HomeMy WebLinkAbout20111714.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #3902 - STEVEN AND PAMELA ROWEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 20, 2004, the Department of Planning Services administratively approved the request of Steven and Pamela Rowen, 5799 County Road 5, Erie, Colorado 80516,for Recorded Exemption#3902, to divide the property into parcels estimated to be approximately 2.26 acres and 1.5 acres, for property which is located on the following described real estate, to-wit: Part of the NE1/4 of Section 5, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services staff notified the applicant, by certified letters dated April 6, and May 4, 2011,that certain outstanding Conditions of Approval had not been completed and that the matter would be scheduled for a hearing before the Board of Weld County Commissioners unless written documentation was received requesting a withdrawal of the case, or the outstanding items were completed and the mylar plat recorded, and WHEREAS, after reviewing Department of Planning Service's concerns and hearing the testimony presented,the Board determined that said request shall be continued until July 18, 2011, to allow the applicant additional time to record the mylar plat. WHEREAS, after reviewing the matter and hearing the testimony presented on July 18, 2011,the Board determined that the remaining Condition of Approval has been completed and that Recorded Exemption #3902 shall be referred back to staff for processing. Staff Recommendation: The applicant has indicated she is out of town on 6/13/2011. Staff would recommend a continuance for at least 30 days. The applicant has been diligently working to finalize conditions of approval and I anticipate that all conditions of approval will be addressed and the plat submitted for recording within a couple of weeks. The recommendation by the engineer was to install a brand new septic system. I then spoke with Steve from the health department and the cost of installing a new septic system versus redoing the lot lines had to be considered. After calculating the expense we have decided to ask for the proposed lot lines to be changed. Below is a drawing of the new proposed line. (Hopefully, it turns out ok in this email.) I am also attaching a metafile in case the email is not clear. (The drawing is not to scale but will at least give you an idea.)The mineral rights would now go with lot B. We would have to seek an easement on Old Highway 52 for the driveway for the new lot A. Provided this change of the proposed division is acceptable to you, we will have our surveyor finish the survey and complete the plat for your approval to finish the conditions stipulated on our recorded exemption. They have instructed us to get in touch with our original soil engineer (Cecil Crowe of Alpha Engineering). He will be able to perform the soil analysis to satisfy them in order to relocate the house leech field to allow the necessary setback requirements. He has told us that he won't be able to work on this until October 23rd. We already have an excavator ready for when we get the go-ahead from the health department. Also, our surveyor, Gary Hammer, has most of the preliminary work done to complete the plat. (Ordinance 2002-11) 11) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal from roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. Our comments and requirements are as follows: COMMENTS: Old State Highway 52 is designated on the Weld County Road Classification Plan (FHU) as a local paved road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right- of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. (Lot B) The applicant shall utilize the existing residential access to this parcel. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. The District has reviewed the development proposal in terms of (1) available school capacity, (2) required land dedications and/or cash-in-lieu fees, and (3) transportation considerations and has the following RECOMMENDATION: the District is OPPOSED to the approval of this application due to this development's impact on already overcrowded school facilities. (1) SCHOOL CAPACITY The Board of Education has established a District-wide policy of opposing new developments that add to the student enrollment of overcrowded schools prior to the District's ability to provide needed facilities. Overcrowded schools are those that are projected to be at or above 125%of their capacity within 5 years. The Board has determined that school facilities operating beyond the 125%threshold impose costs on the District that begin to affect its ability to adequately provide educational services to the public. Because of the burden created on the District once a school exceeds 125% of capacity, the District cannot support a plat until there is a known date for capacity relief. Typically capacity relief can be established once the Board of Education sets a construction schedule for a new facility, sometime after a successful bond election. Once the date of capacity relief is known, the Planning Department can work with the developer on an appropriate phasing plan that coincides the completion of new residential units with the addition of school capacity for the feeder. Current capacity for this feeder along with the impact from this development is noted in the chart below. The applicant and the County should also be aware that the School Board has developed a mitigation policy that would allow the District to change its referral response for this application. Under the policy, should an applicant wish to begin construction on a residential development prior to the District's ability to provide additional capacity, the applicant may mitigate the development's impact on the feeder by agreeing to a voluntary, per-unit payment. Funds would be used to provide permanent or temporary capacity within the impacted feeder. The Planning Department would be happy to discuss this type of mitigation for the proposal with either the County or applicant. Specific comments concerning this proposal regarding School Capacity are as follows: • This application will add 1 new single-family dwelling unit with a potential impact of 1 additional student in the Erie Elementary and Erie Middle/Senior High School Feeder. The "Stdt. Impact" column in the above chart breaks down the development proposal's student impact by grade level. • Of the schools in this feeder, the elementary is expected to exceed 125%of its capacity in 5 years with the addition of students from this development. For this reason,the School District is not supporting this application at this time. • Currently it is unknown when the School District can accommodate future students in this feeder. Erie High School will be opening during the 2005-06 school and will relieve crowding at the middle and senior levels. Differing rates of residential growth in parts of the District and the budgeting of operating funds to staff new schools both affect the construction schedule of individual projects. (2) LAND DEDICATIONS AND CASH IN-LIEU FEES The land dedication/cash in-lieu policy of the District requires the dedication of land with the adjacent infrastructure and/or payment of an equivalent cash-in-lieu (CIL)fee based on the student yield of the development. CIL fees only provide funds for land acquisition, which is only a small component of providing additional school capacity for a feeder. Specific comments regarding land dedications and CIL fees for this referral are as follows: • The School District does not anticipate the need for additional school land in this area and does not request a dedication at this time. • Since no land dedication is required,Cash in-lieu fees will be assessed per the attached chart. 3)TRANSPORTATION Transportation considerations for a project deal with bussing and pedestrian access to and from the subdivision. Pedestrian access, in particular, is an important goal of the School District in order to facilitate community connection to facilities and to minimize transportation costs.Specific comments for this application are as follows: • Because of its rural location, it is unlikely this site will have pedestrian access to any existing or future schools. • Bussing for this project, under the current boundaries, would most likely be provided.
