as automotive fluids, oils, paints, and solvents. A spill containment kit will be kept in the
shop and employees will be trained on spill response procedures. There were no
details in the application regarding the type of work performed for truck fabrication, such
as welding or painting. If welding or painting are performed, the applicant will need to
contact the state Air Pollution Control Division regarding permitting requirements.
The waste management plan was found to be incomplete. The plan needs to include a
list of wastes expected to be generated from maintenance and repair of the vehicles,
including waste oils, antifreeze, batteries, scrap metal, tires and other scrap parts. In
addition, the names, addresses and phone numbers of the waste handlers and disposal
sites need to be provided. The applicant needs to include the contact information for the

• licensed waste hauler that will remove and dispose of the wash bay and floor drain
process wastewater.
The applicant submitted a dust abatement plan. The access drive parking areas and
drive lanes will be surfaced with gravel or recycled asphalt. Water will be applied on the
gravel surfaces to control dust when necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
Alternately, the applicant can provide evidence from the APCD that they are not
subject to these requirements.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
• 1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.

• 3. The existing septic system must be abandoned in accordance with Section 30-
7-70 of the Weld County Code pertaining to individual sewage disposal systems.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
• plan", at all times.
5. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of
the Water Quality Control Commission, and the Environmental Protection
Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
8. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.The facility shall utilize the existing public water supply (North Weld County
Water District).

• 11.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
12. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

E. Each building will require an engineered foundation based on a site-specific geotechnical report
or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
F. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be
determined by the Zoning Ordinance.
G. Building height shall be measured in accordance with the 2006 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 23 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
H. Provide letter of notification from Fire Protection District having jurisdiction prior to any new
construction.

Dear Mr. Ogle:
We have reviewed the above referenced site specific development plan and use by special
review application for a trucking facility on a 9.03-acre parcel. The trucking operation is described as
water hauling in direct support of oil and gas operations. The submitted material does not appear to
qualify as a "subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State
Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a
cursory review of the referral information and provide comments. The comments will not address the
adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any
County regulations or requirements.
• The proposed facility will consist of a water truck hauling operation as well as maintenance of
existing trucks and manufacturing of new trucks. The application estimates that the facility will employ
approximately 30 people, of which 3 will be full-time office workers and the remainder will be truck drivers.
Water at the site will be used by employees for drinking and sanitary purposes, truck washing, and dust
control. The source of water for truck filling was not specifically identified in the proposal. The application
proposes to construct a water quality control pond that will release storm water over a period of 40 hours.
Since the water will be retained for less than 72 hours, replacement of evaporative losses is not required.
The provided Water Supply Information Summary estimates water demands for this project to be
0.70 acre-feet per year. According to the submittal, water will be supplied by the North Weld County
Water District(hereinafter"District"). Wastewater treatment will be through an individual sewage disposal
system. Based upon the most recent information (dated September 29, 2005) provided to this office by
the District, the District currently has an adequate uncommitted water supply to provide the water
associated with this project. A letter of commitment of service from the North Weld County Water District
was provided with the submittal.
So long as the water for truck filling is obtained from a legal source, this office has no objection to
the proposed trucking facility. The North Weld County Water District would be considered a legal source
of water for water truck filling in addition to the other uses at the site. If you or the applicant has any
